Cases of matrimonial disputes coming before the Supreme Court are described in the present video with the detailed explanation of the process and the law.
The Supreme Court of a country, such as India, is the highest judicial authority and has the power to hear appeals and cases of national importance. Matrimonial disputes, which are conflicts arising from marriage or related matters, can reach the Supreme Court under certain circumstances. Here are a few key points:
Appeals from High Courts: In countries with a two-tiered judicial system, like India, matrimonial disputes can be appealed to the Supreme Court from the respective High Court. If a party involved in a matrimonial dispute is dissatisfied with the decision or judgment of the High Court, they may file an appeal to the Supreme Court, seeking a review or reversal of the previous decision.
Matters of National Importance: The Supreme Court may also directly hear matrimonial disputes if they involve issues of national importance or if they raise significant questions of law. These cases may have far-reaching consequences or impact legal interpretations, and the Supreme Court may exercise its discretionary powers to hear them.
Constitutional Matters: Matrimonial disputes involving violations of fundamental rights enshrined in the constitution may be brought before the Supreme Court. These cases may address issues such as the right to privacy, equality, or freedom of religion, among others.
Special Leave Petition: In some legal systems, including India, parties may approach the Supreme Court of India by filing a Special Leave Petition (SLP). The Supreme Court of India has the discretion to grant or reject the SLP based on various factors, such as the legal issues, legal importance of the issues involved or the need to secure justice in the case.
Transfer Petition before the Supreme Court is filed by either of the party for transfer of the divorce case filed at any place. The other party always seeks to get the said case transferred to the place of its convenience. The case can be a divorce case or a DV case or any case related to the matrimonial dispute.
