Police Arrest Unpermitted Hot Dog Vendors at Santa Monica Pier

  • Santa Monica Police Officers from the Unpermitted Vendors Task force arrest two unpermitted hot dog vendors for violating ordinance 3.36.290 (Prohibition on use of combustible fuels in and around pier) at the Santa Monica Pier on Monday, March 21, 2022. Food and carts were also confiscated.
    The multi-department task force consists of Santa Monica Police Officers, Santa Monica Code Enforcement Officers, Santa Monica Fire Department personnel, Santa Monica Harbor Patrol Officers, Public Works, and private security guards.
    The newly formed task force has been instrumental in helping to educate and enforce the City’s safety laws and ensuring safe sidewalk vending practices across the City.
    A new emergency ordinance 3.36.290 Prohibition on use of combustible fuels in and around pier passed on August 24, 2021.
    The Santa Monica Pier has a worldwide identity. The City wants to preserve our decades old wooden Pier so it can be enjoyed for years to come. Unpermitted butane/propane cook-cart is a potential fire hazard for the Pier, the City’s Code Enforcement, the County Health Department, and the City’s Police Department periodically conduct educational and enforcement campaigns to help keep the Pier safe. This safety focus calls to eliminate all unpermitted carts, while addressing improper hot grease and trash disposal, and unsanitary food service conditions on and immediately adjacent to the Pier.
    According to information from the City of Santa Monica website www.santamonic... ; Santa Monica was one of the first cities in the state to develop a permitted vending program. The City's comprehensive program that has allowed permitted or licensed vendors to operate for over 30 years includes permitting processes and parameters for safe vending, and today over 150 vendors are legally permitted to vend in the city. In 2018, the state law changed with the “Safe Sidewalk Vending Act” (SB 946) to provide important entrepreneurship and economic opportunities to low-income and immigrant communities.
    State and local laws guide safe vending practices and standards in Santa Monica. All vendors need a City of Santa Monica business license and if applicable, a vending permit to sell any items in the City, and vendors selling food must also obtain and display a Los Angeles County Department of Public Health permit. The permit requirements reflect Santa Monica’s commitment to balancing public health and safety with expanding opportunities for micro-entrepreneurs.
    Vendors are encouraged and welcome in many sidewalk locations throughout the City. In particular, sidewalk vendors are encouraged to vend on the sidewalk along Colorado Avenue between the Expo Light Rail Line (4th Street) and Ocean Avenue (top of the Santa Monica Pier). Street vending is restricted areas including Third Street Promenade, Palisades Park, Santa Monica Pier and the beach.

      The police officer knows that the permit on pier is $1153.99 per month on April. The police wants to justify his work which is basically kicking out of the vendor who are not able to pay the $1000 rent. Do you want to be the police who support and help weak or Do you want to be the police who kick out of people you already know that they can't pay the rent? That's why our police cannot just kick out of people. I can see how great police he is.

      @@Fechual To a certain extent yeah maybe. But by the same token court is not being held out on the pier. The city requires permits, the police are simply enforcing the city's rules...they don't make those rules. If the vendor's feel the rules are unjust then they can bring it up with city government or argue it in court.

      That must be the one reason so many vendors went to the Pier. San Francisco has also same problem with pier selling too. Also, the other reason is that visitors don’t want to pay lots of money for their meals when they visit the pier, so they buy things from those vendors who are there illegally. Btw, You want to live in Beverly Hills? I wanna live near the street of Camino de Estrella. Also, I can’t afford that now. Maybe selling merchandise on the street could be the first step toward the dream? :D I am the one who got the permit from the city, and I am struggling at this moment and confront with problems. Will you help me?

      @@SA-hz1rs Yes, that is my point, they need the permit, but at this moment, they can't get the permit. Even if they get the permit like I get the permit(I am proud of myself though), there is no place to sell. S A, I am not the side of people who doesn't even know health regulation and sale's tax; also, when we look at some vendors cars, they have more expensive cars than we have, and they don't want to rent the pier but they want to sell!! lol!! However, S A, there must be the way to solve this situation if we try to look at what is real issue. That's what I really want to say.

    Sellers without a license or permit know well the risks. Anyone that breaks the law knows the risks. Here in New York City the food is tossed out and they get a citation. Once a churro lady was arrested in a Brooklyn subway station, but she was a repeating offender. She was warned several times before to leave and she didn’t listen. Then she was arrested. Then the media got involved. Made it seem like the cops were the bad guys.

    Glad the City is staying firm on cleaning the pier up. In the early days of the task force, the vendors smiled and said we don't care if you stop us today, we will be here tomorrow, and the day after. I assumed the vendors would win over time by law suits, public pressure or the leaders of the city throwing up their hands and giving up.
    Goes to show standing by a reasonable, workable plan can succeed.

Go back to earlier videos and see all of the trash, masks, food and wrappers, not to mention the countless times they poured their oil and grease onto the pier, seeping through the slats and onto the beach and ocean below.       You're so gullible to believe that the fire was possibly started by a food vendor. Look at the location where the fire started and ask yourself, who was the first one to discover the fire. All that info was discussed in the prior video.
      Seems to me like it was a controlled fired. That fired conveniently justifies the removal of the food vendors on the pier from this point forward. Why didn't it occur anywhere else on the pier?.
      That fire conveniently started at the edge of the pier, next to a fence, right above a fire door below. And that area looks like there wouldn't have been anyone around to witness it.
      Until they arrest the actual person that caused that fire I'm gonna be skeptical about it.
      And for the time being, I believe that they should let them sell their food with or without a permit. Let the people decide if they want to buy from them or not. I don't buy it, that the government wants to justify their removal for our safety, health wise.

