The decision to create a separate hot tub category is that kind of bottom-line decision that transparently has nothing to do with ethics. It's purely an action to save moderator resources and satisfy their customers (advertisers)

Right now twitch hosts mainly two distinct kinds of content, but is branded and designed for just one, with a ToS written to try and cover both but being insufficient for either. Bezos or whoever could break off a new website with specific branding and a specific ToS and include specific features. Trying to age gate half your content all under a single ToS and a single brand isn't feasible. It's why twitch has the problems it does.
