    Hello im a local realtor and first off im very sorry.
    We all know value especially commercial in PF is incredibly high and i can imagine anywhere around half a million is very low.
    Fair market value would imply what it would sell for in today’s market.
    You should have been compensated with an agreed amount long before eviction and even given time to leave after.
    Its pretty insane considering you need relocation funds!
    Keep making noise! They should have settled your debt long before possession

      @@tianawinterRelocation865 she would have known how much time she had to vacate but not having any cash in hand is a shameful thing to do when eminent domain is exercised. Shame on the city for screwing the resident. From what I see on prices for comps they probably got screwed. The price they offered would be fine for older residential 2 to 3 bedroom but lowballed if it is really zoned res/business and it's located as close as they say to the strip..

      @@rebeccalynn7795 I don’t know how much land and after road how much is left.. but that structure looks older, on a crawl space. Mixed and commercial has potential like anything else but investment into a business takes so much capital and they pay tens of thousands to demolish and haul away, then rebuild. So yes commercial may be more in a thriving market and do you see new commercial businesses going up from scratch? I don’t see that many and it depends on the size of land. If it’s too small for both parking and building you can forget a high price or even a buyer as the piece would have to be added to the adjoining to get a fire truck in and out.

      It does, on paper, legally belong to them. This property was transferred to City of Pigeon Forge on 5/6/24.

      If you had not watched all their videos go back and watch all of them. I think they discuss some of the issues going on in the town that make it hard for people to stand up there. There's a lot of crookedness going on behind the scenes in pigeon forge. A lot of the citizens are supporting them the best they know how at this particular point in time.

Once they started finding out about it they were very upset and started posting videos about him asking other people to share their stories. If you'd watch some of the videos you would have known this. So it's nice for somebody else to say oh well I only stood up because it happened to them. Well why don't you do a little bit more research for you accuse somebody of doing something that didn't do.

They have a responsibility to help get these corrupted officials out & that may mean a loss of revenue until things are made right. At any rate if they let PF get away with it this time, next time it may be their own business that gets chopped.       Yes, it needs to go as high as it needs to go to get these good folks their “fair market value” but I argue the need to change the use of eminent domain throughout the country. It is a very good tool that benefits both city and residents but there are rules that have been ignored, broken, etc here that needs to be fixed. When it is used as designed, it is an asset for us all but there are crooks running the show right now which is the problem

      @@Admin-ys 😂 The house is already gone. Besides that, the property already belonged to the city before they purchased it. If anything, there was some shady dealings in regards to the sale. How do you think they got it so cheap!??? Their own words were it “fell into their lap”. With the way the market it, they should have known something was wrong. City offered them numerous amounts far exceeding the appraisal value of the home, only for the family to want millions! Nothing more than incompetence in regard to the home purchase. They’re only in for sympathy and the money!

    This same thing happened to a family in Oklahoma. They sued and won 2.9 million. They had refused all offers for the home. I'm sorry for your loss. Keep fighting. Your rights have been severely violated.

    Those City officials are dirty. Dirty, dirty, dirty. The Mayor stating he has “no obligation” is CLEAR that he thinks he is above all citizens. Every single person who owns property there better be on alert. It does not make any sense for any government entity and/or officials to take the People’s property. Especially with ZERO financial transactions. We are very interested to hear what you know. My heartfelt condolences for loss of your property, for what you put your heart and soul into to be snuffed out by typical tyrannical elitist government. God bless you and He will keep you.

      If it is similar to Alabama the mayor is probably correct. I am a councilman in Alabama. The mayor can recommend to us things to vote on and what he would like us to do, but he cannot spend a dime without council approval, and the council would have to approve something like this and he would not have a vote in the matter. It is however amazing to me that it actually came to this point. We have purchased property from residents and we were able to negotiate a fair deal for all sides. We never have had to get to this point. It is sad.

It’s like around me in Red Bank- the town has built up like crazy between 2004-2008 and is doing it again. Walmart bought up a mass amount of property. The state took land for roads. It was pre planned. It may not happen in a decade or your life time but the town or city you live in is set for change and an interstate addition highway or another town can be coming near your back door soon!!

    I live in Georgia and my family and I have been going to Pigeon Forge for 52 years and I hate what it has become the greed is overwhelming.
    I know what it’s like to be in a David and Goliath situation and what has brought me through these time is knowing that it only took ONE smooth stone to bring Goliath to his knees.
    Oh and by the way I AM a camper and have many camping friends and I will spread the word about the RV campground. They will not be get my money.

