One of the most common questions I get asked is how I use movie clips in my videos. The short answer is Fair Use. It's a legal doctrine that allows us to use copyrighted material without the consent of the copyright holder under certain circumstances.
There are no hard and fast rules - it's a pretty grey area. However, there are some guidelines that will increase the odds of you not going to prison is you use just a tiny bit of End Game in your next CZcams video.

The real danger to this video is you left out easily the most important thing to keep in mind: in many situations, if you sell anything related to your channel, you’re a commercial entity by many standards. Fair use does not apply. Bc everyone has a contingent right the second you start profiting from the fairly used clip. People missing this can ruin their lives

ACTUALLY.... Here on CZcams at least, fair use CAN apply even if you are profiting - under some conditions. I'm no lawyer so this isn't legal advice - but all of my videos on this channel are monetized and I'm selling products in the description of every video. I very much understand getting demonetized - I had an entire voiceover channel that was demonetized - but there were flagrant violations. If you're using movie clips in a TV commercial - even if really short - ya, fat chance those would ever skate by. I'm sure you'd be hearing from lawyers that day. But on CZcams, I think they cut us a little slack. I think it's more a matter of what prodution studios will allow. They want the good will of the 2 billion active users on CZcams and go easy on us. BUT, in once sense you are right - there is NO guarantee once you start using copyrighted material unless you have written consent from the copyright holder. It is ALWAYS a risk. One I'm willing to take. So I tread lightly.
@DankMcStank Use clips that are under 5 seconds, upload unlisted, and see if they get copyright claimed. If not, you're probably ok, but no guarantees.

Hey Trevor - thanks for another great video. Do you have any tips for using music in the same manner? I've added popular songs to my fun, non-commercial videos and CZcams bans them (Facebook does too) since the songs have a copyright. Any suggestions for getting around this?

Thanks Trevor. Does uploading your complication video with the "Creative Commons" license recommended? In other words, would a video with the Standard CZcams license have a higher chance of getting copyright claim or takedown request from copyright owners?
If you don't own the rights to the footage, using Creative Commons would not be the right thing to do. Using Creative Commons tells the world they have the right to use the video - but you can't give away the rights to something you don't own. It's only for footage YOU have the rights to. Make sense?

The Entertainer just follow these guidelines! Giving credit is a pain, so i don’t bother but it hasn’t been an issue.
Hey Trevor, I know you posted this 1 year ago, but do you know channels like Watch Mojo, CBR, etc. When they play the clips they mute the audio most of the time and credit the creator. Sometimes its a video with slight negativity.... will I get copyright claimed if I do that? If i just put a little bit of negativity, will I get copyright claimed? Thanks.
Eisa TV I’m not certain but my guess is they either have consent or aren’t monetized. If you shown 30 seconds of a movie you will almost certainly get a copyright claim. Even if you change the audio.

I want to open my own youtube channel of suggesting movies. So can i use the movie clips of their particular movies? Because if i suggest their movies then in a way, their movies are getting promoted also. Suppose if i suggest The Wolf Of Wall Street and " everyone can find it on netflix " then they will also be promoted. Do i still need licensed copy?
Same rules apply. If you use clips over a few seconds you will probably not be able to monetize those videos.

I was wondering if the audio of the clip you’re using (and talking on the top of) is silent and is only visual, does this make it less likely that people will sue or claim copy right?? Just curious to know as I’d love to do some video essays with shots of particular movies/shows as I speak over it - and is it even less likely if you slightly edit it? Great question! Don't think that will help much. CZcams SEES and HEARS it ALL. However, if you tweak the visual a LOT - like I explain in a video I'll link you to - as in tilt and blur - and it's silent, ya, pretty sure you can get away with more. The biggest thing is to keep the clips short - under about 5 seconds seems to work. Here's that video: czcams.com/video/2weBieGHRok/video.html
I screen record some clips that I use for memes and Everytime I upload them, I always credit the videos so I can mention that I’m not pirating, or plagiarizing. And to claim that the content is not mine at all. What I do is pretty correct? Right?
The best practice is for sure to credit the copyright holder but between you and me... I never do it.. Takes too long. And I think the bigger factor by far is the length of the clip. Shorter is better. Like under 5 seconds in my experiecne. Unfortunately, there are no hard and fast rules. But yes, you should give credit to the studio for sure.
There’s yt channel called movie clips and they post nothing but movie clips. How do they get away with it?

