  • The State in the murder case of rapper Kiernan "AKA" Forbes and his friend Tebello "TIBZ" Motsoane maintains there is no proof to support the claim from accused four Mziwethemba Gwabeni that the money he received was for a business transaction. The defence has maintained that the alleged R800 000 payment paid to Gwabeni by Durban businessman Mfundo Gcaba was for legitimate business services rendered. The State insists the money was for the hit. Both the state and defence concluded closing arguments in the bail application.

      You are correct but it’s too late doing such at this stage…. it’s a waste of time bcz it’s an obvious case that they already discussed what each must say about the services these accused rendered to Gwabeni…They will definitely not vary.

    Hahaha…Give me this prosecution task in assist with the State prosecutor…Wil give the defence counsel sleepless nights in the points of questions towards defendant who received the money suspected to be the payment of the hit…Accused’s explanation in the defence outline is measured against his statement in the warned and cautioned statement together with the totality of evidence against him…Oh the money was for services rendered,no problem prove it…Just this statement “The money paid for the services RENDERED”….Rendered is past tense meaning everything was done and completed.It is the accused’s onus to prove his innocence and the veracity of his explanation…State’s obligation is just to prove its case with overwhelming evidence proof and facts…The inference has to be drawn from evidence,proof and facts surrounding the whole case…1)Evidence of the services that wer rendered and paid for(2)The attached invoices of that service 3)Book keeping records 4)The costs in reference from other companies which had same services 5)Contract name?the contractual agreements and obligations 6)day of signature and the payment plan…So many questions that wil unearth the sinister reality of this whole whole thing.

      I'm not a lawyer and i think i understand a bit from what you are saying. If i have a friend that needs money, cant i just send him 250k and no questions? is it the issue of services rendered that puts them in trouble?

      @@badass262 …You can send him the money no problem.The issue here is not about the sending of the R800k…What was the R800k for???The State is arguing the money was payment of the hit while the defence is saying it was for services rendered,the services which are non existent,no proof of the legit services at all…Those suspects in the dock are there for the murder of AKA and partner…Murrrder with actual intent “pre mediated”.The state prosecution in their investigations they found out that Qwabeni as coordinator received R800k from Sydney Ncaba the next day after the murder of these 2 victims..The State believes the money was the payment of the hit…This money also proved it was shared among the suspects…Now the defence for Qwabeni is saying it was a payment for SERVICES RENDERED,legit business.The State sort to stretch on the services rendered which they found out that nothing of the service was ever rendered,in fact the name of the service…No invoice,no type of service,no contract but just to say services rendered.What?Prove with defence evidence….Also on Bank Statement of Qwabeni it showed the transactions of before and after,there is no of the R800k which proved was removed deliberately meaning there is a story behind.

      @@badass262…Srry I had answered you in a lengthy one…The case here is about murrrder…In investigations to that,the investigators found that the money was the payment of the hit on the deceased…In their findings they found out that Aka got followed by Gwabeni,accused nmber 4 from airport to Hilton hotel wer he was booked..Gwabeni then left n leave 2 spotters which is accused nmber 5 and 1 to monitor the victim’s movements…Again when Aka left the hotel he was followed to Wish restaurant..accused 5 alighted from vw polo and entered the restaurant spotting their target and he was seen on the cctv..Time of shooting accused 5 remained sitting in the restaurant despite the pandemonium that was happening outside…Gwabeni the coordinator gave a call to Mfundo Gcaba later the next day after the shooting and within minutes R800k was transferred to Gwabeni which Gwabeni transferred R133k to each of his co- accused except Myeza who was paid when they hired his weapons used to carry out the crime….The case here isn’t about money transferred but murder that was committed..And for the state to prove its case they had to present the court with evidence that includes the payment of the money…Which is the payment for the hit.

    Pointless when Mfundo Sydney Gcaba is not an accused.
    Even the trial court will rule in favour of accused no 4 because the honours lies on the state to prove Accused No 4’s guilt

    Why is to difficult to arrest the one who made funds available. True he was making funds available for service rendered which was to get rid of the two. NPA and SAPS incompetence is shocking. They are scared

    No no the state is playing if they were smart they must go and fetch the 2 shooters, we keep on saying South Africa is rating number 1 in Africa is like United States of Africa . What is Eswatini? their population is smaller than Soweto population, when they got the Shooters they will tell who is the mastermind finish. The state is still embarrassed that Eswatini got the shooters 1st and their media and journalists break the news as it. Every high profile case even low profile, 2 shooters they arrest other 5 people and the state have the guts to tell us these are not the shooters so those guys what they are doing there no wonder why prison are full wasting texpayers money. Every year officials of SA go to ceremonies and weddings of the King Eswatini, now is difficult to fetch their own citizens in that country, IN AFRICA really the is no case here

      State takes longer but I can assur you there will be a turning point, everyone can the Gcaba guys are the murders. No accountant can prove the reason for that lump sum payment. A reputable business man will have invoice, and make a description of the services and be able to show what goods or services were rendered and who are other witnesses involved
