      And see how UUL inadvertently nods a couple of times in agreement even when arguments put forth by HS are contrary to his.     Rahul Mr. Lalit is just dodging. Beyond that his comments are pedestrian - लकीर का फ़क़ीर। Mr. Salve in contrast never disappoints. He not only has command on facts but he also has a command on legal, parliamentary, constitutional and social concepts and he brings both into discussion and his commentary with admirable frankness and clarity.

    When we talk about transparency from parliament to panchayat we can’t digest the collegium system for higher judiciary appointments. The time has come for the judiciary to be transparent and allow a new system which can involve parliament and eminent citizens to have a say in higher judicial appointments. The debate was interesting and Rahul conducted it well 👏🏻

    Excellent questions and opinions of two judicial luminaries. It is high time iron out wrinkles appeared in judiciary and executive. The urgent solution required is how to reduce the duration of decades old pending cases before various courts.

    All the functions of democracy are recruited as per the appointments by the or on behalf of President of India by certain procedures. But the judiciary made their own recruitment systems beyond the democracy procedures in India🇮🇳. But still we are a democracy. Strange.

    Too much ego in the ex judges for their judicial system which has given such shocking statements and verdicts at times. The delay in our judicial system is horrifying to see in news everyday. Uday ji saying we will do it when we feel like it. Salve jis few statements destroyed his arguments.

    This system should be immediately changed, if legal procedure demands, by an Act of Parliament. The citizens of the country also demand that vacation system of the Courts of Law should be immediately abolished and follow the usual system followed in respect of Govt. Offices, so that pending cases are disposed of quickest. There should also be a time line fixed for disposal of of cases. The dilatory procedure now followed makes the people disheartened. The Authority in the Welfare Govt. should also keep an eye on the performance of the courts so that justice seekers get the justice within a reasonable time. It is horrible cases linger on to ten, fifteen years time. There are many instances verdicts come after the death of persons, useless then it is.

    W were dragged for 5 years on the orop issue. Invariably the honourable judge would give the timing of 4 pm walk in admit he is tired and give fresh date. He has given innumerable reprives to govt lawyers when they said " we are still preparing our documents" . The IESM reps would go back disappointed. By all standards of our judiciary, five years is a hallmark of efficiency.

    If the collegium system is good then the Army chief will be selected by a collegium of Army officers. School / College Principals will be selected similarly. Commission of Police, Captain of cricket team and other sports, chiefs of ISRO and other science and technology organisations and a plethora of such posts should adopt a collegium system. In future instead of elections, a collegium of politicians may choose members of parliament, rajyasabha, state assembly etc.

    Harish salve ji,s views are more logical and more open minded and forward looking for Judical reforms and this present system of judges appointing judges with no transperency and the whole system is classic example of nepotisam going at highest level.Ex CJI justice U.U.lalit trying to some how justfying the collegium system and judicary overeach.🙏

    Ex-CJI seems to suggest that the judges who appoint other judges through collegium system are perfect beings and are infallible. This is hard to accept, especially we get to see the quality of the learned judges who keep making silly errors judgement. Therefore, to say that the collegium system is the best system.

How does a common man feels seeing netas enjoying resort facilities in jail and people like Aftab Manu Sharma and such case getting stretched to years together and finally getting bail, Rajeev Gandhis killers getting bail. They open court at night for terrorists but not victims like Nirbhaya.

    The way interview was çonducted by Rahul is commendable. What The ex judge said is immaterial as every Indian knows what goes on in Indian judiciary system. As someone commented in comment box, the verdict given by a HC judge is reversed by SC. That means, he is incompetent or who is right HC judge or SC judge and are they referring to different law's?. The judgement is always debatable even common man notices it. As a human being a judge is biased depending on his religion and inclination to a particular political party.

    The present day collegium system do not give any role to the government by way of either consultation or concurrence, whatever may be the vocabulary used. In consultation the government seek the considerate opinion of the judiciary and may or may not agree with it in the light of other inputs privie to them only. But the concurrence is a two way thing and both should agree on a name. The element of who will propose is also an issue with definite advantage to the government in constitutional scheme of things. Collegium system do not leave any thing to government and the most unconstitutional authority which wields supreme power without any checks and balance in a democracy . Justice Lalit found wanting in his arguments. No wonder even CJIs now become father - son / daughter- and possibly grandson lineage, and it is going to be more and more a rule than exception and one can point his finger on judiciary. Considering the vast pool of legal minds in a population counting 1.5 in billions it is a shame not on Supreme Court alone, but on nation too. The people of india no more want to suffer it just because the Judges are not confident about them to keep up the oath they have taken to the office. It is extremely dangerous when the Judges feel that every constitutional appointment should be tested on the abilty of the person considered to "take on" the Prime Minister as Justice Joseph commented. Then why one should single out the Prime minister alone, and exempt the judiciary?

