  • HOW MUCH ARE CRUISE LINE SUPOSE TO WARN YOU ABOUT?
    Margaritaville at sea is being sued for something that happened last year at a hotel they booked for a passenger. One of the claims in the suit is the cruise line should have warned this passenger about an incident that happened 7 years earlier at the hotel and police never filed charges saying there was no evidence it ever happened. Just how much are cruise lines supose to warn us about?

    I believe it's the hotel's responsibility to take security measures to protect guests. Not the cruise line.

    During discovery, it may be determined that there are other unreported attacks. Her attorney is following the proper steps. The link may also be discovered, i.e. due diligence by cruise line in contracting with 3rd parties.

      Because when you want money, you cast a wide net and put everyone on a lawsuit and hope some of them give you money to shut up. Sad state of affairs. Need to have frivolous lawsuits have penalties for false claims.

    I think that it is at least the hotel’s responsibility because they are responsible for proper safety of their guests and for proper screening of their employees so that they will not pose a risk to their guests.

    The cruise ship should not be held responsible at all. If nothing had even been reported to the police and nothing was done 7 years ago - the hotel shouldn't be responsible either. This lady's attorney is stretching to get a connection.

    Although this Jane Doe is trying to blame the cruise line, which is ridiculous, let's show some sympathy for her being attacked too. The hotel should have some type of security measures at the very least

    Glad she’s ok. Society has made it so easy to sue but she’s is suing the wrong people. Hotels have to have security in place for these things. BUT..we have to do our part to stay safe. First, why were you alone??? As a woman, I don’t go places alone when I’m unfamiliar with my surroundings. If by chance I do, I will be on my phone…making sure someone knows where I am. Take responsibility and know who is at fault. Not the cruise line in this situation. Thanks Don.

    I believe the theory is if you are going to sue, sue everyone and anyone involved. Hoping that the cruise line and the hotel are big enough that they may just settle out of court rather than spend time and money to let it go through. Since it was a hotel employee, I can see suing them. But the others is just a cash grab. Also, the incident that happened in 2016 was never charged, so there are no court records. Legally speaking, it didn't exist. If the cruise line "warned" the customer about staying there due to the 2016 incident then the hotel would have a case to sue the cruise line for causing them to lose business due to an unsubstantiated case.

    Ok, let's assume her attorney told her to sue the cruise line for booking her into that hotel.
    Don you are giving ridiculous examples. Let's be real here. The cruise line didn't need to be aware of the 7 year old crime, but they did book her into that hotel. The attorney must have thought there was some blame to be applied to the cruise line. This is not Judge Judy. These are billion dollar corporations who are indeed supposed to protect their clients. The attorney would not have taken the case unless he/she/they expected some form of either settlement or winning verdict.
    Frankly it's not what you or I or anyone else thinks about her claim that is important. She was attacked by an employee of a hotel that a cruise line booked her into. Her life has been horribly and irrevocabley changed by this, and she deserves to at the least be financially compensated. Everyone on here commenting needs to think what if it was your wife, daughter, sister or self. You'd want millions. And you certainly wouldn't want ridiculous comparisons to the Titanic made. Shame on you Don.

    When something like this happens and they hire a lawyer and sue. The lawyer advises the client to cover all of their bases and sue all that is involved. The case may or may not stick somewhere.

    Did the lawyer taking the case warn her that lawyers loose cases or advise her about how many suits he/she as a lawyer has personally lost? You're right, where does it end?

    It is very likely that the woman's lawyer may have added on additional suits to what may have initially been just against the hotel. I saw this happen when my daughter was hit by a driver who ran a traffic light and hospitalized for a week. All she wanted was to have her medical bills paid by the driver's insurance company, but it took a lawyer to get them to pay what was a legitimate claim. Once the lawyer was involved there was pressure to add more to the suit. When you are traumatized and being told you need to do certain things by your lawyer, it can be difficult to disagree. My daughter did, but she had a good support network while doing so.

    If I book it myself it’s up to me to google my hotel but if I book through a cruise line it’s fare to assume they’ve done their do diligence to keep their guests safe. If I book an excursion a 80 people died during the excursion yes I definitely want to know.

    I would sue the Hotel, there should have been security on shift and surveillance. I wonder how many of theses incidences happen and go unreported. We feel bad for this lady, hopefully she will be alright.

    I booked a hotel that was suppose to be by the airport. Instead I went to another of their hotels. It was far out and sketchy looking. I locked the door and didn’t go out. I ordered Dominos for lunch and supper. I wasn’t going out. In the daylight I walked up to get my breakfast. Worst place. Sack lunch with a granola bar, a muffin and a small bottle of water. I’m almost positive I picked the one by the airport. I would never pick one in the boonies. I will always double check. Places can’t be blamed every time something happens.

    Every year, almost every, if not all, hotels have had incidents where police are called. They will never tell their guest about it. Nor will cruise ships unless it's blasted over the PA system or videos record by guests.

    Insurance and the Tax man use 7 years of data against you, is 7 years seems kind of standard. If there was no record of this alleged assault by hotel employees 7 years previously, how did this person find that information. If the hotel has a history of its employees attacking guests, then shouldn't the cruise line skip that hotel? How many assaults does the cruise line accept before it skips the hotel? Is 1 okay, or does it need to be 2? Are 9 assaults okay but 10 not? This seems to me like a challenge for the court and I suspect there is information we don't have anyway. Am I wrong?

    I contacted the CEO of Wyndam Hotels relative to a stay I had at the Wyndam Cruise Hotel in 2023 at Ft. Lauderdale and NEVER heard from him so I can imagine the scope or lack thereof of Wyndam's involvement and subsequent "resolution"....

    I don’t believe the cruise line needs to mention these specific incidences, but I do believe that the hotel should The information readily available on their website for the consumer to find for themselves. They don’t need to mention anything that details those situations, but they should mention what happened, and warn their guests that they are in a foreign country and they need to be safe.

    Well...this is the world we live in... Without details...it seems it's a money grab... Cruise Lines/ Hotels/ Etc. Should give us general safety precautions. If there is a very recent safety issue passengers should be notified. Example..like cruise lines do if a port has had issues...Thanks

    That things happen at hotels and on cruise lines and everywhere else in the world every day. As a traveler, it’s your responsibility to know what is going on in any particular area that you are planning to go. Everybody wants to push blame off on everyone else except themselves. This ignorant woman was not paying attention to her surroundings. Ultimately your safety is your responsibility. Yes, there is a reasonable expectation of safety by the hotel. It’s their employee that attacked you then yes the hotel is liable. But it is no one’s responsibility to tell you about incident that happened five or six years ago that’s ridiculous.

    I personally think that before you jump into a vacation, you need to research. Not just the fun stuff. But, crime. And you need to take into account all different media sources. Plus you need to carry protection. A baton, bear spray. A box cutter. They aren’t guns. But, they stop a lot of bs. So when you go on a remote trail or empty hallway. Be prepared.
