  • Have you ever taken anything from Spermüll (aka. big garbage) before?! 🙈✋

Fun fact: If we put our Sperrmüll at the street in the evening, there's hardly anything left when the garbage collector comes at the next morning. We have secretly watched the scene sometimes from our kitchen window. The "thieves" come with a van from Poland, sometimes even when we are still carrying things to the pile. I have no clue how they know about it so fast. It seems to be a network of people who watch the streets for Sperrmüll. 🤷🏻‍♂

The problem is that the van guys often left a mess at the site or are dumping stuff in the forest after sorting it.

@@gargoyle7863 Yes that's what I'm afraid of. I don't mind if they take stuff but leaving a mess, especially in the middle of the street, is not acceptable. Shortly after I wrote my comment, I wondered who has to take the responsibility in case a car gets a flat tire (just an example). According to the law which Jenna cited, it's the garbage company because they have the ownership but otoh I guess it's still my duty to prevent any damage to third party property. 🤷🏻‍♂

As a German I think if anybody has a use for things from the Sperrmüll. Be my guest. Stupid german laws 🤦‍♂️

    • @gargoyle7863

It's not stupid, it's reasonable: Organized collectors rummage it and spread the garbage, sometimes they take some items but half way back decide otherwise and dump things into the dich. Bad behaviour killed the idea "it's free to take." (It's still free to take, if you behave properly nobody cares.)

And I thought America was onerous with its many laws! LOL! If I ever manage to travel to Germany (beinning German learner here), I'll be very careful. Thanks for the heads-up. LOL!!!

The 10.000€ fine is because organized gangs rummaged Sperrmüll and often are leaving a mess.

What makes this free-for-all of Sperrmüll items a bad thing is the chaos that results when people rummage through the items and spread them all around. I think as a genuine rule taking from Sperrmüll should be legal. But the bad behavior has killed that idea. While you can fine people with "creating chaos and trashing" those fines are very limited to under 100 Euros. If higher they might get challenged by the Constitutional Court. So declaring those items as property of the garbage men (trash collecting firm or authority) makes it a theft which can be fined or even criminally indicted. And to call for people to report it is just another way to keep things under control and tidy. AFAIK the Sperrmüll-rules only allow you to put your surplus stuff out in the mornig of the day they get collected. Some municipalities even have done away with regular Sperrmüll-days so nobody can plan their harvest tours anymore.
So I am all for it. But I would not call the trash police if you take a small item from the heap. Live and let live. But excesses need to be avoided. If our society has changed rules and enforcement need to change too. Sad but true.

"Some municipalities even have done away with regular Sperrmüll-days so nobody can plan their harvest tours anymore."
My municipality has done so because there are lots of scattered tiny villages in the area. A regular tour through all of them for probably little waste wouldn't be worth it. There are recycling centers you can bring your stuff to, and if needs to, they'll pick it up if you ask for it, but that's expensive, starts at 240 euros.
"If higher they might get challenged by the Constitutional Court"
Oh no. It would be the Federal Administrative Court. Fines for littering don't touch the constitution or your civil rights.
"chaos that results when people rummagr through the items and spread them all around"
Honestly, I did that myself when I was a student and lived in a big city, but didn't "rummage", just picked out a few items I thought to be good enough for the flea market. Yes, technically that was theft, and I knew it, but as you wrote
"I would not call the tash police if you take a small item from the heap"
and I think not many people would. Except, and it's sad I have to say that, in some areas, I'm pretty sure they would call if you don't look German.

According to the garbage disposal statutes of my district, it was legal a few years ago when I looked it up.

ME ! 50 to 200 € for a candle? Unheared. I could imagine some of those higher fines would be for stealing, like copper cables and if caught pretending just to have found it in the garbage. Like finding rare metals or other worthy items... I just remember as kid I went with my parents to look for things at garbage dumps if we could find something interesting... but that was at least 50 years ago.

I was told a colleague even found containers with mercury in the Sperrmüll. He made some good money of it. Must have been a commercial enterprise finishing up business. Pretty illegal!
A friend of mine eventually found a job a garbage truck driver. He told me of finding bedding in the trash with featherbeds. He also got some money for that. But that would have been illegal too because he was hired to collect garbage and not to deal garbage.

Here in DK, many "Mühlpläze" have storage, where you can put thing, others can take for free.
BTW, you and your mother should take a trip to Copenhagen. Direct trains from Hamburg and cheap aeroplane tickets from Berlin. Maybe other airports too.
    Copenhagen is absolutely worth visiting.
Check out these two channels. The first is Erin, she is also from Canada. She knows so much about Copenhagen you won't believe it, and she is a good storyteller.
Second channel is a British woman, Melanie. Also been living in Copenhagen for many years. One of her specialities are second hand shops. There are many in the city and she shows where they are.

Sperrmüll collecttors that pick it up as a basic service have to make money out of it to lower the costs for all in the area.
If people steal the copperlines and bars out of that pile the company / city is loosing money and fees will have to be raised one way or the other cause these operation as a service of the city are not allowed to make losses.
Simple as that. If you take valueable things from the pile you will not get only fined you can end on court if you do not pay cause you have stolen whatever it value might have been and hurt the community.
Not reallly complicated and the worst of all are the seekers who run through such pile and cause a chaos. Therefore do not put that pile out too early cause you will have to clean the mess afterwards.

Depends on where the "Sperrmüll" is. Is it on City ground it belongs to city. Is it on private ground it belongs to the ground owner. And no matter, when you take it, you steal it. The private owner won´t say anything, because he wants to get rid of it, but the city would fine you. 😩🤗
