    i really like the point you made on nepotism being a major problem without affirmative action. i’m not sure what the solution to that specific problem is at the governmental level, but attacking nepotism could also help in the grand scheme of things to level the playing field better than affirmative action ever could, so finding a solution should definitely be up there on our list of priorities as a country.

      When governments make an equality law, the people in control already wrote a backdoor to exploit it for their own gain.

      Well, nepotism that results in [illegal] discrimination is illegal, however the biggest issues are a lack of awareness why an applicant didn't get the job and a lack of time and resources to fight the discrimination legally.
      Honestly, the solution is to just fix the problems with impoverished communities so they have more access to better jobs and higher standards of living. Another part of a solution is more worker-owned companies and stronger unions.
      Basically, the best way isn't to try to beat them, but to make such bad corporations unnecessary so all you have left are good ones with proper checks and balances.

    California voted to end affirmative action some time ago. We just re-voted and continued to vote against it. Since repealing it, the number of employed African-Americans in LA-OC has decreased shockingly. Honestly, it breaks my heart things are going this direction. Well done, Ben!

      It's a pretty insidious incentive structure overall. The biggest problem is that there's a lower pool of qualified applicants if you try to hire exactly equally or one in higher numbers. And fields also don't have equivalent numbers of people who enter. I imagine what's happened is that they've become more dispersed instead of in simply one institution.

      On the other hand, every attempt to un-ban affirmative action in California was met with protests from Asian communities. And that's what the Harvard lawsuit was about: competitive universities discriminating against Asian-American students (minority people-of-color) by requiring Asian-Americans to have significantly higher grades and test scores than everybody else.
      It's weird that it's somehow a Black-and-White conversation, while ignoring the racial group that is the most negatively impacted by affirmative action policies.

      ​@@Cosmo1093Funny thing. Legacy admissions took up more slots for unqualified students over Asian Americans. AA was literally one of the only reasons why Asians were even accepted into unis in the first place.

    I think there was a quote when affirmative action was first introduced saying something along the lines of "in 20-25 years we won't need this anymore". Well, it's been 20-25 years, so perhaps there's a fair argument to say that if it hasn't fixed the problem it set out to solve by now, probably for some of the reasons Ben mentioned in the video, perhaps it's not really helping.

      i mean, i think ben kind of addresses that point - if you just implement affirmative action, and do nothing else, and in many cases do your damndest to actually make things worse or at the very least keep them stagnant, of course it's not going to have a permanent change to the system when you take it away; the analogy to just calling homeless people 'unhoused' without doing any further steps to improve their conditions is a good one. saying 'in 20-25 years we won't need this anymore' was something believed either a) because it was assumed that additional measures would be happening alongside it or b) as an excuse to cut it after an arbitrary period of time, depending which side/with how much optimism you approached it from

      @@Croz89 Something really necessary that AA did, though, is increase the number and visibility of minorities in higher positions, where they can reach down and help bring other minorities up. That itself is doing a lot to help fix the root causes, even if it's not actually enough.

    I can tell ya from my dad's stories that SEARS was one of these way back in the day when this became a thing that just hired whatever black person wanted the job. You are totally right companies that acted like this were the problem. Took me a long time to get him to see it that way.

      I have been told three separate times now to reapply for a job in a year, because they wanted to hire me but had to focus on diversity hires for the time being. I never took it as losing it to someone who wasn’t deserving of the position, rather I took it as an issue with the company. I completely agree with you on this being only a bandaid solution, while also making the problem worse by everyone being pitted against each other.

    If I recall the reason the supreme court had to remove it was due to colleges abusing that rule to prevent asian american's from being able to get into colleges they were qualified for, but the schools already hit the limit of how many Asian Americans they could bring in, as well as the fact they set the bar higher for asian Americans, and lowered it for African Americans.

    I seriously have to agree with Ben's take on affirmative action. Any public or private organization that discriminates based on immutable characteristics doesn't deserve to exist. Also affirmative action was literally a way for the Fed to just say "look we did it!" Then proceed to fix literally nothing.

    I do love when you remind us from you're from Florida. At minimum it at least makes me grin.
    Excellent points about Affirmative Action. It absolutely was necessary, but it should not have stopped there.
    They are still kicking people out of neighborhoods to build highways and stadiums. And what people don't get about this, and about gentrification, is it doesn't just hurt the people who were living in that area. They have to go somewhere else. Now maybe in an area where nobody sticks around for long, it's not a big deal, but this is affecting entire communities. People who've grown up together who've been maybe in the same area for generations and have all kinds of systems built to help them get through. They have to start from scratch now. And you have a community of people who don't know each other. A community full of people who are resentful because they had to leave their home. They weren't given a choice.
    You can't build anything with that.
    Also, stopping Dan Povenmire from singing is just cruel

    I 40% agree with you Ben!! The other 60% agreed with Texas because I did happen to my step brother. He is jet flyer but was denied a better position ( even though he was the best in the class ) to a black guy because of affirmative action. So it does happen

    Affirmative action at work places isn't about quotas. It's about companies taking actions to ensure good faith in outreach to underrepresented populations and making sure they address issues like harassment and discrimination. Schools are different, but it was never about bringing in people who didn't earn their place.

