- A man in Torrey Highlands is out $2500 after falling victim to a landscaping scam.
It’s a scam CBS 8 has covered before, where supposed landscapers show up at homes unannounced offering to put mulch in yards for $10 a bag.
When they’re done, they demand thousands of dollars.
"They wanted around $10 per bag of mulch. And usually, you know, looking at my front yard, I figured they’d probably only use about 50 bags of mulch, and so I agreed to the work," said Alex Sun.
Sun asked for an estimate beforehand but was told that wasn't possible. Two hours later, he received a bill for $5,000, the equivalent of 500 bags of mulch.

It is a civil matter. A contract dispute is not a police matter. It's for a judge to decide. How do the police know this is the scammer? How do they know the landscapers aren't the victim? Police and courts are NOT the same thing. I bet you're one of those people that call the police when the power goes out...

I have a roofing business and a lot of business is generated through door knocking because people don’t usually get on their roofs to see if they’re damaged. We go out to areas that have been impacted by storms and offer free inspections and then let homeowners decided what they wanna do after

If the contractors are not licensed, then it is a criminal act because they are contracting without a license which is a misdemeanor (B&P 7028). They are not entitled to any money because a licensed contractor should have done the work, not them.
Alex should have said, "I never told you to put that mulch down. Do you have my signature telling you to do it?"

I wanted some interior painting done and a neighbor referred someone. He came by an gave me a verbal estimate that was pretty low. I document everything and asked him to email or text a detailed invoice of what he was painting (walls, floorboards, doors, etc) with price. I contacted him several times and received nothing. He texted two weeks later and said if I Zelled the payment he could begin the job. I didn’t reply. He could’ve been legit but I’ve heard too many horror stories about people taking your money and not doing the work or doing the work and claiming you owe them additional fees. Get everything in writing folks!

I had everything together contractually and otherwise to have my home renovated for sale. In the middle of the job my painter either started some drugs or had mental health challenges. The first half of the work was great, then he never came back for weeks except to wander around and move his stuff from pile to pile. It was creeping me out because I am old and single. When I fired him I had paid 50% up front and I paid him the rest just to go away. He said the check for the payment was bad and went to the DA's office ranting that I was a criminal. They told him to go cash the check. Instead he left big notes on cardboard on the front of my house and stalked me when I walked my dog. I have moved and he still has an uncashed check. I was sad to stop contact with my old neighbors but I don't want him to find me. Just for some painting!🙄
it happens both ways too, I submitted an estimate, then a written one, everything agreed so we started the job, bought all the paint and needed from my pocket, we did the job and homeowner dont want to pay, that he was not in a sane mental state, to take him to court.

Unlicensed work over $500 , in California you owe NOTHING! Video tape them all, truck licenses, etc. Post no trespassing signs and use that $2500 to install security cameras. I just went through this is with a handyman, he got nothing of second half payment

Always insist on an estimate beforehand and make sure to get it in writing. If they won’t that’s a red flag
Their only recourse is to sue you. They’ll not win. They can’t just stand out on your lawn because you didn’t pay. The fact that it’s a civil matter means they have to sue you to get their money, not wait around. You can trespass them immediately, because they have no right to stand around till they get paid. Don’t let them intimidate you.

What can they do? It's a free market. If the guy is dumb enough to engage in business with someone walking off the street, he gets what he gets. Scammers are successful because they use the greed of the other person against them. They think they're going to get yard work at pennies on the dollar and their greed blindsides them from the obvious scam. I could tell it was trouble from a mile away when they approached my door. If I want my landscaping done, I'll call you, you don't call me, and you certainly don't just walk up on me from the street.
How do you figure these guys are a scam they came up they offered a product and service and these people agreed without an estimate up front and then they also chose not to watch the work being done and then when the work wasn't done complete and left a mess they still chose to pay them that's not a scam that's just called not being a good consumer

In my experience no one has that kind of " left over" product from a "job." It's usually stolen. The way they mistreated his landscaping and irrigation and left a mess tells you they weren't serious workers.
He should have checked on them outside, and got a license plate number before they left. Or better yet, gotten their business card and said you'd think about it first.

The same scam happened to me in Lakewood, CA several years ago. A guy came to my door with the same story. I assumed my lawn would not take more than 3-4 bags, but they came back and told me they used 30 bags and charged me close to $500. I was so upset. I will never buy from these people offering this service. Even my Mexican gardener told me that these scammers are looked down upon in the landscaping business.
So if you assume and you didn't get an estimate and you didn't get a bid then wouldn't that make you the person who made the decision to do that in the first place so how do you call that a scam you willingly allow people to do work because you saw a cheap price tag. You literally get what you pay for and you can't call it being scammed you pretty much did it to yourself not using common sense.

