    Hello, how are you doing my name's Keith and I'm a dad, and I pay child maintenance through the child maintenance service. So I thought today, I would talk to you about what happens when someone reports that you haven't paid, and what happens next.
    Okay so, in order to report a missed payment, the CMS system shouldn't allow you to do it until three working days (was 5 working days) have passed, so if you're due to pay on a Friday, then the following Friday if you haven't paid you can get reported, or if you're paying parent you can make sorry a receiving parent you can make the report that the person hasn't paid so what happens next is the CMS will send a text message to the last known phone number that they have it will say, somewhere along the lines of, it's been reported that you haven't paid Child Maintenance please contact them so what do you do next.
    Well you can ignore it because maybe you have but the trouble is if you ignore it automated systems may mean that something may happen anyway, so what experience tells me with CMS that essentially you have to make a response and that response needs to be done normally within 14 days so what what you should actually do if you are a paying parent is respond within 14 days and obviously the quickest way to do that is via the portal.
    I do appreciate though that some people refuse to use the portal but what I would say is, if you use the portal it goes directly to your CMS account and therefore it goes directly to the person dealing with it. If you send evidence by post it could get lost in the post, but also all post that goes to CMS does not go directly to CMS, it goes to a mail handling centre, which is run by a private company.
    I'm not quite sure of the process but I believe at that point they scan your mail into the CMS computer system and obviously it gets allocated to a case and of course if you don't send information that identifies who you are, t's possible that they will get it but they won't be able to match the information to to you. Maybe because you've not put your reference number on there, or maybe because your name's John Brown, and there's 15 John Brown's, but you've not given your address so that's why I always say use the portal and for those who use the portal you go to the portal and you're essentially complete an online form. So you know all that I'm aware that there are some people out there that have this happens to them quite often, so I presume if they're not already doing this they do this, you just go online you fill out the form and it will say on there you haven't paid from such and such a date it will then list your payments. You then type in how much you've paid and you press submit then you need to back that up with supporting information.
    This is the time where you take a photograph of your bank statement and you upload it to the portal obviously the portal takes certain file types jpegs PNG files which are the normal files that you use for sending pictures, so you can send the pictures you can do this from your mobile phone you don't need to sit next to a computer and then of course at some point someone from CMS will look at this and make a decision.
    I personally would challenge and keep on challenging until I get an answer so if I'm accused of not paying, then clearly I would submit the information as quickly as possible to prove it, I would then probably follow that up with an email now obviously the CMS normally don't have emails but you can always email the correspondence@DWP.GOV.UK email address there are other email addresses that float around but that's the one I suggest you do because at least then it's going to the Department of Work and Pensions. The Child Maintenance Service (CMS) is a part of the Department of Work and Pensions.
    If this keeps on happening to you, this is a form of financial abuse so if you find you are regularly being asked to pay prove that you've made a payment and you've made those payments report it to CMS when you upload your evidence upload a letter and ask them to record on your account that you are being financially abused and that your ex does this from time to time.

    My ex owes £1000 in arrears didn’t pay his monthly payment reported it ask to go to collect pay accepted it took a yr then went back to direct pay and surprise surprise he missed the 1st payment reported it ask to go on collect pay again properly take another yr while system is an absolute joke

      They have to take people off of Collect and Pay after 12 months.

    The CMS kick in arrears and issue DEO if in a job. 3days now not 5.
    Then CMS make it up from there.. so you miss a payment and end up having a situation of made up arrears of thousands so You miss a payment your knackerd…

      Hello, thank you for your lovely message. I try to help. The current CMS system is not fit for purpose. It rewards parental alienation. Please ask questions on the facebook page, because if I dont know the answer some will. Remmber never pay the arrears figure, because the payments are built into the plan. Dont be frightened by the arrears.

      @@ImpartialDawn A common theme with cases is that once CMS is involved contact is often refused, or reduced as there is an incentive to have less shared care with the paying parent who ends up paying more. It’s a common complaint and a common experience for many. It rewards alienation as parents with care can receive more money for less contact. Of course the parent with care would argue they receive more money as they spend more time looking after the child.

      @@childmaintenanceuk ill assume that youve analysed the data and it is true that the existence of child maintenance cases is a driving motivator behind removing contact
      assuming the above is true, do you think its reasonable to blame the CMS for this trend? outside of ending provision for shared care, could you even think of a single thing that CMS could do to reverse this trend?
      would it not be a more logical conclusion to blame this on human nature - i have no doubt that a lot of receiving parents are greedy as a lot of people in general are greedy - to anyone who is being wrongfully denied child access, they have my genuine sympathy and i hope they succeed in the courts - but CMS is just a party caught in the crossfire

      @impartialDawn - Your knowledge betrays that you probably do, or have worked for the CMS, and have therefore come across a range of cases. The current shared care bands do cause issues. I suspect if it were only possible for a receiving parent to receive 5 out of 7 nights, there would be a lot more parents with 2 night per week arrangements.
      My own case was set up as 1 night shared care with me, in seven. It was actually three. It took nine months to get it corrected. Even when the ex admitted to 3 nights per week, and it was recorded on the CMS system, they wrote and told me it was 2 nights per week! It was only when I obtained the case notes, that I became aware that she had said it was three nights with me, and it still took 3 months for CMS to update.
      Then there are the countless cases of 50:50 that are fought over. Is there a better solution? Difficult to say. What would you do?

    If I’m due to pay Saturday 01/07/23 I have basically have 5 days after before she can request collect and pay or contact CMS? Thanks

      That is correct. Due to the volume of people that may be a few days late, CMS dont classify a payment as late until 5 working days has passed.
      However you should not be consistently late.

    this fellas advice about emailing some random DWP email address re/ your CMS case may just be one of the worst bits of advice ive ever heard - its always a better idea to speak to ur CW directly, granted the phone lines can be long at times
    The smartest thing to do is to open the notes section on your phone, write something like "can my CW call me tomorrow at 4.30 PM please as i want to discuss some issues with my case", then screenshot this and submit it to the self service portal - as correctly pointed out in the video, this will go str8 to your caseworker who will be obliged to call you back at the time requested

      correspondence@dwp.gov.uk is not a random email address. It is a proven address for contacting the CMS, which is a part of the DWP. Many people dont use the portal and prefer to email. Particularly as the CMS have scrapped the messaging service on the portal.

      @@childmaintenanceuk i have no doubts that emails sent to that email address can get filtered down to the relevant caseworker - but this relies on the email getting passed around like a hot potato by many parties before it arrives with your caseworker
      emails also need to be scanned on to CMS' system (by the same scanning company in Wolverhampton no less) before they reach your caseworkers eyes and can absolutely fall to the same issues with physical mail you gave in the video - in a lot of cases the email will sit around for weeks before reaching your caseworker, and sometimes never will if the correct identifiers are not attached to the email - whereas the method i mentioned would appear on the system, for your caseworker, within the hour
      not even mentioning the fact that the reason CMS no longer sends or receives emails is because they were deemed a GDPR risk - maybe ur comfortable potentially leaking ur own private info to the world at large, but its irresponsible to do so with your children's data

      No John I dont work for them, and Serco dont wont the DWP either. But I have been asked by people. What happens if I ignore the CMS letters as I have a private arrangement, so put this together so people know.