Hello Trevor! Very informative video but I have a question, my friend is doing a rant video about Yu-Gi-Oh!Expressing what he doesn't like and such, would this count under "criticism" fair use? Thank you in advance
He can SAY whatever he wants under the First Amendment, but whether or not what he shows from the movie is OK is what fair use covers. A few seconds, probaby OK. A long scene... probably not unless, of course, he has written consent from the copyright holder.
For fan video edits (like, taking music and Star Wars The Clone Wars scenes and editing the video) if I give credit will I be protected?
Giving credit is a "best practice" but frankly, I don't bother and I don't think it helps. Pretty much the ONLY thing that seems to matter after doing this for a few years: Keeping the clips short - like 5 seconds or less. Long video clips of big movies I think will almost always create issues.
How do you channels like Watch Mojo get away with this? They post entire movie clips!
I'm not 100% certain but my GUESS is either A. Not monetized or B. Written consent. I'd love to know for sure!

What about if I add part of a clip but no sound? For like a review of a movie..

I make virtual recreations of movie sets, and use a couple of photos and mini clips from the real movie set I’m recreating and compare them both, will I get in trouble if I use a couple of seconds of a scene to compare my creation to the real one?
I doubt it, but can't know for sure till you try! I wish they'd give us actual "rules", but they don't exist. Just uplaod unlisted to test.

So if I wanted to start doing movie reviews, how much of a clip can I use ? If I wanted to show parts of all the good scenes from the movie itself?
What about 5 minute scenes that are cut and have music played over them to amplify the original message? In other words, can I take 5 minutes from a movie and play a 5 minute song (That I'm allowed to put in my video) and create and amplify a very emotional moment that was already in the movie? for example Like those star wars edits with Anakin's transformation with some sad music.

@@paperplay9744 When I say monetize I mean Google Ad Sense - which is where CZcams pays you per 1000 views, known as RPM in your analytics. You MAY monetize/"get paid per view" with movie clips if they follow the fair use guidelines. Be remember, NO GUARANTESS, cause copyright holder can always call you out, even if YOU think it was fair use. Best advice: use clips under 5 seconds and wait for CZcams to run it's checks BEFORE you make it public. Good luck!

Hey Trevor! I wanted to do a supercut of the film Evil Dead 2 in which I take each scene the main character is injured and use it in a sort of montage. This would use a pretty substantial amount of scenes, and I was wondering if this would fall under fair use. I wouldn't be monetizing it or anything.
Depends on the studio. Some will make you take it down, others may let it fly...

For news - my guess is PROBABLY. But there is never a guarantee unless the media is yours or you have express written consent. News is easier to get away with using than movies.

Heck, not sure. CZcams can SEE and HEAR your videos and compare it to pretty much every major tv show and movie on earth... so they for sure will know. But... you can just TRY it. post it unlisted on your channel, and they will very quicly tell you if you "passed".

Well.... kind of. You can probably use clips up to 5 seconds, but will almost never get away with using long scenes. I'm not sure how the channels using long scenes get away with it. The may have consent from the studios. You MIGHT be able to get away with a longer scene, but most likely will get a copyright claim and not be able to monetize.

Music is REALLY tough to get away with. You might be able to use a couple seconds at a time, but full lines will likely be rough. I don't bother with specifying the label - tho in theory it's a best practice. I don't think it makes a big difference. I think the biggest factor is the length of the clip or music. Short for video. Shorter for music.

Im really sorry Trevor because my question to you was confusing and not clear, so please allow me to quickly clarify :- Music is not a copyright issue in my question since we are a family of musicians, and all our music rightly belongs to us and fully copyright. So I just wanted to know if using old film dance clips in the context of " fair use" can be to used "together" with our copyright music without confusing the two. As the music is copy right and the video clips would be "fair use" Can you tell me please if both can be used together in the same video ?
Hey Grace - It's exactly the same as I say in the video. Using a small clip MAY be considered fair use, and following the suggestions I make you can increase your chances of it being considered fair use, but there is no way to be certain unless you post. Only a judge can decide if your use is fair use. Even if CZcams's Content ID flags it, if you're only using 1 second clips I wouldn't think anything serious would happen. But there is always a risk - you always take a chance and there are no guarantees. Personally, I'd take the risk - which in my opinion is minimal - but I like to live on the edge. 😎

If you want to make posters out of screen shots of movies and sell them on Amazon... that's pretty clearly a copyright violation so I would not recommend doing that.

