NJ Foundation Repair Gone Wrong - Cost and Who Pays the Price ?

  • Construction Codes were created to organize and conform all Construction methods to ensure safety and structural soundness. Township Building Department's were created to assist the public with conformance and review details of all Permit Applications and I for one am glad they do. Getting on the right page before starting a job saves us all from costing ourselves more money. A Township Construction Department is vital for public Safety.
    Once upon a time they were called Inspectors. Of course we all need them to inspect, double check and if we missed something or made a mistake, point it out so we can fix it. None of us are perfect and we do miss things and sometimes do something the wrong way. And that's how the permit process should go. Nice and friendly and professional.
    Once upon a time their Title Was Inspector. Now it's "Code Enforcement" ? I don't think I like that tone. Do you? In that has become an attitude of conflict. Why can't we all get along? - Daniel J OConnor
    This is a Foundation repair job but I will also do a foundation waterproofing job on the exterior and a Basement Waterproofing job on the Interior.

      He is the voice of many in NJ, the environment makes you this way, the Russian or Italian mafia has managed to make them evolve under extreme anxiety, fight, roll over or die. Say South Amboy, to Travolta or Sayreville to Boin Jovi,. my neighbors, and THEY WILL FILL YOU IN- BUT stiil wish to save some Pride in the Green covering all the EPA Superfund dump sites everywhere around the Raritan Bay..

    Crazy situation to be in! But the #1 thing I can tell about you is you take your craft very seriously and passionate to deliver quality work to your paying customers who put their trust in you! Especially with what for most people is the largest investments of their lives (their homes), and having homes needing structural repair is probably something very concerning to any home or property owner!!!
    You've obviously been around the block a few times and know the drill. I'm an HVAC contractor myself.. been in HVAC for nearly 20 years.. had frusterations myself! But at the end of the day we all have projects that need to get done. The city by no means should have held yours and your customers repair up that long!!! What a disservice to you and them! Especially when they through taxes as well as the permit and inspection fees is paying all their wages!!!
    To the one commenter who said not your problem, let the homeowner deal with the building department, and sue them when the basement gives way.... That's definitely NOT the way you handle your business! You wanted to repair the issue for the homeowner and all be happy. But ended up having tons of your time and money wasted dealing with lazy city department staff!
    Great video! Sorry for all the issues! Great insight! Hope when more of the community sees how their tax payer paid departments operate that they will demand some changes be made!

    I watched your video's Daniel. Thanks! I have a 107 yr old house, a 9ft static water level and a 5ft deep basement. After continuous water pushing up thru the floor I gave it a go and dug up the floor. I put in a drain like you show and a 30in basin with sump. Then I chiseled out all the mortar between the stone walls and remortared and sealed. This thing works great, haven't used the dehumidifier yet!. This thing has pumped 1000's of gallons of water out!. Thanks for the videos. I'm in the cleve,oh area. Guy I know spent 15k on one of those bogus systems that aren't deep enough. Ha ha ha he still gets water and they won't fix it. Took me 2months to do it right by myself!.

    @Daniel J, OConnor, I hope you see this. Just saw two of your videos. Read most of the comments, too. I just want to say a heartfelt, "THANK YOU!!!" Your video just made me change my mind about buying a house with a bowed in basement wall. I was thinking that maybe it wasn't so bad...the basement doesn't look/smell wet, so I can fix that down the road. Nope! I am going to leave that house alone. Thanks for the education. There are some of us out here (widows/singles) who have to fend for ourselves in these male-dominated waters, and we can get fleeced without proper education. Again, Sir, my thanks.     Ive been a claims adjuster for 14 years and built homes/remodeled for 10, and I’m always learning. I’m here because I’ve learned a TREMENDOUS amount from these videos. It is clear he knows what he’s talking about. I’m leaning towards a suit being filed namely by the township engineer and township for unreasonable delay and expenses

      Hey Chris, this kind of township bullshit never ends and it's getting worse. We're all better off, even all homeowners, to go ahead with jobs without permits. I'd rather pay a $500 - $1,000 fine than deal with the continued nonsense. Thanks for your comment.

      Daniel J. OConnor I’ve reroofed a few without doing my mid inspection and was threatened by the building dept inspector that he could make me tear it all off, but I took LOTS of photos during the process to show correct installation, and they let it go. I’m on the same page.

    The homeowner should have been notified earlier and gone down to the town hall themselves to get this moving and looked into their property file. This delay could have all been avoided.

    Sounds like the township doesn't want this home repaired. Somebody in a high place, wants that lot for their own purpose. Nothing like butting heads with corruption.

      That was exactly my thought also! I'm just a person watching a video; I don't even currently own my own home, but I found this video so disturbing that I was gritting my teeth! That, so called, Engineer should be fired! And if I were the homeowner of this particular house, I would see that he was! To the Contractor:
      I'm sorry for the frustration and stress this caused you. I could feel your pain; and I have to say that, had I been in your position, I'd probably be in prison for assault and battery, at the very least!

