@kipskip_ He couldn't flag it anyway because he doesn't own the video, 99Designs does. He showed their website in a video that he then monetized by trying to sell his DVDs.
So by his own logic, he never owned the video to begin with and he copyright infringed on their property.
But to use real life logic, they might actually have some sort of case since he showed that page in its entirety and it wasn't new or transformative and it could theoretically be used as a replacement of the website instead of going to that page. A very loose argument but it makes a lot more sense than his does

But in all seriousness, Derek needed to just grow up. It was so childish the way he created one big warbler over a critic giving him advice and pointing out the movie's many flaws. IHE actually brought up some of the biggest issues in Derek's writing, like how it's Cool Cat's own fault that Butch was threatening to get him after Cool Cat replied to a mean text from him. I don't even know if Derek knows this, but that is something that you DO NOT do when a bully is targeting you.