      I’ve been a licensed RE Broker in 3 states since 1994 , 30 years, my goodness where did all those years go? But anyways, eminent domain has some clearly defined rules that local, state, & federal governments must follow in order to take a property under eminent domain. Now clearly, if they decide they want your property, they are gonna get it but, they must pay you “fair market value” for your property and sometimes that means that it is tied up for years in the courts going back and forth with appraisals and other evidence to show what the fair market value of the property at the time in question is worth. The city had no rights to bulldoze the house until they had not only possession of the property but also legal, unencumbered title to it as well and that they did not have!! There is a massive difference between a property that receives a commercial appraisal versus a residential appraisal. Not only are values completely different 99/100 times but the entire appraisal process as well as the forms and the methods of establishing value are different and they use different comparable , etc., and be legally they can not lay a finger upon the property until just compensation that is agreeable to both parties has been paid and title has been transferred and the encumbering mortgage has been satisfied. This is a slam dunk legal case for a good real estate attorney. I’m not gonna tell you it’s gonna be an easy case, but it’s a very winnable case for y’all and you should prevail with a verdict giving you fair market value for a property valued under a commercial appraisal because whether or not it is currently zoned commercial or not does not matter but what defines the current value on July 1, 2024 is what the highest & best use of the property is. If the property is close to the strip and everything around you has been either converted to or selling as commercial property, then the highest & best use of the property will be a commercial use regardless of what the actual current zoning is. Many times, it’s not uncommon in towns like this that have been expanding and you will see all the old homes along the main drag that have been converted to small shops, restaurants, bed & breakfasts, etc and when looking at the zoning map for the city you may find 100 properties that used to be residential but are now commercial properties but smack dab in the center of it all may still be one or two residential properties that had an elderly couple living in them and they did not want to sell cause they raised families in that home and have memories there but now they have passed and the property is being sold and we have to look at that property now as a commercial property because that will be the “Best” use for it now. No one will purchase that property now with intentions of having kids and spending the next 60+ years there raising kids and grandchildren but it’s day has come to turn it into a store front or office like the others on each side so it’s value must be considered commercial and the appraisals will reflect that. Because of the way this transaction is being handled, it would not surprise me one bit if you walk away awarded Treble damages as long as you have a fair & just court overseeing the case. You are entitled to those damages and should be awarded them from what I’m seeing and comparing to other cases I’ve seen over the past 30 years.
      I’m sorry I got long winded but thank you for reading. I’m not far from you guys just over here in NC but I also grew up as a Buckeye and my grandfather had a large farm in LaRue Ohio and our childhood home was in a small farming community called West Milton. I have a brother in the Columbus area and a sister in the Dayton area yet. I’ll keep y’all on my prayer list daily cause I probably won’t be able to get to the city meetings but do not give up folks!! Be prepared to ride this as long as you need to ride it in order to get fair compensation!! If we need to set up a gofundme in order to help keep you guys alive and keep your good credit rating until this can slowly maneuver the courts, I’m sure you will have enough of us that would donate to keep your dreams alive! I understand how hard it is cause I lost my property last year in a crazy situation and most folks do not understand how fast & easy our government can steal our property from us but it’s happening every day!!! Please, do not give up!! Y’all still have the fight in you to fight it all so please fight and send the message to Pigeon Forge that they do not get to run over it’s residents!!?

    If you sue them in federal court and request a jury you will see a huge settlement . . The city is on the hook for your loss , your mortgage, and mental anguish compensation.
    No government can take property without compensation and it would be in the best interest for the city to offer a good settlement now before it goes to court.
    Do not miss any payments on this property and make sure all the taxes are paid because they want to drag this out and maybe get the house in foreclosure

      I think a key piece of the puzzle is being left out, that is that the city did deposit the appraised value into the court registry which legally gives city access to the property. This is how eminent domain in Tennesse is handled. The date of deposit provides city with possession. Once deposit is made, the property owner and lender can withdraw.

      I agree that they should not not miss a payment... Messing up their credit is a bad idea in general and they don't need anymore added headaches. You guys have done a great job so far with keeping everything documented from what I've watched and just keep going including making that payment. I'm just now tuning in to this but from what I have seen its wild to me that y'all have not been compensated... It doesn't shock me that the house was forcibly taken and demolished that was unfortunately always going to be the outcome but it definitely should've happened after fair compensation on a fair market (commercial) evaluation. 🤷

      They were offered 490k 10/23. They paid 309k 8/22. The Race’s countered offered 3M and refused a settlement. The city offered a fair price. The Race family is not entitled to become millionaires on the backs of the Pigeon Forge taxpayers. Clearly 3M is not a fair price.

