Veteran Cop Admits Under Oath that he "NEVER received formal Field Sobriety Testing TRAINING"!

    My first Jury Trial I've ever done -- my Trial by Fire. To this day it makes me cringe how nervous and loud I was.. But, hey, we all have to start somewhere!
    DIRECT EXAMINATION: 0:00
    CROSS EXAMINATION: 38:46
    My client got his truck caught in a fence. Once he freed himself the officers were already on scene because some coon hunters (yes, we have those in Kentucky) who happened by, saw him stuck and called 911.
    My client was arrested and charged with DUI. We had to go to trial because he was a CDL license holder and could not risk losing his CDL privileges for a year.

    The only thing the field sobriety test does is convict you. Never take it. Never take any test. You stand a better chance in court with them having to prove you were drunk without any evidence.

      71donkrider yes they take license but giving evidence against yourself will not help case. They are not looking to free you but to hang you up.
      So can testify against yourself on side of road or take loss of license well you wait for trial.

      It is a myth that the only purpose of the tests is to convict.
      I was pulled over for DUI one time, admitted to drinking, and given field sobriety tests. I passed them and was let go.

    I love how the demeanor of an officer completely changes once Mr. Forman begins asking questions. I mean, they act like they are the most confident, polite and by-the-book officer on the force during direct examination. And after about 3 questions from Mr. Forman, they begin to come off as confrontational, argumentative and lacking in training. That's a good freaking lawyer.

    I’ve seen a lot of videos like this that these officers have little or no training and the odds are stacked against you , even if you are sober. What’s even worse is even if you are innocent it costs a hell of a lot of money and time to fight this in court. They make you pay one way or another for the officers mistakes.

      Naw I think you misinterpreted. He said he parked on a hill but the camera didn’t see the test because they were down at the intersection where is was flat.

    Oh my lord. Massive mad props to this defense counsel. Asking the officer if he knows if the machine is under warranty. When the machine was maintenanced the month of before or after the arrest. Wow. Wow. That is a solid defense point to argue.

    The bit that got me was when the prosecutor was determined to not let you ask the officer to demonstrate a sample of the test of what he actually said he did on the night in question. If you cannot get up in court and do a short version of it whilst showing no clues, what hope does anyone have? Prosecutor really didn't like you pointing out the two clues the officer showed because it undermines the entire test.

    After subscribing to the channel I started researching body language and I love the defensive, arms crossed position the Sergeant takes when being asked if he was aware he was supposed to document what the defendant specifically did when he "failed" the Field Sobriety Test. NEVER take a field Sobriety Test! If you are sober or had one drink with a meal, take a blood or urine test, and get one done at your own expense! This "game" I rigged AGAINST you. If you are sober, you can still FAIL!

    Well played. By introducing the study to the witness, and then making him say that he wasn't aware of it, that further discredited the witness. Either way, either affirmative or negative response furthered Mr. Forrman's goal to discredit. Fantastic job sir.

    Thank God for lawyers!!! Think about this fellow citizens, when you go to court it's 3 against 1. The 1 is you, the 3 are the judge, prosecutor and the police. If I'm ever charged with a crime I didn't commit, I would be so very grateful for legal representation. I have the highest respect for lawyers, I really do. And one more thing, never ever talk to the police.

    The way you express yourself is inspiring. Watching you use aggressive tonality and high energy expression through your demeanor simply inspires and captivates. Im currently going thru a 2nd Dui charge, It's being set for jury trial in march. My attorney to me seems very unzealous. He keeps me in the dark, very hard to get ahold of, and i live out of county and the drive is nearly 2 hours to his office. Well, at the last court date he said "get in contact with me in january". I have no idea what hes planning or if hes even planning anything towards my case. So any continuances, no offer from the state, i just feel lef tin the dark, ye thes already fully paid off. I don't have the money to hire a new attorney, and i don't know how to go about that in a case to where i would like to somehow transfer the money i paid this attorney to a new one. I don't know if its too late to even attempt it.

      Don't feel left in the dark. Many attorneys do this to not get clients' expectations up. Also they do this to prevent clients from getting chatty with someone they don't realize is associated with the prosecution prematurely revealing a major flaw that could prove a client is innocent or get them off the hook because something was done improperly.

      There are a lot of interesting parallels between the sovereign citizens and the first amendment auditors. I don't always agree with the tactics of the first amendment auditors, but I do think their actions have led to many LEO's improved education regarding civil rights.

    Man you crushed him . I did notice that when you had him flustered he would blink his eyes erratically. And when he had to do the heal to toe and tried to tell him what he did wrong and judge said you couldn't then finished up and whent back to the podium and said it again lol it was a good move to make sure that the jury looks at that.     I get the feeling that this particular judge would always rule to the benefit of the prosecutor or police. It is absolutely disgusting the way the judge treated the demonstration. The prosecutor knows whenever he objects it will be upheld. It is especially grievous in view of the fact that the officer has never received formal training.

    Something I’ve noticed in this video is how the cop answered the prosecutor’s questions, compared to answering the defense, also pay attention to his body language when your asking questions, just like he doesn’t even care, or wants to be there!

      In most of the United States it is ILLEGAL to drive a vehicle with a *breath alcohol concentration* (BrAC) of 0.08% or higher.

    I fully support good law enforcement. I do not like how police officers demand that civilians address them by their police rank. Your rank means nothing to me. I am a veteran. If a civilian says "hi, sailor", I'm not going to say "I am addressed as (rank/rate)!". To Law Enforcement: Your ranks are relevant only within your department.

    It is a very good thing that this sergeant or someone like him never pulled me over when I was having an extreme hypoglycemic crash. During those episodes, my speech is slurred, my balance is disjointed, my walking is completely off, and I have even admitted to the paramedics that I had 4 or 5 glasses of wine - when in fact, I had had no wine or alcohol to drink. 🙈🙉🙊🍷🙈🙉🙊🍷

    My biggest concern is that people find out who the number one police trainer is in the US - Dave Grossman...his training is turning cops into paranoid warriors who see all civilians as threats whose sole purpose is to kill cops. Every citizen is guilty. Every citizen needs to be challenged, questioned, interrogated, identified and categorized into either "less of a threat" or "deadly threat." Any citizen who challenges, questions or refuses a cop's commands or demands automatically becomes a "wolf" and, in Grossman's words, "Wolves need to die" either through deprivation of liberty or outright extermination. And, to top is all off, Grossman tells cops that when they shoot and kill someone they will have “the best sex of their lives.” There is no such thing as "community policing" or "protecting and serving." From the moment an officer gets up in the morning until he or she goes to sleep at night...there is only surviving and God help anyone who threatens that survival...whether it is a real or perceived threat. And non-compliance, suspicious behavior, or even abnormal behavior is seen as a threat.

      Oh, it is unbelievable. He travels 300 days a year talking to police departments. His seminar is called, "killology" and "The Bulletproof Warrior." I have the seminar booklet. It is sick. I am an English Professor and writer. My specialty is in analysis and criticism of information. What he teaches needs no deep analysis. It is just sick. I am commenting on as many forums as possible to educate the public as best I can.

Every officer that is deceitful, dishonest, and convinced they are above the law or that they ARE the law make those good officer's jobs more difficult and erode the people's faith in the system.     I love when you are owning the cop the judge has to shut it down. Him showing signs on the demonstration should be something the jury sees and hears so they see how bogus the test is
