In delivering Justice it is not only about the facts but justice should also be seen to be done. So it speaks to due process. The outcome of an election should be as good as the process that delivers it. Now that these matters of determining who has won conclusively are no longer the responsibility of the divided IEBC because of their commission or omission, it is going to be determined by the Supreme Court, the entire election process including irregularities in polling, counting, efficiency in entering data into the 3.4a forms, 3.4b, and c forms during tallying, etc for the supreme court to use its delegated power of the people to deliver Justice to the people of Kenya. Rt. Hon. Raila through his previous election petitions has also contributed to the incremental improvements in the conduct of elections in Kenya. Prof. Manyiora must realize there are better minds than his. His argument about the 4 rebellious Commissioners being in the majority and therefore their opinion takes the day. I agree with. I am trying to listen to Manyora as carefully as I can but I don't find myself understanding what he's trying to evplain as mucha as he's explaining what "perception" is. Please why don't you open up and pour out your heart!!!
Lawyers sometimes are in taking round and round. It's correct that it is the chair who proclaims the outcome of presidential tallying. Verification and tallying if form 34As is vested on the commission not the chair person. However no need for voting but based on verified figures from the forms.Who is right?
The lawyers in the studio should address and not ignore the issues relating to both,
the letter and spirit of the Law and/or the constitution. In delivering Justice it is not only about the facts but justice should also be seen to be done. So it speaks to due process. The outcome of an election should be as good as the process that delivers it. Now that these matters of determining who has won conclusively are no longer the responsibility of the divided IEBC because of their commission or omission, it is going to be determined by the Supreme Court, the entire election process including irregularities in polling, counting, efficiency in entering data into the 3.4a forms, 3.4b, and c forms during tallying, etc for the supreme court to use its delegated power of the people to deliver Justice to the people of Kenya. Rt. Hon. Raila through his previous election petitions has also contributed to the incremental improvements in the conduct of elections in Kenya. We hope that even in these upcoming petitions, the Judiciary arm of government in Kenya will still help to make a determination on areas that may still require to be straightened to make elections in Kenya the best in the world.

Prof. Manyiora must realize there are better minds than his. His argument about the 4 rebellious Commissioners being in the majority and therefore their opinion takes the day. I agree with. M learned friend Joy and her reading of the Constitution and the law. The Supreme Court will be guided by the Constitution and the law and not the perception that we or part of us create in the public space. I am persuaded to invoke the political thought angle in this debate. The good old professor is an Azimio agent in this forum and this masks his bility to think broadly with the big picture view and not the narrow picture. At this point, I think Prof Manyora should keep to his Lane and refrain from encroaching an area he is not qualified to handle.

Prof is biased against the commissioner. The commission was not to decide for Kenyans. To insist on decision making by the commission in manner suggested by Prof respecting the elections is to say that the commission should elect the president.

Chebukati was acting as the returning officer. The commissioner had no direct role in declare the results only in ensuring all returning officers did their job. Only one candidate thought they had won when the figure said other wise. Sorry, you are enabling bad behaviour.

At 1pm the media was still showing about 30 constituencies that had not been announced, at 2pm the announced was that the counting has been concluded our chairman Chebukati then refuses to have a meeting with his people to even address the alleged malpractices then He goes ahead and announces his well known friend come on...I bet you want a good future Kenya for your kids that is if you have one. The problem ws in Bomas talling center,chebukati didn't tally all the forms,there's 28 some forms tht ws nt recorded in the IEBC portal.the election ws nt free and fare ,the opaqueness ws included.

Whether Manyora accepts or not we can actually do 10 elections in a row and Raila will lose each single one of them but will never ACCEPT the results. The will of the people is final -as represented in form 34a. The server is open and all that is needed is a simple basic calculator like fx82 to confirm who the winner is. The people of Kenya have spoken through the majority of votes and not majority of commissioners