    The county did this to my family about 20 years ago. They took approximately 20 acres for a school to be built and to this day there is not a school on that property. My family did accept the pennie’s they were offering for it due to the county threatening to condemn it. At the time the attorneys we talked to said there was nothing that could be done. I hope you kick their ass and get all that you deserve. Hopefully the good ole boys won’t win again.

    If your property is "taken" under eminent domain, the county must notify all parties that the property is now the property of the county. You are entitled to get an independent appraisal for your property. No one can "force" you to accept a low ball offer. 5th amendment protects you. You folks need to find a owner friendly court not corrupted be a builder.and county.

    My whole family is a first hand witness to corruption in Gatlinburg! We sold our houses in our same neighborhood so did everyone who lived in that neighborhood because they built a new rental on a hill that should have never been built on causing all kinds of problems for the two families next door to the new rental.
    They chased so many families off of BrentHills Blvd in Gatlinburg

      I don't think the past owner knew it she was an older lady who tried to sell the land to the mayor and the mayor said he did not want to buy it. So she did not know as far as I know that the land was going to be used for a road. The mayor though did.

      The Title Company should have done their research before that actual sale. It is their job to search records for any issues with a property. The Title Company should be contacted.

    Mayor Wear knew what was going to happen to this house before yall even bought it. when he and his brother bought the property next to you , they knew what they was doing. I'd gather up the original road construction plans , the new road construction plans, all notes and records and go to the Supreme Court of Tennessee.
    Mayor Wear is not the end-all be-all headhoncho in Tennessee, no matter how much he thinks he is. There is a process to eminent domain that even he has to follow. If that is not followed , yes you can file a lawsuit against him , and the county.

      I had part of my front yard taken from em dom. But I had an attorney and knew when I was buying that the projected plan had part of my prop. But she doesn’t even mention she has an attorney. The atty should have been handling this and set up an em dom real estate appraisal to justify her claims and her atty should handle anything regarding this but she doesn’t mention that she has representation. That is not wise. Town hall meetings is not the way to handle this

      i found out when visiting there several years ago with a friend looking to buy rental properties on wears valley. when talking to the builders themselves my friend decided to bail out when i came to him with news from the builders themselves. he was soooo done he went to florida and bought properties there instead. noone wants to go vacation in a place thats supposedly family oriented when they take the families homes from the very place they call a family place is pathetic!!! gives me more incentive not to go!!!! not giving my money to a place that DOESNT even respect their own people!!! disgusting at best!

And if you've watched all the videos then you've gotten a lot more information about all the situation. The only reason the road design was changed is because somebody in the government there is a co-owner of the RV park that they decided to buy and renovate and turn into a brand new one. The road originally was going to go through a corner of the RV lot they had nothing on it. They live in Ohio. And they were not towed anything about a road being diverted because of someone buying a campground and wanted to renovate it or anything like that. The mayor set there from his property which he could see their house and on purposely watch them renovate it for 7 months not once stopping to tell them about The fact that the land was going to be taken by the city. He watched them do it. You could always go down to the courthouse if you live in the area July 8th I think she said it's when they're going to have their next city hall and see for yourself if it's true or not. But they've been a lot of people that have went to the meetings and so far everything seems to be legit. The governments have gotten corrupt so bad in cities all over our country not just our federal government. And so many people have lost their property to illegal intimate domain that she's not the first one that this has happened to. Where they have been bullied lied to or treated out of their property You're many stories of such the events happening. That are starting to come out. You can believe this fish if you want I happen to believe what she's saying.

    Unfortunately, this is one of those situations where if you were a Senator, or if you were a member of Congress, And it affected them guaranteed something would’ve gotten done, but because this is an actual civilian,… well, the rest is history…. My in-laws lost property in Massachusetts due to what they called eminent domain so that “Prince Spaghetti” could build an open up a headquarters plant in Lowell, Massachusetts… my in-laws lost a big portion of their property because of this so-called eminent domain, years later, “Prince Spaghetti” decided they no longer wanted their headquarters in Lowell, Massachusetts, and sold the building off and left….
    Eminent domain is nothing but a mockery! It’s a way for people to take what they don’t own… and want…..!