I am a power generation contractor and I have burnt up thousands of hours over the years that weren't paid for just because of this kind of crap. You can't stick it to your customer just because some bureaucrat wants to lord over someone.

    had a water problem in a creek bordering my house. steel corrugated drains were always draining even during long summer droughts. i called south bound brook engineer and borough hall and my calls went unanswered for 2 weeks...til i called the e.p.a. they came right away and found that the builder of the new house across the street had run the sewer waste into the line for rain sewers which dumped into the fresh water system. strange how quickly the officials responded after the e.p.a showed up. the homeowners were booted out of their house since they had to turn off the water until the road could be dug up and the pipes reconfigured. also strange how there was never a mention of the answering system problems in the borough hall, which is why they said they didn't respond. they never got the message. and if you believe that, i have a lovely bridge i'd like to sell you.

    I can tell that the Town Engineer was out to screw you over at what ever cost to you. That is too bad. It is called abuse of power. The engineer and his staff should be fired!!!

      sounded like they were working against the mission of their department and have abandoned their fiduciary duty to the residents of the town, probably had alternative motives such as being the first ones to build a new house there.

    you kept your integrity thru all the RED TAPE. thank you. i to need a water barred from entering on the top plate of b-ment wall. i'm on a hill and previous work has rotted away left with sunken South side thats uphill. what is 'anmenitys', its on my deed, i also have gutter downspout going thru a concrete sidewalk but to where ?.     Sir, Integrity is a costly virtue. Anyone viewing this can see your passion for a job done correctly to a high standard. I am part of a Zoning Department for a small town. Our Mayor would have drug our Building Inspector to that job site if he pulled something like this. Thankfully our Building Department shares your passion for a job done correctly.

      Hello Abby, Frankly I can safely say you are disillusioned. Ask a friend to apply for a permit in your town. Something simple and somewhat not very important. Your Building Department people will make it difficult for your friend. Treat your friend as a sub human. They will be extremely impolite and self exulted. I've one of these again. The counter person wants us to prove we are not doing electrical work by having the homeowner write up something, also wants us to get a plumbing permit applied for when there is no code requirement for such. Still we must apply and write in "Exempt." They have treated my assistant condescendingly. We have made three attempts and yet more is being required to the extent of having my Engineer provide sealed drawings. I must pay him $800.00 for the drawings. FOR A BASEMENT WATERPROOFING JOB? A $7,500.00 JOB?
      The job is now without any profit and I am not going to do the job. Imagine that? All that I have done to create a business and do what I do is totally negated by my attempt to get a simple Permit. --- With the Township we are dealing with now, my assistant will not let me involve myself because she knows I'll go to that office and go off. I haven't and I won't because I am not going to do the job. So please do have a friend apply for a permit in your town and see what happens. To you it may be unimaginable but after your experience, perhaps you might realize why all of us out here would avoid applying for a permit at all. And bye all means don't take the word of a Contractor. Ask a neighbor or any one who has applied for a permit in your town.
      Do note I have no idea what town you live in. They're all the same. 95% of all Construction Department Employees seem to have had to take a course on How to be an Arrogant, unhelpful, impolite and condescending ass hole before getting the job.
      Some say I'm my own worst enemy by acting like a civilian who is intolerant of their bullshit. Yet I shall continue to do so and I will continue to remind them in no uncertain terms that I AM THE CIVIL AND THEY ARE THE SERVANTS!
      Make no mistake I did get my attorney on this and letters were sent to the Mayer, Township Attorney, Committee members etc. I HAVE NOT LET THEM KNOW THIS VIDEO EXISTS. I do have future intentions for it but won't get into that. And bye the way, I am so looking forward to the next permit I apply for in that Township. I shall do so myself and bask in their kissing of my ass.

      If the person applying for the permit has influence and the right friends, the permit will be approved with no questions asked or maybe a permit will not even be required. Unfortunately, where I live, going higher up does not help. Everyone here in charge is part of an old boys' club. You can't even go to the newspaper because they refuse to write an article that will cost them advertising dollars. The local, county and state police in the area are part of the club. Court is not an option because the lawyers will not take sides against the powers that be plus the judges are elected and the powerful have many friends/votes. If you try to fight, the police look the other way when acts of vandalism and retribution take place. So, you either play the game here or move. Sadly, hundreds of decent people with pride of ownership moved. The town is now 52% rental and the only people making money are the connected ones. All of this sounds like it is coming from a crazy man and that is exactly their defense... nobody else is complaining, nobody else has a problem.... this is because they are afraid or have moved.

