      Yep. That's policing in America in a nutshell my friend. They only solve 6 percent of crimes in the city, but over 90 percent of arrests by NYPD are a result of random interactions like this one. Usually, it's trespassing or obstruction and disorderly conduct.... totally bullshit subjective charges .

      His lawyer probably refused to keep going after the settlement offer. Lawyers who work on contingency (which are the only kind normal people can afford, let alone homeless people) can drop a client if they deem the case not worth pursuing. The lawyer probably got an easy $40K with a few hours' work (standard 30% contingency) and didn't want to risk getting less for putting in dozens or hundreds of hours required for a jury trial and possible appeals. And if one lawyer drops you, it's hard to get another one to take your case on contingency.

    How are these officers NOT in Jail for Assault, Violation of rights under the color, abuse of authority, falsifying police reports and gang-realted actitivies? The other officers are just as much to blame. Let alone still employed as a police officers. The passenger should have pushed for the 40 million and not settled. That would have made headlines and put more pressure on the officers in the video.

      I used to think most cops were good and honest until I started watching these videos by We The People University. Now I wonder if my beliefs were true.     I moved out of NY in 1980’s I was born there and believe me nothing has changed. Police have been doing this and more since the 40’s. I have seen stuff and more in my life time as a kid then grown up. Now their behavior has spread to other states.

    People ALWAYS put their bags on empty seats….EVEN during rush hour! No one cares. And it can’t be a law…they’ve got to be kidding! How is the poor guy supposed to RELAX with all hands on him and someone pressing down on his head? It’s disgusting!

    How desperate are these costumed clowns to remain relevant that they have to assault a man just trying to get to his destination? He wasn't bothering anyone from what I could see. The problem with assaulting someone that is down on their luck is that they have very little to lose. Every now and then they will become your karma and justifiably so.

    It's also disturbing that no bystanders came to the defense of this man who was obviously being assaulted, terrorized and bullied. When something as egregious as this occurs, the public needs to step in and help in real time.

    What is somewhat disturbing is that the people in the background didn't say/do anything. They probably, quite rightly, thought they would then be arrested/assaulted for interference, resisting arrest, and disturbing the peace. Instead, they waited to post the video on YT where they were separated and safe from the Police. That is symptomatic of a Police state where the Police see the people as the enemy.

      The fact that you (and I) watched this video make you (and I) a small minority on YT that might take action. The reality is that this video would get a lot more hits if it featured a fluffy kitten. Anyone who had taken action risked arrest and all of the possible consequences. Lawyers fees, a charge/conviction on record, lost time off work, loss of job, injury etc. This combined with a starting assumption by many that the Police only act within the law helps suppress direct action to bad cops doing bad things. I sympathize with those that do nothing more that record and post video to YT. For many, that is likely to be the practical limit of their actions. The USA, and no other 1st world country, feature so many YT videos about bad cops doing bad things to the people they are supposed to serve and protect. @@chrisw5742

      I have thought about what I would have done if I was on that train that day. The answer is that I would have done no more than video the incident. There were two armed cops. One violently assaulting an innocent man just sitting quietly on the train. Both cops clearly believed the law was on their side. If it hadn't been for the video from the guy sitting opposite, and the body cam, they probably would have got away with it. They have probably done it before. If USA cops can treat innocent harmless citizens that badly, what chance do you think me, a foreign tourist, would have? Had I, or anyone else, interfered, I could reasonably expect to be arrested, charged, fined and jailed. I would have needed to pay $thousands for a lawyer. A court appearance would have ruined any travel plans and cost more $$$$. Rationally my best course of action would have been to sit quietly and record the incident. That is the tragedy of policing in the USA.

      I have been to a lot of countries including the USA. There are plenty of 3rd world countries with more Police corruption than the USA. The Police are typically ineffective or/and they will skim some cash. Amongst 1st world countries, the USA Police corruption has two unique features. An interaction with USA Police can be a truly life wrecking experience. An innocent harmless person can end up dead, injured, jailed, unemployable and destitute (civil forfeiture) as a direct result of the legal system being systematically weaponized against ordinary people. The other feature is that exposing and fighting Police corruption in the USA seems to be left to YT channels and legal volunteers. Other 1st world countries usually have effective and truly independent Govt. bodies that weed out corruption. When I visit the USA as a visitor, I genuinely fear any interaction with Police. If it is bad for citizens, just think how bad things could get for a visitor. @@DarkWolfsDen

    I can't believe the Prosecutor actually increased the charges before the Court dismissed charges. The guy should have sued for more since numerous cops participated and they jacked up the charges. You know his Attorney likey took 1/3 of the settlement.

    When I used to use busses or the London Underground, I'd often put my bag on an empty seat next to me and move it if a passenger needed to sit down. This is just abusing and bullying homeless people.

    As an NYC resident, I find this absolutely appalling. I know the MTA rules, and this video shows that it's enforcement was arbitrary and cupreous. The rule was instituted to empower the police to take action against a subway passenger taking up multiple seats in a situation where others had to stand as a result of it. From what I saw, seats were available and nobody was standing as a result of him.