    Love this. Thanks, Ben. "Unhoused" kinda sounds like we're trying to normalize this and convince the "unhoused" that this is totally normal and fine. Well, it isnt, we should be fixing this, not putting a bow on it by giving it another name. And its insidious. We say its because a "home" is in your heart, not a "location". You're not "homeless", you're "unhoused". See? all better, now. No,Karen, that doesnt make it better. That fixes nothing, actually.
    Saying unhoused does not make homelessness feel any f-ing better. Period. To no one. Not even the kids.

    Thanks @Ben Brainard for posting this video about affirmative action / supreme court. Here are the viewpoints expressed by Supreme Court justices regarding affirmative action.
    1) This case is about a group called Students for Fair Admissions (SFFA) who sued Harvard College and the University of North Carolina (UNC). They said that these schools were not fair in their admissions process because they were using race as a factor, which they believed was against the law. The law they referred to is the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment*.
    2) The Equal Protection Clause is a part of the Fourteenth Amendment that says that every person should be treated equally by the law, no matter their race, color, or nationality. The SFFA believed that by considering race in admissions, Harvard and UNC were not treating all applicants equally.
    3) The Court looked at the history of the Fourteenth Amendment and how it has been used in the past. They also looked at how other cases involving race and college admissions were handled. They found that while diversity in a student body can be a good thing, it must be handled in a way that treats all applicants fairly and equally.
    4) The Court also looked at the idea of "strict scrutiny*". This is a way for the courts to look at laws to see if they are fair and necessary. If a law or policy is found to be unfair or unnecessary, it may not pass strict scrutiny and could be considered unconstitutional.
    5) The Court found that the admissions systems at Harvard and UNC did not pass strict scrutiny. They said that the schools' use of race in admissions was not clear or specific enough, and it resulted in fewer admissions for certain racial groups. They also said that the schools' use of race in admissions seemed to stereotype certain racial groups, which is not allowed.
    6) The Court also said that the schools' admissions systems did not have a clear end point. This means that there was no clear plan for when the schools would stop using race as a factor in admissions. This was another reason why the Court said the schools' admissions systems were not fair.
    7) The Court decided that the admissions systems at Harvard and UNC were not fair and did not follow the Equal Protection Clause of the Fourteenth Amendment. They said that the schools' use of race in admissions was not clear, specific, or fair enough to be allowed.
    8) However, the Court also said that schools can consider how race has affected an applicant's life. They can look at how an applicant's experiences with their race have shaped them and what they can bring to the school because of those experiences.
    9) In the end, the Court decided that the admissions systems at Harvard and UNC were not fair and did not follow the law. They said that the schools' use of race in admissions was not allowed because it was not clear, specific, or fair enough.
    10) So, the Court decided that the SFFA was right. They said that Harvard and UNC were not treating all applicants equally in their admissions process, which is against the law. They said that the schools needed to change their admissions systems to be fair to all applicants, no matter their race.
    *The Equal Protection Clause is a part of the Fourteenth Amendment that says that every person should be treated equally by the law, no matter their race, color, or nationality.
    *Strict scrutiny is a way for the courts to look at laws to see if they are fair and necessary. If a law or policy is found to be unfair or unnecessary, it may not pass strict scrutiny and could be considered unconstitutional.

      The court decided wrongly on strict scrutiny. There is a compelling interest for Affirmative Action. More compelling than a states interest in preventing abortion anyways. Affirmative action is the most useful tool our country has ever used to try to alleviate systemic wrongs (which as Ben pointed out is pathetic). And it was working to address generational poverty amount specific racial groups.
      How can SCOTUS on one hand say states have enough compelling interest in getting more unwanted child dependents born yet no compelling interest in significantly increasing social mobility for historically disadvantaged groups.
      Additionally, they could have at least worded the ruling that meant legacy admissions were not permissible either. Which would put more than 4x as many seats up to actual merit based competition. They didn't.
      The court is just doing whatever it wants so long as rich conservatives win the most and the most people they don't care about suffer.
      I expect to see low income enrollment drop regardless of test scores and I expect that drop to hit minorities even east Asians the harderst.