    Here in Florida inspectors are required to come to the site if requested. They can't tell you no.
    Inspectors can not interfere with the progression of the work. Sure they can tag you and you have you make corrections but they can not make you wait for them. You might wait until next day...that's it.
    You sir, have an intentional effort to slow or stop your work. Someone in that city office has an issue with you or the property owner. Welcome to union workers B.S. Add a lawyer as a signer to your company and have him pull your permits.

    Did you ever get to see the records, if they existed? I have to say that the building codes here (in the UK) are actually more stringent - but at the same time you could call out a Building Control Officer for a situation like that and probably get a visit within 24 hours. You would then receive an expert opinion and be asked to comply with his or her instructions. Being asked to expose the soakaway system would probably be one of those instructions but low down the list. The local council might issue an order for the householder to leave, but ONLY until the necessary work has been carried out.
    The BCOs are generally RICS-trained, that is by the Royal Institute of Chartered Surveyors, and they are shit-hot at their job.
    On any construction job they have to be present to inspect various stages such as "bottom of trench", "foundations to damp course", "installation of same", "layout of drainage and testing of same" and, relevant to this work "inspection of soakaway: location, depth, distance from buildings, correct fill and suitable covering."
    From underpinning to supermarket (mall} construction, they are everywhere. A sensible operative just does a right job and there are no problems. I'm sorry that you lack that system over there - it would make your job a heck of a lot easier.

      This Townships Construction Sleazeballs lied to my Customer to cover their asses. My customer always comes first. Even when something like this happens. I did not receive my final Payment which was $7,500. So I'm out the $7,500. It's only Money, I can make more. Do know This video is nothing when compared to what the Mayer, Township Comity, Township Lawyer received from my very "Politically Connected" Lawyer. Does Deep Sea Fishing with Donald Trump count as Politically Connected? I am so looking forward to getting another job and filing for a permit in this Township. I am going to be the Ultimate Stick it in their asses Prick. And no need to worrie. After all this they called us several times having transitioned into the ultimate suck up's.

    No question the engineer and the neighbor are connected. Most likely these neighbors are at odds with each other. Write a letter to the local newspaper.

    I bought a house with basement in north Texas but I couldn't to find a company to seal the leak and level it up, because we have no many houses with basement. Can you help me with advice please.

      Hayder, I've started doing Face-time etc. estimates across U.S, and Canada and the end result is a Customer knows what is needed and INTERVIEWS a Contractor and TELLS the Contractor what to do AND how much they are willing to pay. I might tell a Homeowner the job should cost Ten Thousand but the Customer can offer to pay Six. In this a Homeowner can Hire ANYONE or even rent equipment and get a few laborers to do the job. Of course I do charge a fee which is $750. Thanks Again. Daniel J OConnor

    when dealing with government you sometimes have to jump through hoops.
    I'd say scope the drain and use locator to map the drainage system, or I'd just draw a quick map showing water draining within hone owners yard. even better reroute downspouts at least 6feet from foundation and call it done.
    do anything to get the job done and go on to the next one.
    I've seen so many downspouts that drain into weepers and over whelm the drainage system esp in older homes where weepers should be replaced. or worse drain into City drain.. in that case the water should be diverted away from foundation and cap the underground drain.

    Approach the city council in open forum, or go to the federal prosecutor's office. The is a federal statute that covers public officials intentionally refusing to do their appointed jobs. City liability for the damages caused by their delay is something to look into to as well.

    I`m a contractor for over 40 years in new York and the worst places to deal with are local townships in NEW JERSEY ! PAL I DON`T KNOW HOW YOU EXPLAINED ALL THIS WITHOUT CUSS WORDS ! . I probably would have told this story from a bar ! lol.

    19 years in home improvement here and I got extremely frustrated watching this video. The ignorance and bureaucracy runs rapid throughout all industries. As time goes by it is getting worse these days. Being money hungry I'm surprised the township didn't issue the permit ASAP, so there must be a 'grudge' or 'power trip' somewhere.

    HeHe, well when we had a problem with the local head building inspector here in Queensland Australia, first we had our solicitor write him a pretty terse letter, followed by adjudication from his superiors who "Retrained him well", he left!!! lol, don't have a job there anymore

    I love the way you didn't mention any names, I do think it was clever that you let us see it in your letter!
    Not in construction or anything, but I'm wondering if some insurance company would have been pissed had the job failed.due to professional oversight on his part.
    This guy should have been reported to the state as a risk to life and property. Failing that, catch him coming out of the office on his way home and see if you can't beat some sense into him. Make sure you gave him enough of an ass whooping that he could give the extra to his secretary.

    From a contractor. The city does make it very hard at times to follow all city guide lines for sure. If it was there home that was being worked on . Let me tell you the job would have a permits and work done and completed in a few days for sure .