What if I use a 5 minute clip with no sound as a video for my music? Basically using just the video for instrumental/beat to keep watchers entertained as they listening
Back with a few more unsolved answers lol. One of your steps to cover ourselves was to get permission to use the clips. How would one get that ball rolling? And once we get permission or give credit in description does that mean we can monetize the video or using clips automatically disqualifies the video for monetization. Really appreciate yr feedback in advance 😊
It's super grey. I'm not a lawyer, so I can't give legal advice. Best rule of thumb: if it's not yours or you don't have permisssion, don't use it. But... If they are short clips and you're following the other stops you'll PROBABLY be fine - even to monetize - but there are no guarantees! It's always a risk! Permission? Just have to research it! For movie/tv clips, I've never done it! Way too time consuming. It's just the super safe way to to do it! Good luck!

I used a clip from a music video during a commentary/opinion video about what it was promoting to kids. It came up with a copyright claim even though it was fair use according to the guidelines. What can I do about that?
The guidelines are insanely grey. No hard and fast rules other than this: The only CERTAIN way not to get a copyright claim is to get written consent. Anything over 5 seconds will very often result in a copyright claim, has been my experience. On the flip side, a claim is no big deal. Usually means you can't monetize it or that the ad sense goes all or paritally to copyright holder.

@@MommyAnswerLady How much of the music video did you use? Also, CZcams lets the copyright holder pretty much call the shots. "Clearly fair use" - applies to virutally nothing I'm afraid! My understanding is the only way to determine 100% if something is fair use is... in court. And hopefully none of us here will ever end up there! Sorry I don't have a better answer! Okay But even for a shorter clip, CZcams is showing messages like "Your video won't be shown to anyone or can not be monetize". How to bypass this, Please suggest. These message are appearing in the Check option while the video is being processed for publishing.
How long are the clips? I keep it under 5 seconds usually.

If it's a long clip, I'm not aware of being able to get away with more if its a review. But I'm not lawyer and have tried everything!

I think I have a good grasp on the fair use issues but how to actually capture the content? What program are you using to edit this into your videos? I have been looking everywhere and with different search criteria but nothing but fair use comes up. Any help or suggestions would be appreciated!

That is what is suggested to play it extra safe - but to me, it's way to much work! I'm trying to follow the other steps as much as possible.

Movie clips: you'll have the best luck keeping them under 5 seconds. Music - possibly even shorter. I stay away from copyrighted music almost completely. YT seems more uptight about music than movie clips. I just use Epidemic Sound, like $15/month - link in description - but I know that doesn't help if you're wanting to review a popular song.

Hi I have seen many movie explainer channels use multiple small clips of two to three seconds from entire movie , so they make 10 to 15 minutes clip combining all those 3 seconds clips , and so voice over to explain the movie in local language , is it safe ? Or we can use small clips only few times in single video

Yes. Yes I do. No problem as long as the clips are really short, is what I've found so far.
Wow. I've been terrified of using any clips. Got a copyright claim on one of my speeches, because I used a song - just found out after years of it being online. They made $5 off me... THAT WAS MY $5 :'( You just TOTALLY changed my game - thank you SO much!

Trevor I want to start a channel for example where I use only clips of a movie and put non copyrighted songs over it. Will I get striked if my vid is like that where I make a montage of a movie or so. I see lots of channels like that but they dont monetize their content for some reason. Thank you
If your entire video is copyrighted material, it's unlikley you'll be able to monetize. I don't know if you'll get strikes but you'll very likley get copyright claims if you use large chunks of movies and shows Armand.
I made my first video, I would upload a non monetised video on yt.. but I used a full song and a lot of clips from a series. Do you think I can somehow get a license from them?
