  • It's one thing to know what makes a good witness performance on cross-examination, but it's another to actually see it in practice. So, in this video, we're going to watch an example of a really good mock trial witness on cross and break down their performance.

2:34 THANK YOU for saying this. Biggest issue I see with witnesses on cross is the complete, irrational compulsion to fight _everything_ the crossing attorney says. Your likability as a witness is your most important weapon, so agreeing with the other side can be just as powerful as refuting it.

Absolutely! And, after all, what makes you look less guilty...simply saying "yes that's correct" or "yes, however, if you really think about it, uh, the truth of the situation is, blah blah"

Teaching when and how to have just the right amount of fight and not agreeing to things that are just completely wrong.

It would be interesting to break down the process of objecting, when to, when not to, all that fun stuff. Very good video!

does stating “i didn’t say that” when regarding specific statements that aren’t word for word as specified in your affidavit possibly affect your likability as a witness in a negative way?

It depends. You don't want to get into a semantics battle--something like "I said 'warm' not 'hot.'" Stuff like that will definitely make you look silly and unlikable. But if it's actually something you didn't say, stand your ground!

question, how do you move on as a witness if you get impeached

Don't get impeached to begin with 😂
No but in seriousness, just keep your confidence and composure. Don't let it rattle you or change your persona.

I thought she seemed to be winning. Showing him on paper that the bank specified he was behind. The excuse that the bank was wrong seemed very lame to me.