    My town allows you to have 3 garage doors on your property. I had a 24 X 36 free standing garage built in the back yard. One 15-ft wide door would of been okay--giving me 3 counting the 2 existing doors on the house. Because I wanted 2 9-ft doors in the new garage. I had to pay for a public hearing and notify all the abutting neighbors within 500 feet of my house. I got the approval finally, however it cost me $200 and a lot of hassle.

      So am I James. My first union Journeymen s book was in 1981. I designed and built some great projects. One of my Kitchens was in Better Homes and Gardens Magazine in 1991. I did a 9200 sq foot complete gut and rebuild. That was in Better Homes and Gardens also back in 1985. Then the "overwhelming sense of entitlement" generation showed up in early 2000's. No real tradesmen or anyone with skills. I'd be working alone. So I went into this Industry because it is easy.

    Is a crack in the foundation wall ever NOT a big deal? Are any large cracks instantly a sign that the whole wall needs to be replaced or are there times when installing interior drainage, re-grading lawn, and perhaps re-inforcing the wall would be enough?

    I wish you lived in my neighborhood and could come and look at my problem my house was built on too low of a grade and there's water under my house everytime it rains also everytime it rains my sidewalks covered with water and I don't know what to do to fix this problem we've been in this house since 1968 and we pumped water out from under the house everytime it rains if you could provide any instruction I would really appreciate it because the middle of my roof is sagging and I can't fix the leaking roof until I fix the sagging Foundation or floor joice's I would appreciate any feedback that you could give me I wish you were in the Michigan area and I could have you look at this problem thank you so much for your help and I love your program signed Ken rosbury

    The house is owned by a couple who are the parents of the paperboy that was cheated out of 2 dollars. The paperboy got mad at the engineer wanting his 2 dollars and kept asking for the two bucks. The engineer then decided that if he could make the paperboy an orphan, he could get out of paying the 2 dollars ?? That's my theory !

Too bad all contractors aren’t as honest and have such an awesome work ethic as you! If you were in NC I would hire you to fix my foundation… I’m worried about getting screwed.       Most people don't want to get permits. Ask any Home owner who has gone threw the ordeal. Whomever is behind the counter when u go for paperwork seems to have taken a course on how to be rude, obnoxious, ignorant and condescending. 98% of all I've encountered are exactly that. Unfortunately I do express myself without buffers and also recite conflicting codes when asked to do some dumb ass nonsense. Sump Pumps for instance. No plumbing license is required but they all tell me I have to have one. Ridiculousness. Then of course it's bust Contractor's balls time if he doesn't grovel. I'd rather not do the job and have told customers to hire another Contractor. (that's why my assistant won't let me do them anymore) All Bullshit n too much aggravation to bother. - Daniel J OConnor

    You're lucky in New Jersey. In Honolulu, if you're lucky your building permit will take only 6 months to 8 months to be processed.
    I know. Iv'e been drawings plans and obtaining permits for 40 years.

      I say go on a rant. Loose it and treat them like an employee. Shout at them and if they give you any shit, walk across the parking lot and ask the police who is the Township Lawyer and how you can make an appointment with them. That's it. all you have to do. Someone from the township will call the construction department and ask what's going on before you even leave the building. They'll tell you to go back. Go back, look them in the eye and bust their balls some more. Show no mercy! Yep, you will laugh your ass off later after they pucker up and kiss your but from then on.

    Usually when I try to hire someone like you (a root cause analysis kind of guy who knows what's what) there is at least an 8 week wait time. Young people need to understand that hiding problems to avoid consequences is short-term thinking. They are leaving money on the table in their careers if they act like that.

      Yes! You have to stand up for yourself and not let assholes walk over you. It's not about picking fights or being disrespectful, but about being assertive. I have had a few experiences where I called someone out on their bullshit and it's surprising to find others who say they wouldn't of said anything, to not 'rock the boat' or 'be neighborly'! The idea that a situation like yours was a matter of perspective of you feeling one way and the permit dept feeling something else is just laughable.       Cmon' If you have done this for 40 years, you should know you don't piss off the inspectors. MOST inspectors (actually some are retired guys who do it for fun and really know their stuff) are clueless and have no idea what they are doing. They can be real idiots not on just about the code but about everything.
      But you know they are used to having their asses kissed so you've gotta do the same.
      Actually, you can get them in trouble in other ways but it's not via legal routes. That's only going to piss them off for life and every one of your projects are going to fail when they come to do their inspections.

      Take property tax and pay by tax payers but ruining public's life's. In California my neighbor was told to install an owner' drainage under the ground but water gets onto my foundation then I was told by the Public Works Engineer to re-build the house refuse to have my neighbor's house land elevation evaluated with a building permit because there was an encroachment due to corruption in the county. My several structure would not take the job because no way to stop the rain water coming onto my foundation. Please advise.
