There was a 70's Australian band that released an album under the name Scandal even before the 80's US band and then it was 2006 that the Japanese group was formed. I won't pretend to understand any legalities, but the story goes that the Japanese girls selected the name as it was the largest sign in / near the building they started practising in. And at some point they made a polite inquiry to make sure they weren't offending the US band. No idea if the US band had any sort of ownership of the name by that stage, but respect and politeness goes a long way. Perhaps I'm ignorant as well, but I assume a record label would have raised any name issues when signing them. It would be a headache for them. ~ Tabitha

That group had 1 album released, the Japanese band has 11. There were other Scandal bands out there as well, it's a common name.
