Mother sues Similac formula maker after premature baby's death

  • A Charlotte mother has filed a lawsuit against baby formula giant Abbott, claiming the company has misled parents into thinking its Similac baby formula is safe for use with premature babies.
    Brianna Anthony claims in her suit she gave birth to her daughter Reign in June 2021 at only 23 weeks. Anthony said Reign was relatively healthy for a baby born so prematurely but still required a feeding tube and breathing machine to help. Eventually, a doctor reportedly told Anthony they would be switching Reign over to Similac, but Anthony said she protested the idea because of her own research. However, she said the doctor went ahead and used Similac.
    The lawsuit states Reign eventually became sick and passed away in September 2021, just days after her body started retaining fluid and her organs shut down.
    Anthony's suit said Reign developed necrotizing enterocolitis or NEC. According to the Children's Hospital of Los Angeles, it's caused by bacteria invading the intestine wall, which can cause an infection and inflammation that destroys the wall.     Here’s the thing to those who wonder why she is suing Abbot, primarily because it was their formula and it can have the same effect on other babies and more than likely they discontinued the use after this findings. But they should have known. But I do agree that she should also sue the doctor because it is up to the parent what their baby consume and the doctor should have suggested something else instead of giving it to the baby anyway. She had a concern and she was ignored. It may not seem fair to some about her suing Abbot but this will be said in court for lack of better words because it was their product that killed her baby. It’s just the facts.

      This is the fault of the DR not informing the mother the enhanced risk of NEC in preterm babies when supplemented with formula instead of breast milk. Any preterm baby can develop NEC even on breast mill BUT formula may increase the risk and its advised to stick to Breast Milk the problem is that some preterm babies NEED special formulas with extra calories so no one really is to blame BUT the mother should have been properly informed if every risk. NEC is hard to prevent with preterm babies and I can’t imagine how broken the parents are but you can’t place a blame with absolutely anything could have compromised the health of a preterm baby even the slightest cold. Informed consent is my issue here I don’t understand how DRs don’t sit with patents and explain things like this.

However, there are many lawsuits against this company which is why it should be taken off the shelves and definitely shouldn’t be given to pre term and in my case micro preemie baby. The doctor didn’t have to inform me of the risk because I already knew and pleaded with them not to give her the milk. While the statement that any baby can get NEC is true, that formula increases it a great deal. Yes anything could have compromised my daughters health, however she passed away specifically because she got NEC.

      This is an old comment thread but it’s actually specifically cow based formula that can highly increase specifically premature babies to develop NEC because their guts aren’t developed enough to process the protein found in cows milk. The issue is the formula companies being aware of this and not disclosing it. It just like tobacco companies having to say their products can cause cancer, whether people choose to avoid it is their choice. My premature daughter who was a twin developed it as well in 2016 and almost died because she developed sepsis. I also only wanted to do only my breast milk for her but they really insisted fortifying my milk was best for her to get the extra calories, and ironically the older she got we found out through her pediatrician she and her twin had a milk protein intolerance. So it was very detrimental for her to have cow based formula, I had to go completely dairy free to breastfeed my girls. If I would have known it was a risk and linked to NEC I would have absolutely 100 percent and confidently denied it.

      ​@@CharletteGno ma'am the makers of the formula knew it was harming and killing babies!!! Let's speak on things we know are true here! My son had to have a colostomy bag and then reversal surgery to repair all the damage done to his intestines from NEC ...which came from the formula feeding

    They need to close Abbott factory in Sturgis Michigan. I live by it. And they are horrible. Management is totally out of control. Skeleton crews. Nasty. Can't keep help. And floods when rains come hard. I wouldn't buy anything from there. That's the way I feel about it. Hours they work people are terrible.

    My daughter was Preterm this year and Similac actually makes a formula for preemies. Not Sure which Similac she used but my daughter and a lot of other people I know who use Similac with there preemies had no issues with it

      Congratulations on your baby! It wasn’t a similiac that I specifically chose, it was one that the hospital just gave. I’m happy to hear that your daughter did well with it, however it does give a greater risk of NEC in a lot of preemie babies. My daughter unfortunately was one of those babies… every baby is different.

    Preemie babies can develop NEC with or without formula. It’s one of the complications of being born prematurely. My son was born at 26 weeks and it was a huge fear of mine. There are many benefits to putting babies on formula or adding formula to breastmilk. It’s to add Calories and nutrition. It’s very important. If the baby wasn’t getting these added benefits then she also could have died. A baby born at 23 weeks is very scary, unfortunately that child had a lot of odds stacked against her. I feel for the mother. But it’s not similacs fault. NEC can happen even if you do everything right.