    The officer is a very patient as he has no obligation to hold a dialog with general public. He is doing his job which is to keep the pier safe (safe from unsanitary food and potential fire hazard).

    The first time I saw one of these videos of the police confiscating the food carts I felt bad for them. Then I watched many of the other videos and realized the police are doing the right thing. They have given these same group of people warning after warning that they can’t sell on the pier without permits. These people don’t care and run the area like a gang attacking any other vendors that try to sell near them. They keep their raw bacon wrapped hot dogs in a box under the cart all day with no ice or refrigeration to keep them at a safe temperature. Who knows how many days the same unsold hot dogs come out to sit there day after day and how many people have gotten sick from eating them. The fact that they make no attempt to follow the most basic food safety protocol shows they don’t care about the safety of their customers. It’s a huge public safety issue to allow these people to serve food to the public. It’s also a slap in the face to all the businesses on the pier that have their permits and pay rent to do business there.

    7:10 “we had a fire two days ago” so they already almost burnt down the pier, which was thankfully put out by Pier Safety Task Force already on the scene, and then FD who had to use ample fire retardant foam to protect the nearby wood and put out the smoldering inside the wood after the fire was extinguished by a fire extinguisher, or people could have perished in the fire, or drowned jumping off into the water, or been trampled by frantic crowds running! So, breaking this law is NOT a minor offense, these crowds heckling cops enjoy the pier yet don’t care if it’s destroyed over a $5 hot dog cooked on a grill black with filth, but they wouldn’t want it happening in their backyard putting them at risk, so I just don’t understand the problem they have with obeying necessary laws like everyone else! Combustibles on the pier = jail, fine, impounded carts, etc, so please! just respect the law, there’s a reason for these laws, and it’s not all about you, you want community support, but threaten entire community, everyone’s lives and jobs, for your own selfish gain, it just doesn’t work that way! I used to be very sympathetic to the vendors too, but they have had plenty of time to get it right, and there was a fire two days ago, so NADA MAS!

That fire was an accident likely caused by a cart left near that fence while vendor went to the bathroom and the the combustible on all those carts either exploding from the heat of the sun, or being left unattended and the cart was removed by the vendor who ran away instead of putting out the fire, either that or a meth head, but either way combustibles are banned from the pier, so you can imagine the cops are setting fires if you want, but it’s way more realistic the fire happened from negligent handling of banned combustibles whether it was a cart or a crack pipe, it’s banned, period because of the FIRE HAZARDS, this issue has to do with preservation and safety of thousands of lives, not just those willing to risk theirs to save a dollar on a hot dog

    Man, this is still going on? Dealing with these people is so frustrating. They act like this is the first time they've heard you can't just come and setup on the pier. And those crowds surrounding and heckling the police, wow. I admire how patient and calm these officers are. My patience would have run out a long time ago. Not a fun or easy job.

What I'm talking about is if they have the necessary permits to operate. If not, then what matters more is not only health code and what not, I care if they are paying their fair share. I love street vendors, but I despise those who take advantage, make a mess, leave their trash for others to pick up. Seriously think about it, who pays people to pick up and clean our streets. Our taxes. The example they are giving, in my opinion is that anyone and everyone can be a street vendor ( which is actually true) but can't just set up a tent or a make shift stand on any piece of property unless it's you'res and the state or county or community allows such sales in neighborhoods or where ever you live.

    Glad to see they are toughening up for the safety of the public. These people think that they are just trying to earn a buck, but they do not realize the danger they put everyone else in. The tougher the consequences for endangering the public the less violators there will be. What a stupid question," Why are you taking the carts". If you brake the law with it, you loose it! If it is DANGEROUS you aint getting it back. But it is California and they'll probably get everything back and composition from our taxes.

Hot food had to be kept at a certain temperature. Call food had to be kept at a certain. Meat had to be cut on one cutting board. Fruits and vegetables had to be cut on another cutting when we serve Buffett we had to put up a sneeze guard. Straws had to be individually wrapped. Customers and workers stand right over there food talking I'm passing money. There's numerous, numerous violations with the "street venders" if a restaurant or fast food place did the same thing they would be fined. Not to mention tax violations also!

    My husband owns a restaurant & he had to go through hell and back to get permits and clearances, not to mention all the money he spent. People who work on the streets selling food without permits shouldn't be allowed to get away with it. That Mexican woman defending her was running on pure emotions and not logic

      I didn't care about any of this until I started my business and went through all the red tape to get my permits to sell. Now it infuriates me when I see people doing it illegally without permits, without tax paying etc. It's not fair to the rest of us.

      These officers do not want to be a bad guy, that's why they are nice as much as they can. The police do know that there is no place to sell, and the permit on pier is over $1000 coming April, but that's not their job to adjust the permit price, the pier management set the permit price.

    These people get involved talking like they know what's been going on for 2 yrs...Vendors have been told the consequences for coming back...S.M Police are always respectful to them and vendors get aggressive and rude especially the young ones.     Not sure how they do things in Mexico but in the US they require permits for food preparation and sale. Added: And cooking food on an aluminum trey is probably not safe. I think bare aluminum might released toxic chemicals into the food. Most aluminum cookware is coated.

      You should know better stop eating those nasty hot dogs because next time you might end up in the hospital I hope not
