He also just straight up lied in his deposition and said he wouldn’t have played with a red joystick.
It doesn't/wouldn't matter anyway since it's highly likely that he didn't get that score that day on that machine and the footage was achieved on another day, on another machine.
We don't know for sure that it was an 8 way joystick. It doesn't matter though. Billy proved he never played on that machine. They just brought it in with a pre-taped MAME score. The people running the show said he "set" the record so fast early in the morning they hadn't even gotten everyone there yet. It takes 3 1/2 hours to get to the kill screen. Apparently Billy did it in 30 minutes LOL
@@SayAhh We all know he didn't set the score on that machine. We know he brought a MAME tape with him. The problem is we don't have an eye witness account of that, so it's speculation. The red joystick is a smoking gun proving the score was illegal. That's the problem with the legal system. Even if you know something to be 100% true and obvious, you still need "proof" by their standard.
They also got Billy to purjur himself.

Let's not forget about Jeremy Young. He was the original person to discover that Billy was using MAME. Without his findings, Billy probably would have gotten away with it. And also Apollo Legend (RIP) as well.

It's not just that the "rules state" it must be original. It's actually... a grey area because old Twin Galaxies played fast and loose with rules, I'm not even certain it was a written rule at the time of the score, just that the PCB must be original, unmodified.
HOWEVER, the affidavit of the machine's supplier goes out of his way to state multiple times that *everything* was original, and unmodified. And that's a big, big yikes. Bigger yikes, honestly. We've got 'telling lies directly to the judge' on the menu, not just "oh, they must have been some kind of mixup" or "*technically* it wasn't a written rule at the time" excuse.

The issue isn't so much that it was replaced, but replaced with an upgrade. In Donkey Kong the original joystick could only touch one of the four contacts at a time. This joystick is capable of touching two points at a time.
The movement of the barrels is not completely random and is influenced by the last direction pressed (left or right). That meant if you were climbing the ladder and wanted to change the x-axis status of the joystick you would have to momentarily stop climbing to press left or right. With an 8-way joystick like this, you could press left or right without stopping, gaining a competitive advantage.

Normal players back in the day weren't looking to get their scores recorded at Twin Galaxies, but Billy was, so he had to play by the same rules as every other competitor or he was cheating. It might not seem like it matters, but this time its someone else suing him for fraud. And because he's a pathological liar, he isn't doing so hot in the court (he and his lawyer also caught forging evidence).

The 4-way action of a Donkey Kong stick is the result of a restrictor plate in the deck. The Twin Galaxies rule saying the stick had to be the original height was put in place 2 years after this game was played. Billy Mitchell might or might not be a cheater but this photo is not proof of anything.
Except Bully has always claimed he played on original unmodified hardware. This is proof he's a liar. The stick is also and 8 way stick as opposed to a 4 way stick. Therefore giving him an advantage, and confirming he is a cheater.

He cheated beyond that by completely faking scores, but the unoriginal joystick meant he played on modified hardware which meant his scores had to be removed (the stick also has advantages if my memory serves correctly). Karl Jobst has a billion videos covering this but Billy Mitchell is a complete con artist and a compulsive liar.
If you leave out all the swearing this clip would be four seconds long, and MUCH nicer to have to listen to. Grow up.

The rule states
• The joystick itself MUST be an original stock 4-way Donkey Kong arcade joystick, or a replacement 4-way joystick of exact size and shape as the original Donkey Kong arcade game joystick.
You can't tell if that is a 4 way or 8 way. Also it may have been swapped out when he played it.

It does matter because the stick has 4 extra directions that the short black stick does not have which gives him extra control of the character that is not intended for the original arcade machine. The original stick goes up down left right. The red stick does that but also can go diagonally which changes how you control the character on ladders and makes the game easier.
So, it's really not the same game at all.

The joysticks color is mostly irrelevant. The issue is that it's an improvement. With original equipment you can't hold the joystick diagonally. You instead had to stop holding up when you reached the top of the ladder before moving left or right. This joystick allows you to hold up and left, for example, so that when you reach the top of the ladder and can't go up anymore, you'll immediately proceed left, no manual adjustment required.
The lawsuit claimed defamation which requires the defendant to have lied. The photo proves that the comment was true, that Mitchell did cheat (even if unintentionally). It's highly unlikely that he wasn't aware of the swap or that it was changing the control of a game that he has been playing competitively for decades.
Because he is suing people for defamation.