    This is a horrible tragedy, but it’s not just a “similac” problem. Enfamil also has the same type of lawsuits. And people saying they should stop making similac, well it’s not that, it’s that formula companies in general don’t warn of the risks of NEC on there label, and cows milk isn’t good for preemies, especially micro preemies. And the Drs also at fault because the moms was pumping and providing the milk for them but they wanted a “higher calorie” so they gave the baby the formula after the mom said no. So not only are formula companies in the wrong for not labeling but the dr is too.

      the doctors are trying to tell me that it's pointless to give my triplets donor milk and the laction nurse tried to detour me from pumping and reestablishing my milk supply.. they are projectile vomiting and spitting up so badly.. I don't know what to do. They keep saying this formula is the best that it gets.

      @@pikkonnanu6366 you have every legal right to refuse that formula and pump. If you can look online about your rights, and the hospital your at should have a patient advocate worker and a social worker. Demand to talk to them and most have a legal department you can talk to as well. Hospitals can recommend and suggest treatment options but YOU are there LEGAL GUARDIAN which means you have the final say. Do NOT ask the nurses about these advocate departments, go to like a receptionist or someone who doesn’t know you and ask, you’ll have better luck getting to the right place that way.

    Every baby I know including my own who had been started on Similac couldn't keep that crap down for nothing. It's garbage. Enfamil or home grown.

      My triplets are on neosure and they projectile vomit, they added Prilosec and thickener.. basically telling me that's the best they can do. They switched once to Gerber good start and it was horrible puking. Keep saying donor milk is pointless because it's pasturized... I'm scared and don't know what to do.

    Yes , it’s didn’t suits my baby also he had blisters on his whole body after biopsy it diagnosed as “ prurigo nodularises “ the skin disease.. dr advices to stop the formula milk .. this action help him to recover from the disease

    Um….. this is an awful loss and all, but I am confused why she thinks the formula is to blame? Babies that incredibly prem die of NEC all the time.

      Update: I have been reading articles and reviews on bovine derived milk and the link with NEC, and I now understand.
      There are several studies describing it as at least possibly responsible for NEC, and even literature reviews concluding the same.
      Looks like it is a very complex decision to introduce any milk changes to extremely premature infants. It doesn’t sound like the mother’s valid concerns were listened to by the doctor involved. ☹️

    I would try to breastfeed/pump first then see if the hospital had any donated breastmilk. So sad 😔

      Hey, I pumped everyday for my daughter, it wasn’t the lack of break milk that was the issue, it was the fact that they wanted her to gain weight so they wanted her on the formula (added calories).

      @@saiqueen2399 my baby was born at 34 weeks 1 weeks ago and I been providing my breast milk to feed him and just today they told me that they will be adding the Similac 22 calories to my milk so that he can gain weight...I don't even know what to do. I noticed that after I fed him today at the NICU he got sleepy right away and like drained but not sure if it was the mix of that or that he ate to much he also threw up a little bit which it hasn't happen before.
      I don't want nothing to happen to my baby....sid they mixed it with your breasts milk??

    “Studies going back to the 90s states using cows milk based products in preterm infants raises the chance of them developing NEC” honestly its not the formula companies fault I blame the NICU drs and pediatric drs who aren’t being proactive in encouraging not only breastfeeding but cows milk product alternatives. This is a very unfortunate situation that sadly is happening more than it should !!!

      I have triplets and couldn't produce enough for all three no matter how hard I tried.. they told me that donor milk was pointless because it's pasturized and loses its benefits. My babies are projectile puking off Similac neosure.. all they've done is switch once to Gerber good start which was worse and now they give them Prilosec on top of neosure, they have feeding tubes and still projectile. I don't know what to do.. they keep saying that it's the best option.

      Hi, no my daughter had plenty of breast milk that I pumped. She was put on that specific similiac because they wanted her to gain more weight quicker, it wasn’t because of the shortage.

    Any premature baby can get NEC with or without formula. It’s a major cause for concern with premiees. She wants to put the blame on something and I get it, my son was born at 26 weeks and it was very scary. But again like I said, many doctors and any research you do will show that NEC can happen with premiees which is why they try to closely watch for it but it’s very serious and deadly. I’m sorry this mommy lost her baby.

      Any micro preemie/preemie does have the odds stacked against them. However, my daughter developed NEC from the formula. Speaking on her overall heath, which I was well aware she had a long way to go in the nicu. She didn’t pass away from being born prematurely, she passed away from NEC.     She cannot win the lawsuit. The decision to feed a formula is the mothers responsibility not the manufacturer’s. It is also the mothers responsibility to insure the chosen formula is appropriate for the baby. The death is tragic but the mother is responsible not Abbott.

      I breast feed my 4 and Ik it’s hard keeping supply up had a situation where my baby was gone for a week and 5 months later I’m still struggling keeping up I wish he could take formula but he just doesn’t like it. I can’t imagine what a premi mom has to do with her baby being in nicu for multiple week before supply is even established and then to have a baby pass because you are trying to feed them everything isn’t black and white

      @@phoenixjames9762 hi, this is my story. Thank you for your comment. I pumped every night and day for Reign. She had more than enough milk. It definitely was extremely tough, her fridge in the nicu got really full and I eventually had to start storing at home. It was more so they wanted her to gain weight quicker, that’s why they wanted her on the formula because it provides more calories than breast milk.
