In other words, can they be given a permanent resident or immigrant status? Indeed, by marrying a Filipino citizen, a foreigner could qualify to apply for a permanent resident visa, subject to other qualifications. 2 pathways by which a foreigner spouse may apply for a permanent resident status in the Philippines: one, is the 13(g) visa and the other is the 13(a) visa. There third one known as the SRRV or the Special Resident Retiree’s Visa, but I will not discuss it here because it is not dependent on marriage with a Filipino citizen. I will discuss that in a separate video. Under the 13(g) visa or also known as the Balikbayan Visa, a foreigner spouse as well as the unmarried minor children of a former natural-born Filipino citizen can be included in the application for non-quota immigrant visa in accordance with Section 13(g) of the Philippine Immigration Act, as amended. For 13 (g) visa to apply, the applicant foreign citizen must be the spouse or child of former natural-born citizen of the Philippines, who was naturalized citizen of a foreign country and intends to return to the Philippines for permanent residence. The 13(a) Spousal or Marriage Visa, on the other hand, is issued to foreign nationals who have contracted a valid marriage, recognized by Philippine laws, with a Filipino citizen. The application can be made in the Philippines through the participating office of Bureau of Immigration or abroad though the Philippine embassy or consulate. For 13 (a) visa, it requires that the applicant foreign citizen must be the spouse or unmarried minor child under 21 years old of a Philippine citizen. In the case of the spouse, there must be a valid marriage certificate recognized by the Philippines. It also requires a sufficient financial means to support themselves and their family. The 13a is a multiple entry Non-Quota Immigrant Visa type, which means there is no annual limit on the number of visa applicants and the visa allows for permanent residency. So, both the 13(g) visa and 13(a) visa are Spousal Visas allowing permanent residency to foreign nationals with Philippine citizen spouses. The difference is the current citizenship of the Filipino spouse. In the 13(g) visa, the spouse is a former natural-born Filipino citizen, whereas in 13 (a) visa, the spouse is a Filipino citizen. You use the 13a when your spouse is a CURRENT Philippine citizen. You use the 13g when your spouse is a Balikbayan, i.e., a returning former Filipino citizen who is now a naturalized citizen of a foreign country. The grant of permanent resident visa works on the basis of reciprocity. It is available only to a foreigner whose country of origin also grants permanent residence and immigration privileges to Filipinos. Permanent residency is available to foreign nationals from any of 84 countries with reciprocity agreements giving the same immigration privileges to Philippine citizens.

    Hi Attorney, My mum is a Filipino but after marriage to a foreigner as in that country duel citizenship wasn't allowed when she was applying for citizenship. I would like to know how can she apply for citizenship back in Philippines? As we weren't born in Philippines how can we children apply for PR??

    I had my 13a probationary visa but unfortunately my wife died during the probationary period and immigration informed me that the visa would be canceled because she was the petitioner, i was told i can go back to a tourist visa but i said why should I be a tourist when ive built a home here im taking care of her daughter paying her school fees and meeting all her needs also helping my late wifes parent's..im still in the appeal process

      I have a 13G visa. I have been married to my wife for 34 years and we have one daughter. We have a built a home here in the Philippines and I have a good pension. I was also told that if my wife dies my 13G visa would be revoked and I would be only allowed to stay in the Philippines as a tourist visa.

My wife and I were getting ready to retire in philippines, she was filipino myself Ozzie, we have children and property in philippines but as she has now died after 40 yrs married I can only go as tourist but I could apply for srrv visa but more expensive.

    Many thanks for your explanation & i would like to ask regarding
    Egyptian national (male) married to filipina, why they are not qualified for 13A visa while Egypt is already included in the 82 countries list who have reciprocal agreement for rhe same?
    And only can apply for TRV temporary residence visa which is valid for 1 year as probationary & then renewed for 3 years of each time of extension/renewal.

    Hello Attorney. I recently watched a blog you posted regarding Philippine banking.
    I am now a US citizen. Before migrating to the US I worked for 16 years in the Philippines & have contributed to SSS. I no longer have a Philippine bank account, I closed it in 2017 bec it was considered dormant by the bank & I was advice to close it.
    My question is, can I open an account in the US (PNB) & uses that when I will apply for my Phil SSS pension?
    I tried opening an account with SSS & they require me to have a Philippine account to deposit my small SSS pension.

    Hello Po, India now provides OCI(which is a PR status) to Filipino Spouse (I have done for my wife). However I see it is not on the list of 13A visa. Is there any reason?     The one thing no one talks about is how to renounce your usa citizenship by going to a Philipino Consulate and surrender your passport to seek Pinoy citizenship only to get visa snd own property. That part is never covered any place I can find online. There is no need for a special visa, you simply swap out.

    Hello Attorney, I'm a Filipina and my husband is a British, we live in England. We're planning to go back to the Phils. as soon as my husband get retirement pension in the near future. On our research, we found out that if ever the Filipina passed away for example, my foreign husband will lose the permanent residential in the Phils? I think my husband need a security as well on this issue because we don't know what can happen in life, we will sell our (use to be his) property here and then if I go first he has no where to go.       Spousal Visa is dependent on the subsistence of the marriage. The death of the Filipino spouse will result to the expiration of the visa. You might want to consider the Special Resident Retiree’s visa instead.

    I'm a foreign citizen and I have a son who was born here in the Phillipines, I have a 5 years relationship with his mother who is filipina and we live together for almost 3 year. I can not marry his mother because she married 10 years ago but his husband abandoned her 10 year ago after 1 week married and since that moment they don't keep any communication.
    Is it possible I can get a visa that allow me to work and reside in the Phillipines so I can support my son and his mother? What kind of visa can I apply?

      Depende po. Kung may valid visa naman po sya, hindi naman po. But if nag-overstay po siya, lagpas sa allowed period of stay ng visa nya, maaari po syang ma-deport.

      It seems to me that your child is a dual citizen by birth. Children born of a Filipino parent acquires the parent’s Philippine citizenship. If your child is a Philippine dual citizen, you may donate your house and lot (I assume that it’s house and lot) to your child.
