Hi Stu, my partner gets ESA & has been in the wrong group for over ten years. He recently got a letter from DWP saying they realise hes in the wrong group (moving from the Work related activity group to the support group) so his money is increasing. When he rang up today to enquire if he's eligible for backpay, he was told no, because he should have appealed the decision back in 2013 when he got the letter & had a month to do so. But he was seriously in pain from an operation that went wrong, also this whole time he thought he was in the right group (support group) bec no one has ever contacted him about finding work
In terms of ESA legislation, that is correct. However, whether he might have a case in law would be a different matter. It might be worth looking into legal advice, though there could be costs involved.

I'm on UC, work 14 hours a week and am £61 per week below the AET. I have Fit Notes to say I can only do those hours, yet the DWP aren't pleased... so I've gone down the WCA route, fingers crossed it works in my favor cos if I have to be sanctioned, then so be it.
See the end result you want each night before sleep. Don't hold strong emotions to it
Hello Stu, doing a great job. I have a question if someone is on the legacy benefits of ESA in the support group when they move over to UC will they need to be reassessed for lcwra and have an interview? Second question is if that person is on pip and a 10 yr award with the talk about the changes to pip would that affect them and have them reassessed or will they continue till the end of the 10years?
My neighbour is worried sick as she is on both esa and pip and I said I subscribe to your Chanel and would try to get some answers.
They will only need reassessment if they are due to have one. Check out my FAQ videos as I do one on transition from esa to uc which covers that. As for the PIP changes they are planned to effect everyone, but they are not guaranteed to happen and may yet take a long time to come to pass.

after six month waiting, I got today decision that I am apply to do some work even I sent them sicknote for three months and my doctor said I not apply to do any work because my health is very bad!
You should appeal the decision. Get support from a Welfare officer, maybe try the CAB
@@StuartMcGoo do you have much knowledge or experience of appealing? I have sciatica and slipped disk which effects me most days. But I am feeling like is it even worth the stress to appeal it. I had to wait 6 months , worrying and, guessing. It was so stressful waiting , I don’t know if I can cope with the stress of appealing for what might be the same decision.
