Is there any recommend duration after which I should put my application for the spousal open work permit? Some people are recommending me to apply after the completion of my wife's one semester (i.e. after 5-6 months), let me know your thoughts, Is it mandatory that i can only apply for open work permit, once she completes 6 months of studies? or i can apply early. So my girlfriend is trying to sponsor me for the common-law spousal sponsorship and I have some issues that I really need answers for pls. She's currently struggling financially even though she has a full time job but have been home sick for the past three months. She has also in the past taking student loan for her career education and I'm wondering if these two issues will be a problem if we decide to put in an application? I have also overstayed my visa for the past 7 years because an immigration consultant screwed up my application for PR and got me in a limbo so got my working visa and passport expired. I had applied for H&C after that but got refused based on some strange facts and not about me overstaying my visa. Will these things be a problem for me if my girlfriend has to sponsor me in Canada?

      - rental agreement showing both the sponsor and principal applicant as occupants of a rental property
      - proof of joint utility accounts (e.g. electricity, gas, telephone, internet, etc.), joint credit card accounts, joint bank accounts
      - vehicle insurance showing that both the principal applicant and sponsor have been declared to the insurance company as residents of the insured’s address
      - copies of government-issued documents for the principal applicant and sponsor showing the same address (e.g. driver’s licenses)
      - other documents issued to the principal applicant and sponsor showing the same address, whether the accounts are held jointly or not (e.g. cell phone bills, pay stubs, tax forms, bank or credit card statements, insurance policies)

    • @JadeCalver
      @JadeCalver  Před 2 lety +1

      Hi there,
      I’d have to look at statistics to pull an exact number, but generally my advice is that you need to have really strong proof of common-law in order to be able to file under the CLP class. When the CLP period is short, we need to prove each month of cohabitation. Read more about my services and book a consultation if you need more assistance www.calverimmigrationservices.com/about-calver-associates

    • @JadeCalver
      @JadeCalver  Před 2 lety

      @@parvindersingh4591 Not necessarily, it more depends on the strength of evidence of the relationship. If a CLP couple have been together for quite a long time and have lots of evidence of cohabitation, this would be stronger than a very new marriage. With this being said, a marriage exists by law, and a common-law partnership by fact, so the common-law partnership application does usually require more evidence.

    I did my application on my own and came here in 5months you can too if you want. Great video Jade Calver.
    If anyone wants to follow my channel of how I did it on my own visit my channel. I am not an immigration consultant or lawyer but I am very street smart. If you have extreme cases then I would recommend the use of a lawyer. It's not as difficult as you all think.
    All the best Jade, also if you should I think Jade would be a great person even though I don't know her but its best if you let someone from Canada help you with your immigration process.

      @JadeCalver  Před 4 lety

      Hi Rida. Arranged marriages, especially ones that occur quickly, are typically subject to extensive scrutiny by Immigration Canada. It can be difficult to prove that your relationship is genuine without evidence of ongoing communication and relationship development. That being said, it's not necessarily impossible. If you'd like to discuss your case further, you can contact me by email at admin@calverandassociates.com

    We have been married for a year ,we used whats app to talk every day but we did not save copy of those chats neither my husband.The worst case is that my phone got broken so I lost of the history of our chats. I have some from after a month ago when I got a new phone. We have flight bookings,many photos together,I am not in canada yet,my husband is in canada and we are applying soon but we are recollecting all we need for the form.I am concerned it might get refused because we both do not have evidence of our first chats.Do you think this can really affect the process of being approved?

    I am planning to marry my Brazilian girlfriend... I do have records on Messenger, and WhatsApp.... Also been to Brazil 4 times now and hundreds of pictures... But her English isn't so good at this time... Would that harm chances???

      @JadeCalver  Před 4 lety

      Hi Boyd. You can see the full requirements for spousal sponsorship here: bit.ly/38HqpuH
      Your spouse will have to answer whether or not she can speak English and/or French on the application. However, IRCC states that "This question is not for selection purposes. One of Canada’s immigration objectives is to support and assist the development of minority language communities in Canada." Visit the link above for more information.

      Hello. I would advise you not to disregard Facebook logs. We often use social media screenshots as proof of correspondence and proof of relationship. Social media is also great because it shows time stamps. So, we often use this documentation as proof in an application. Best of luck!

      You would need to check if your current wedding document and marriage are recognized in Canada. You can refer to this page for more information: travel.gc.ca/travelling/documents/marriage-overseas

      Hi Qasim, you'd need to check Turkey's requirements for marriage licenses and then confirm whether the marriage would be valid in Canada.