    The city is waiting on it to default with the mortgage lender then they can buy at courthouse steps. If you have an escrow account there should be a homeowners policy involved. If you did not escrow then call your agent. I am a Loan Officer even when we see property bought by force of city your still on the deed and until you convey your interest then they do not have clear title. I hope you don't have to fight city hall with expensive attorneys. Prayers as in 24 years in lending have I EVER heard such criminal actions 🙏🙏🙏

    Oh my word!! I can't believe you are in this situation. I live in Central Florida and we have/had an eminent domain case with Duke Energy. We have 10 beautiful acres with a small 2 bedroom cottage, shop, and barn. It's been our home for almost 20 years. They contacted us 2 years ago and said they would be taking 2 acres for a new power line. The acreage they wanted backs up to the beautiful view we have of the protected wetlands we live by. Our beautiful view 😢. They would be there for 2 years. I was so mad, sad, and confused. I have watched my 4 grandchildren play in that area and ride their 4-wheelers, build things, fairy houses, and all the kid things. They had a treehouse too. It all was going to be gone. I made them PAY!! And I got a lawyer. We settled and if they go 1 day over 2 years, they will pay us 2,000 per month that they go over that time frame. I would have happily given that money up for our land back. 😢 I can not believe they took such a beautiful home and you have 0 compensation. I am so glad you're fighting against them. You should be compensated!! That is your legacy and your life! I'm so sorry and I'll be praying for you. 😔 ❤
    Meanwhile, I'm still waking up to heavy power equipment every morning at 6 . They have 4 months left and I don't think they'll make it.

      It’s not what it used to be before all of this. It’s lost its family feel. Too many breweries and too much being built in top of on top of already existing businesses. The Christmas lights are crap now. At least they were the last time we were there. There are too many other lights distracting from them. We used to go several times a year. Nothing there for us anymore. That’s my personal opinion and I know a lot will disagree with me. They’ve ruined the beautiful mountains.

I had a neighbor break every rule as a land owner and dump/funnel water onto my property and put a ditch and an illegal road in front of my home. I had another neighbor burn house trash illegally and dump sewer on their land because their septic was not hooked up. I fought with the county and the neighbors. It took its toll on my life and happiness. I sold the property and moved away. God had better things for me. God has something better for you. God bless you.

    Call your homeowner's insurance company. File a claim for a damaged house and get an adjuster over there PRONTO.
    When they show up & see that there is NO house, they will have a problem, and the insurance company will want to be made whole

    Okay I've done a little research on Tennessee rules of eminent domain and see that condemning authorities such as City of Pigeon Forge must first deposit with the court the amount of the appraised value, in order for city to take possession. My guess is that the city did complete this step so I'm looking for the Race family to clarify. If this deposit happened, then any statement saying city has not yet paid is inaccurate. Keep in mind this deposit does not prevent the family from further litigating to obtain additional money. They will have this opportunity.

    In the 1970's a missionary who owned a house had to go to court in a similar problem at the end the Judge said...he owned the house outright and the mortgage company was instructed to "give" the house to him for the sum of $1.00 therefore, his mortgasge was "paid" and THEN the county, state, and mortgage company had to find them a new home, no down payment and they had to do it within 6 months...and they did.

    What did they pay for the property, as it was a fairly recent purchase from what I understand? What were they offered by the city? What was the day of condemnation? These are relevant facts that I haven't seen in the videos. Almost certainly this taking was underway when they purchased the property as these things take years to work through. They certainly received a check that they chose not to cash it. You cannot stop a taking simply by not cashing the check. Lawyer up and hire your own appraiser. In an eminent domain case, always cash the check, you can still fight over damages and value after. It is not seen as accepting the agreement as in some other instances.

And when buying property check the towns building plan because properties may be in zones that are deemed to be used for the use of the town in Ada Vance. The building plans are in place sometimes decades or more in advance. Cities are planned out way ahead of time. I feel bad for her but she doesn’t say she has representation.

There are quite a few steps required to make sure you don't get taken advantage of when buying land and it seems like they skipped most of them in order to buy that house below market value.

    It does appear based on knowledge from AmPat-x2q that the city did indeed pay $490k in May by depositing into the court registry, thus granting the city possession of property. The money is available for the Race family and mortgage company to withdraw. There have been too many statements made here that the city has not paid thus generating outrage against city. The city followed the Tennessee eminent domain law by depositing the $490k.

    The realtor, appraiser and city needs to be sued ASAP. I wouldn't be surprised if they still make you pay land taxes on it. Maybe you can talk to your mortgage company and see if they will defer some payments. I hope you guys win enough money to buy three investment properties after this!!!
