  • The plaintiff says she bought a Mercedes-Benz convertible from the defendant, but it turns out the top is broken. He refuses to take the car back, so she’s suing for the cost of the repair and emotional distress. The defendant says he informed the plaintiff one of the hydraulic cylinders leaked and she agreed she would fix it. He’s countersuing for monies owed.

      That's exactly what I was thinking. Take some accountability. Nobody wants to pay the $100 to have a mechanic look over the car BEFORE buying it, then they want to cry and complain when the used vehicle has costly problems. It's nobody's fault but the buyer sadly. Don't be cheap and have it checked!

      What pisses me off even more about that is when people are actually abused, it is not something they freely share to the world. Majority of the times the victim is ashamed and wonder what they did to cause the abuse (which is why victims don't always leave the abuser). I know that is not always the case but I have a hard time believing anybody actually abused would go on a show with millions of viewers and freely share that information.

      @David Swick people have and would go on a large audience platform if they've healed from the abuse, mentally, particularly if it's spreading awareness about DV. This is not a case of spreading such awareness, so it's weird she brought it up, but she may be mentally healed to freely talk about it. I won't discount her claims just because I don't agree with how she's using it to platform her position of sympathy in this situation.

    Usually a person sells a car because there probably something wrong with it ,and they’re not going tell you exactly what’s wrong with it that’s why you should always get a mechanic to look at it. as the judge says every time in cases like this.

      That is very true, but you also have consider if the original owner is even knowledgeable of vehicle malfunctions etc, aside from what can be seen on the outside, excluding cosmetic damages.

      depends on the car. some people get rid of it because they want something newer. I just sold a car that was old and nothing was wrong with it, it was in good condition therefore it could be used as a trade-in and took money off my next purchase.

    Girl, you should have made an appointment with a mechanic and taken that vehicle to be inspected from top to bottom BEFORE you paid 1 penny. Arrange for the seller to go with you to the mechanic...if the seller wants to. Have the seller drive the vehicle to the mechanic and you follow the seller in another car/taxi/etc. But DO NOT give sellers any money until you know what ALL the issues are from a written report from a reputable mechanic. *These sellers will omit the worse problems with their cars in order to make a quick sale and they are extremely happy when you don't request a full inspection first.* You should've also taken the vehicle through a car wash before paying this man. Car washes have a way of revealing windshield, window, door and roof leaks.
    There is much information on the internet for you to gain knowledge about buying new or used vehicles. You have nobody to blame for this but yourself. *DO BETTER.*

    You bought a 22 year old SLK, be happy it worked for 3 days. Electrical gremlins plagued the SLK in this generation. Shouldn't even consider this unless you know what you are doing mechanically or know a private mechanic. The average life of a Toyota is 18 years, really took a gamble on this one.

    If you buy an expensive car you have to be prepared to pay for the expensive parts AND labor for the said car. She's young and foolish but this case will teach her a valuable lesson in purchasing used cars down the road.
    My sister owns a Jaguar, her husband has a Land Rover, both expensive vehicles. And oil pan leak cost her $5,000.00, an electrical problem cost her husband $11,000.00. Be prepared to pay or buy a cheaper car. Imports cost much more than domestic vehicles made in America. Her older Mercedes really cost her a bundle but she got rid of it and bought the Jaguar. I'll stick with an American made truck thank you.

    Why haven't people understood and see Emotional Distress has actual, legal defining terms. Emotional Distress isn't just anything to sue for. And, agree, plaintiff used being a victim of domestic violence to prep her story up🙄🙄🙄🙄

      Buying from Craigslist is no different from buy off of Facebook Market place, the newspaper or any sales site.
      I have bought and sold many things through Craigslist and as with all things Caveat Emptor (let the buyer beware).

      My parents have brought two cars off Craigslist and both were fine. They also had both checked out by mechanics BEFORE they purchased the cars. The last one they bought was a 07 Ford Focus that my mom still drives. The other one was an 02 PT Cruiser that would have still been on the road had I not got rear-ended in it. It's totally fine to buy things off Craigslist as long as you're smart about it.

All of this could have been avoided if she had paid the $115 to get the diagnostic before she bought the car. Too bad!

      i bought a minivan off craigslist 15 years ago and i still use it as my everyday vehicle , i put over 200 k miles on it and it still runs good . where u find a car is not the issue , its the other factors . i specifically looked for a car being sold by the original owners who bought it new 10 years prior to me buying it and when u buy from the original owners then its always gonna be in better condition than a vehicle u get from a second or third owner or an auction .

    I bought my 2000 Honda civic 3 yrs ago from Craigslist. She had only 37000 original miles. Looked in beautiful condition. Original owner rarely used it since he lived right across the st from his workplace. It is still running strong!

    If you are buying a car and the seller mentions a LEAK anywhere in the car...DONT DO IT!!! Unless you are a very experienced mechanic dont do it. There is no leak thats an easy fix or easy whatever!

      Hmmm . . . years ago I was selling a car. I had just had the oil changed. Someone came to test drive it, and we both noticed a burning smell. When we got back to my house, there was an oil leak. I explained that it hadn't been there before, and that it must have something to do with the oil change. She didn't believe me and walked away (I don't blame her). I took it back to the place that had changed the oil, and they hadn't screwed on the filter properly. They tightened it, and the leak stopped. It was months before I found another buyer, and I got almost $2,000 less than what I'd been asking (the first woman had mentioned she thought the price was great, before she test drove the car). So, those mechanics neglecting to screw a filter on properly most likely cost me $2K. But my point is, an oil leak isn't necessarily ALWAYS a difficult fix.

    Whenever you buy a USED car don't just look at the exterior have your mechanic(someone you trust)look at the entire vehicle. Don't ever! buy a car with your heart and never trust the seller! 'AS IS' means what ever problems the car has is your problem.

    Can anyone tell me how a person can wear huge-ass fake eyelashes with the added weight (though meager, naturally) of crystals? That's quite an accomplishment, I think. I dunno... I can't even wear mascara without rubbing my eyes into raccoon eyes. 🤣 Some of y'all must have good control of not messing with your eyes. I guess you get used to it. I've never been one to wear make-up... maybe just eyeliner, mascara, and blush for very special occasions, which are few because I avoid social outings. I'm a stick in the mud - but I'm old... I've had enough fun in my six-plus decades. I'll just kick back, thank you. 😅 But I do admire peeps who can keep make-up applied w/o streaking their faces. 🙂🤩

      I don’t know how they do the fake lashes. I’d rather stick to my fiber lash mascara & not glue my eyes shut applying fake lashes.

      They often think being annoyed is what emotional damage is.
      Emotional damage/distress is more equivalent to someone going through something traumatic (for example a stabbing or a severe car crash) and has to get mental health treatment or hospitalized as a result.
