That depends on whether the camera person's vantage point was directly on accessible public property (not hanging from a wall or say a drone POV), the camera person is saying the pictures were from her balcony looking over public spaces to the mayor and partner's balcony - now is that construed as in public or private but accessible or private with expectation of privacy - I suspect two pictures without a zoom lens used though not a streaming video is fair when no overt public need is served (evidence of the commission of an active crime say).

That is straight up flirting and generally, I don't sit on a balcony to have romantic lunches with my co-workers. Must be nice to go out with my boyfriend who the city is paying for to protect her - that doesn't look like 2 co-workers having a bite to eat at Subway or McDonalds. If he's so keen to protect her - why is her back to an entrance where she could be harmed by a member of the public. I mean she could have just quietly said to herself "Oh well - I got caught" and let it go. Filing a restraining order for ONE picture taken by a member of the public? Great way to bring attention and public scrutiny to your little romantic lunch you probably expensed to the tax--payers of your city. No legal leg to stand on for the mayor. She was outside, in public, like everyone else she has no expectation of privacy. As a public official she has even less. This is already settled case law multiple times at the supreme court level. Look at it logically that shot the woman took is probably on every CCTV camera that each business in the area has at the same time. Unless the courts start prohibiting private businesses from filming the public they cannot prohibit private citizens from doing the same.
