  • LIVE: MA v. Karen Read - Motion to Dismiss - Defendant Karen Read returns to court hoping to get her case dismissed after the Killer or Cover-Up Murder Trial ended in a mistrial.
    Read is accused of killing her boyfriend, Boston Police Officer John O’Keefe, by hitting him with her car and leaving him to die in the snow. The judge declared a mistrial after a hung jury but some jurors are coming forward saying they acquitted Read of murder.

      Everyone who was watching that last day remembers it. Her jury instructions were confusing and convoluted.
      She seems EXTREMELY stubborn and imho she will not admit she and the Commonwealth made huge mistakes. They'd much prefer to put Karen Read on trial, again, on charges that she's 1. Been proven factually innocent by science and 2. Was acquitted on by a jury of her peers.
      Who are they working SO hard to protect? To the point that they themselves are being made to look at the very least incompetent, at the most? Possibly corrupt.
      She's going to rule in whatever way makes her and the Prosecution look the best, she will not rule impartially. Watch.
      This is going to be an appellate case. And all 12 must come forward.

    What is the point to televise this when we can't hear the arguments? There's 50 different mics in courtroom, and they can't move ONE to where they're talking?
    I understand it's for those in the court to hear but that brings me back to my question.. why bother showing it on TV when we can't hear them? Making me angry.

The other attorney came up with a story as an alternative as to what could have happened with the cover up and all that BS. You don't need an alternative story when you tell the truth. This is a circus. Look how Karen treats her own mother if you want to know her character. Says it all!

I was fascinated in how she publically was horrible to her own Mother like that!! Then in front of cameras, shes laughing, smirking, etc. Whether shes guilty or innocent, her boyfriend was killed and she has acted like this was some joke the entire time!!!? Give the court your highest respect!! Doesnt she realize with all those disrespectful looks, smirks, laughing, the jury is looking - but she does not respect any of it. If that was me, and i knew i was innocent, i would especially be acting the most respectful!!

    In my humble opinion,
    I believe that Judge Cannoli cares far more for her close family friends than she does for the rule of law or justice for the innocent.
    In my opinion, I wholeheartedly believe that Auntie Bev would shoot herself in the foot in order to protect her friends.
    That's what I think.

    I watched the entire trial and I’m my opinion the judges instructions were the problem. Read’s attorney tried to get the instruction changed. He wanted a guilty and not guilty with each charge and she only had a not guilty at the bottom of the three charges. In my opinion the jury didn’t know they could find her not guilty of each individual charge. The not guilty was at the bottom and could only be check if she was not guilty of all three charges. That is my understanding. Wish we could see the instructing the jury received.

    The Judge and Prosecution are cravenly hiding behind two jury concerns, namely that the deliberations of the jurors cannot be questioned and the preservation of the anonymity of the jurors. Although these concerns are ostensibly in play, they can be effectively and easily addressed if the Court is committed to truth and justice, as is their charge.
    First, the jury deliberations do not have to be questioned or exposed - that is nothing but a red herring. The Court needs to know nothing about their deliberations, only that they came to a final verdict on the first and third charges. If anything, it would appear to me that the Court has the absolute duty to determine if verdicts were reached on any of the charges, and if so, publicly declare what the jury decided. The idea that they can just ignore any such verdicts because they did not follow the form of the verdict slip is an indictment on the Judge and her Court, not on the fact of the verdicts themselves. Any Judge committed to truth and justice would NEVER render a true verdict invalid because of such a misunderstanding. In my view, such a position would warrant the Judge's removal. If they demonstrate such contempt for the law and so blatantly violate their oath of office, they have no place on the bench.
    Second, the anonymity of the jurors can be preserved by following the same guidelines that were in effect when the trial was being conducted. There is no need to make any change at this stage, just individually question them as to their final verdicts on the three charges, specifically which charges were unanimously decided. And for any charge that wasn't unanimously decided, they need not disclose anything about their individual position.
    Attorney Weinberg clearly laid out the steps necessary to properly receive the verdicts. The Judge can easily make this right, the real question is does she have the requisite integrity to do so?

    Lally is a terrible attorney. Not only does he lie, his interpretation of the law and rules shows his incompetence. He comes off super arrogant and I think that's to hide how bad he is at lawyering.

      Yes. Thank you. He actually is TERRIBLE. I think his bosses can’t stand him and they knew this was going to be a shitshow so he might as well be sacrificed. His witness preparation was terrible, he can’t speak orally and he doesn’t seem to know the law. Everyone is so focused on a guilty verdict that they ignore the facts and the words of the witnesses. Garbage case.

    My problem is and has been, if you look up the recorded real data of death due to being struck by a vehicle, its only a 10% chance of death if struck by a vehicle going 23 mph. That being said, i dont believe someone as educated as KR (which she is very educated whether ppl like her or not, there's no dispuiting that fact) would back into her boyfriend and assume it would fatally injure him. So in that sense she would have no reason to conclude he wouldnt recover and be able to then say what happened which would give her no chance of hiding what happened. And thats also assuming she was so reckless that she completely disregarded whether or not someone was watching out the window or not to see exactly what happened and render immediate aid. It just doesnt make sense that she would assume/hope that hes deceased and no one saw her even though there was a house full of ppl in a nice neighborhood full of cameras.

    This is a 100% pure nonsense motion from the defense. I’m alarmed the judge thought it even warranted a hearing when she could have easily dismissed it out of hand.
    Jurors from the previous trial ceased being jurors the moment the trial ended. Any jury room deliberations not resulting in a decision are therefore moot and sureAF can’t be considered as evidence in an unrelated (new) trial.
    If they want to appeal the mistrial they pushed so hard to get, have Grandpa Simpson get to work on that. 😂

    I usually don’t like comments that talk about how bad a “judge” is and this and that….but my goooooodnessssss she is the worst judge and needs to retire! She didn’t do her job, she knew there were other counts but instead rushed the jury out the door! Why didn’t she read not guilty to the other 2 counts!? To me this should of never came to trial, it was a botched investigation and there is no evidence without a doubt that proves she hit him. Every witness for state came off aggressive , cocky and shady, not grieving friends that just want justice.     Prosecution keeps saying the court can’t delve into the jury’s “processes or deliberations”…. Duh. No one wants to confirm anything except for their verdicts! A verdict isn’t a deliberation. A verdict isn’t a process. It’s simple to verify which counts they voted unanimously on, and which they didn’t. Notarized affidavits. Simple. Geeeez. It’s almost as if the court doesn’t seek the truth or honor what actually happened. That would be corruption. The jury was confused by the judge’s instructions. They are trying to see justice done. I think Bev should be charged with judicial misconduct for not clarifying which charges they couldn’t come to an agreement about - it’s common sense to simply poll the jury to ascertain each charge separately - to simply ask if they were at an impasse for each charge or just one or two? Stupidity!

      It still leaves count 2- which in my opinion is much easier for the prosecution to prove than count 1.
      For that reason I don't understand why they didn't just agree to drop 1&3 and retry on 2. I believe the penalty is 10-20 yrs for count 2.
      There was never any proof she deliberately hit him ( indeed the FBI experts said she DIDN'T hit him. They were proper experts not like Trooper Paul!)

      Well, the jury stated that they were not in agreement…they didn’t give specific information. I understand what you’re saying, but you never hear it announced in a court that they are hung on a charge. It’s either guilty or not guilty. Once it’s determined that they are unable to reach a unanimous agreement ( hung ), it becomes a mistrial. In that case no verdicts( on any of the charges ) are announced in court ! Judge Cannone clearly stated that they have to reach a unanimous verdict on all counts.