Homeowner: This is on you. When they said no hard copy of the dollar amount could be furnished,.......That is your RED FLAG. Bid them Audios, turn around and close the door!
We got this exact scam last month. My wife was home and agreed to let them do a small area in our front yard, and only told me about this 10 minutes after they started. It sounded wrong to me and we realized it’s a scam right away, so I rushed home to stop them.
The instance they learned that I’m on my way back, they started dumping all the “mulch” on to our front yard, and says “they’re done with the job”, all within 30 seconds and asked for $325.
I got home and things escalated right away, I was shouting and they were shouting. Police were called. When police arrived, he said it’s civil matter so we’ll have to settle or bring to court.
Considering they know where we live and who we are, I paid $100 hoping they’ll just leave us alone.
Please be aware of these door knocking scammers. Nothing is so urgent that you have to agree to a job on the spot to some random dude knocking on your door. Also, lesson learned for my wife, she’s not gonna fall for any solicitation / scam in the future. Again.

These are the wood chippers who are wood chipping on the next street over. They grind up the wood and then sell it to another neighbor as mulch. If you've ever laid mulch, you'd know it doesn't come in small bags like they used for big jobs. They deliver it by the yard in a big truck and dump it off in your driveway in a big pile.

Because it's not a criminal matter that these consumers were not intelligent about their purchase before they did it. They chose to okay and approve work and product that they didn't see and that they didn't get an estimate on not only is that not criminal but it's also not a scam.. What difference does it make if you get an invoice or estimate but the actual number of bags are significantly less than what is being used?

Even the guy admits in the video to no wrong doing because he paid the contractor for services. He should've paid $10/bag and told the contractor to sue in small claims for more.

There’s no recourse because San Diego is in a lawless state. In fact if it went to court the landscapers would probably be asked what they are owed and the homeowners would be told to pay.
As a sub contractor for a city, unless it’s on paper you don’t have to pay. They never gave you an estimate, nor explained how much work was going to be done for a rough estimate. Technically after you agreed to the service and they start, then yeah it does become a civil matter, they still have to take you to court and explain to a judge why they didn’t have a contract, which would then be followed by a review of the amount of work done and materials used and you’d have to pay an altered price by the judge or it would be thrown out of court for bad business practices

At that point, the police was in on the scam.
and kids, this is why you get an estimate before letting people work on anything, if someone isn't willing to give you an estimate it's a scam red flag

I live in Utah I guess our prices are good still out here.. 😺 nobody scammed these people they just thought they were getting cheap labor and cheap product and didn't bother to get a bid which was their error not the workers

Girl scout cookies, yardwork crew, snake oil salesmen, debt collector..... maybe your amazon delivery
If its family or friends, they will call/text before coming and upon arrival.
Ditch your doorbell.
That's why you always sign a contract first. Word of mouth can change very quickly and very drastically, and scammers have no morals so they will change their word on a whim.

He thought he was getting a cheap product and had no thought to the labor involved. He didn't bother to check the bags he didn't bother to look at the mulch he was purchasing he thought if he hid behind his little camera that that should be enough know you are not scams or you were just stupid and now you feel stupid and you know that you don't have a legal case and you can't go to the courts because you don't have a civil case because she paid these men for work that you accepted them to do without the proper information beforehand and that is no one's fault but your own

Today, people are afraid to tell others to EFF-OFF and sue me if you want your money.
I went to renew my driver's license this week and before I entered the DMV, some dude approached me with renewal forms in hand, asked me for my soon to be expired license and other info. Fill out the renewal form for me, even though I never asked him. And then afterwards charged me money for doing so. Turns out he doesn't work or have any affiliation with the department.
Never trust anyone going door to door.

Guys stopped by, said $10 a bag, one guy just started pouring it on my lawn to show the product but I declined and they left. Their product was junk! Weeds started to grow where the guy left the stuff.
I recently saw the same type of guys doing the same thing about a month ago but I don't answer my door to solicitors anymore.
I never give door knockers any time because my scam alarm instantly goes off

I have a roofing business and a lot of business is generated through door knocking because people don’t usually get on their roofs to see if they’re damaged. We go out to areas that have been impacted by storms and offer free inspections and then let homeowners decided what they wanna do after

Same scam got my girlfriend last year in Los Angeles county. I got home asked her what was going on and I stoped them. They wanted 2 thousand dollars for what they had done up onto that point. I told them to kick rocks and was ready to fight. They kept dropping the price to her and i still said no. She just wanted them gone so we agreed to $275.00. I wasn't planning on paying anything but my girlfriend felt so foolish once she saw what they had done to her and just wanted it over.
She is so lucky to have to. You are super smart.

They try to intimidate you, but honestly they have no real fight in them. Call cops, tell them to see you in court. They are scammers, not looking for felony assault rap.
Why didnt you scam them right back? Theres no documentation. That works in your favor as well. They wanna get paid for work? What work? Show me documentation that you did work. Show me an agreement or contract. Dont have one? Get the hell away from my house then

Have some balls man. Tell them you have them on camera and to get lost. You can just as easily not pay them, as they can try and extort you. You signed no agreement.
Ask for their contractor's license. If they don't have one, tell them to get lost.
This happened to me, but my BS detector went off when the guy claimed he just happened to have some sod left over from a previous job. Told him to get lost.
There are no “Victims” only volunteers. Never should have entertained a solicitation in the first place. But even after having been stupid enough to do so. Still didn’t have the intelligence to refuse the service after being presented the inflated bill. Should have told them to scoop it out, put it back in the sacks and get the heck off your property.
