This is about the state refusing to prosecute but wanting to keep a US Citizen behind bars without bond forever. That is a major violation of the US constitution, anyone who took civics in school should know that. The blood here is on the DA and police's hands for not putting this guy away...not on the judge who DID deny bond for two years but then realized any further delay would be a civil rights violation and he would have a claim to have charges thrown out totally and a hefty payout at the taxpayer's expense.

Thus is the reason why people call lawyers and sometimes public officials bloodthirsty: she’s riding on the law, not on a moral obligation to anyone. The law says if you mess up a case like his, he has to be given bond. But MORALLY, it’s obvious he’s a violent criminal and should be kept in jail. When you have a legal system full of crooks and people with no moral compass, they don’t do their jobs to protect the public, they do their jobs to look good or to get paid. There’s not a ton of dialogue when you get into the world of law or politics that tells you you’re going into a life of SERVICE, and that’s sad.

The person in question was held for an extremely violent offence, evidence strongly pointed to him as the perpetrator, to release him for a legal violation in of itself is a criminal act. Deliberately releasing a potentially violent person onto the pubic breaks the public trust.
We can’t count on anyone else to keep the criminals in check. We regular folks have to do it ourselves, by any means necessary.
Incorrect. Bail is still a right regardless of the evidence for the simple reason that the charges have not been proven at the bail hearing. Think of the converse where bail would not be available. This would now be a police state as they can keep you locked up for whatever charge they think up. There is a principle in law that it is better to set 10 guilty people free than to lock up 1 innocent person.

No. The judge is NOT there to determine guilt at pretrial hearings. That's for the prosecutor to prove in court at trial while the rights of the accused are maintained.

The judges are not charged with determining guilt or innocence. They are essentially the referees and finders of fact in criminal trials, where a jury determines guilt or innocence. I can appreciate this woman's arguments where there may have been a statutory justification based on the prosecution's failure to try the case and/or comply with discovery. I'm usually very much pro-Kennedy, but this is a bit of a stretch.