    Aim and objectives of judicial bench was to visualize different dimensions of Judicious angles. It is only possible if judged by different specialist mindsets never same mindsets of numbers of judges. But we cleverly manipulated and appointed all juducial mindsets in all bench. For example all judicial system oriented individual would inevitably condemn and disagree with all types of killing . But for various Adminstrative solutions it's happening everywhere around the world. So judicial angle are different from social, national or Spritual angles. So unless we incorporate specialists from different sectors we cannot be judicially correct

    The basic reason for the delay in delivering the judgments is the adjournment system and the listing process of cases which are not at all addressed in these discussions. As for as the government is concerned it should drastically improve the legal infrastructure before thinking of increasing the number of judges

    Why no discussion on UP being topper among all States in pending cases and still
    has just one Bench and that too so close to Allahabad at Nawab City called Lucknow and nowhere else? A State like Maharashtra which tops in Justice Index Ranking list has maximum High Court Bench and Supreme Court never deliberates on this! Regards, Sanjeev Sirohi, Advocate

      The issue is mainly that judiciary needs to be independent of executive body. That’s a separate and equal branch of a democratic state. Without its independence there would be lesser check on governmental overreach.
      Today perhaps a government you like is in power, tomorrow that may not be the case. Do you want a judiciary beholden to that government?
      So while we want some way for parliament - the deliberative body - to have checks on judicial overreach, the opposite should also be the case.
      A democracy works best when power is decentralized and responsibility exercised by all three branches - and has an independent media and an informed and engaged electorate ultimately.

    Judges appointing judges.
    Members of Parliament deciding their own salaries, hefty retirement benefits after a tenure is over and so on is same.
    Nobody by human tendency likes to loose power of control and monopoly.
    So, it's duty of parliament to decide the democracy survives in Judiciary and when self regulations are concerned.
    At the same time the we should take care that the legislature should not become a Bhindi Bazar.
    But democracy and it's check is always needed to balance the misuse of power and in turn trust put in the system.

    We can have a constituency of lawyers with atleast " x " years of experience, who have a vote. The weightage of this vote should be 50-60% , balance weight should be with the collegium of judges.
    No politician should be a part of the process .
    The process should be recorded and published on the website.

    Mr Uday Lalit is now free to air his views more candidly now that he is not wearing the crown.
    This topic hardly affects the common man who goes through harrowing times while appealing courts to give him justice.
    The cost, and time involved in getting justice drains his energy and his expectation to get a fair verdict.
    Not to speak of the corrupt practices he experiences in the judiciary, particularly in the lower courts, be it is civil or criminal.
    No wonder the common man has come to regard Courts as 'School of Scoundrels '
    The present CJI would do well to address this rot which has now become a chronic disease affecting the courts.

    Collegium is perfect. We should make CBI, ED and Election commission more independent too. And yes I can't see where is LOKPAL..😉

    Why cant our Courts run like a Target Oriented Business Enterprise with Agreed Turnaround Times based on a proper categorisation of cases. ON what basis some cases are heard in the night during vaccation time and others after years? Why not computerise the Case Assignment and Allocation in an equitable and random basis to be transparent. Why not make the whole system computerised, paper free and remove the archaic colonical wordings! So that just like in other areas for approaching the courts for claiming justice, the lay person can fill up and register a case online and heard online? There are so many areas which need attention & improvement in a system which is steeped in age old practices & customs! And in this 21st Century!!

    Indian court system:- murgi chori karne wala garib ko 2 year jail term.
    Dusre ka property hadapne wala rich ko bail.

    Collegium is near perfect system: By Judges, For Judges.
    Also courts never take responsibility example Manipur.

    How much is the collegium equipped to know about the antecedents of the judge's character, his illegal relationship, foreign accounts, and his relationship with international agencies?
