      Indeed, that would be horrible.. but at least it would be quick. Can you not imagine the slow agony of being buried alive? The pain of Carbon Monoxide poison slowly creeping into your blood stream until you die? The muscle cramps as they contract .. But theyy can't even move to alleviate the cramps, and the poison causes them to vomit..they can't move, their mouths were covered and would be choking on their vomit through their mouths and nose .. And the panic of knowing that there's no help coming - this is it - no one even knows where they are..that in itself is enough to cause a coronary infarction... It's an agonisingly slow and horrible way to die..I certainly wouldn't choose it over burning quickly, although burning to death would be my greatest fear - at least it was until I heard how this couple were murdered, as I think this would be far worse than anything, at least from the perspective of human suffering and the horror of knowing what is happening to you.
      The perpetrators of this horror were too cowardly to commit murder.. So they let TWO elderly folk truly suffer to death very, very slowly - for their money. I think there's only one penalty to be applied here.. I don't even hear any remorse - just the cold-blooded, matter-of-fact testimony of a coward who had total disregard for the lives of the people that he murdered for their money.. They each deserve as much mercy as they gave their victims.... But that's just my opinion.. I'm not a judge - thank God.

      Really?? How do you not see what is going on? The judge is inappropriately acting as a second prosecutor. Going out of his way to Intimidate the defense witness and scare him into backing out of testifying, so that the defense will not be able to use this helpful, exculpatory evidence. And trying to intimidate the defense attorneys from rightfully Conferring with their own witness, which they have every right to do.

    The lady victim, the wife, had BARELY survived one attempt on her life when she was shot by her first husband , just to be killed by these aholes. The blood transfusion from ER after the shooting took place gave her hepatitis C which gave her cancer she was battling . The male victim was a severe diabetic and not so well himself. They were known to help anyone and everyone thus why they were fooled by these idiots when they said their car had broken down and they let them in to use the phone. The only solace to be found in this situation is knowing they died together, holding one another and are together now wherever that may be. Even if it's nowhere, they still went nowhere together.

    I have a big problem with people using their struggles in life as a defense for bad behavior. When I was a child, my father was extremely abusive to both my mother and I for many years. Finally, when she filed for divorce, it was good to get away but it also brought a new set of problems. He stalked, harrased and threatened me. On a supervised visitation, he brought an article in the paper of a mother and children who were shot to death on the courthouse steps by their dad. My father laughed and said that will be me. The judge issued what is still the largest restraining order in our states history (1 full mile). Not that it stopped him, I'm just explaining how dangerous it was. During all this, my mother repeatedly told me she should have aborted me. After, she told me she should have let my father have me then I'd be dead and out of her way. That said, I've never done anything past normal mistake or used my problems as an excuse for bad behavior. When people use their history as an excuse, it absolutely infuriates me! If having problems in life justifies bad behavior now, I'd have every excuse in the world to do whatever I want but I don't and never will!

      @TheresaofTheWorld I appreciate that, I really do. I understand emotanal pain is like physical pain and everyone has a different tolerance level. But, everyone has choices too. If you can't handle it you can get counseling through a pastor at no cost. There's alternatives out there for everyone

      @lindaarrington9397 how sweet you are! I appreciate that a lot! I can't say it wasn't tough but I relied on God and made it through. I know that sounds cliche but He absolutely did save my life (more than once). Also, I definitely learned what not to be. I adopted my son when he was 2 and used my experiences to become a better mom and person. It's also made me tough and allowed me to avoid the mistakes a lot of women make. Sometimes I catch myself taking that to an extreme but I do think it's helped me and the people around me as a whole.

    Attorney here, I state my occupation for no reason other than offer credibility to my opinion but I love this judge. It is of my professional opinion judges that are open and honest while staying calm and collective are the best to be in a courtroom with.
    I want to point out in the very beginning the way this judge was willing to admit he what he was saying was not factual and could possibly be incorrect; per staffing. This is a small detail but these are things I believe are very important and great indicators of an entirely bipartisan judge.

    I could sit here and give you a big sad story of the things that happened in my life. Things that would make your jaw drop. I haven’t gone and hurt anyone let alone kill them. A lot of people have gone through even worse and they don’t hurt anyone let alone kill them. I don’t let that affect my decision with something like this.

      Agreed. It's about who You are, not about what's been done to you. I wouldn't want anyone to feel like I have, in general, about myself or about people that have done me wrong (on any level). Lack of empathy is a sign of a deeper problem than having been victimized and survived.

    Tough shit! My Mother has never loved me and neither did my father. Not only did she not love me she abused me. She should have been charged, but sure as hell doesn't make it ok for ME to be another monster on the loose. This guy has no empathy for these people, and no interest in making himself better. He should NEVER get out and really should be burried alive like he did to those poor people, going out partying after. NO REMORSE, and has no place in society. He go the best outcome already being a useless eater in prison. I have NO sympathy for him.

      Isn’t this entire re-sentencing to decide if they get the death penalty, or if it’s life in prison?! The description doesn’t have any info, not the names of the victims or the people being sentenced, so it’s a little confusing

      @@MissAmanda616 Yes. Apparently they were sentenced to Death Row and the Supreme Court made a subsequent decision that a verdict for the death penalty has to be unanimous. Since theirs were not they were being re- sentenced. Repulsive.

    I hate it when they make excuses because of drugs and alcohol, these monsters don't deserve to live. I can't begin to imagine the fear and the suffering this elderly couple endured.

      I've had the chance to do things that where very wrong to get high but I stayed sick that day cus there is a line you don't cross. Lying stealing but physically hurting ppl to get ur fix is wrong. I've had offers to run up in ppls house to get dope but I said no I'll suffer an found other ways to get high but I'm 5 years sober now.

      @@ronniewilliz153 That's me, for 10 yrs I was an addict but would never stoop so low as to commit crimes or sell myself to get them. I had morals I was just in a bad situation because of dirty Dr's and kick backs for writing certain drugs. I just couldn't do anything like that, I despise a thief and I'm just not a cruel person. I'd except to run up on someone that wasn't going to take it and stop me and maybe end my miserable life at the time. I hoped I wouldn't be an addict forever, I had and still have a great life and a wonderful husband that stayed through it all. 3 yrs clean and it's no struggle. I'm back to pre drug me and I'm so grateful I'm out of that and wouldn't consider going back. People that do are just hopeless and have no control and apparently haven't been miserable enough in life to remember it and learn a lesson. The memory of the misery and just wanting my normal back is plenty for me.

    Crime would cut back alot if a murderer could be punished the same way as their victims. I saw the complete story of what they did to this couple and it was completely sad and inhumane. They didn't have to kill them because they basically told on themselves anyway!! Shame on the female involved, that couple was really good to her.

    I like this Judge. He is calm, knowledgeable and fair. He is trying to make sure that their will be no mistrial in this case. He is not intimidated by these attorneys.

      Are you referring to the same prosecutor the judge admonished for assuming guilt for the defendant not talking/ pleading the 5th initially. That's a right and the prosecutor should know that and the judge rightfully so notched him down a bit.

Even when it’s clear cut, the defendant, but mostly society , deserves a fair trial. It doesn’t matter what the facts are but only what the state can prove inside of the courtroom. If we stop requiring the state to make their case then all of us, guilty or not, are susceptible to false imprisonment

    There needs to be a law against offering a plea deal with crimes of this nature. How in this world could you get that cold? That takes a demon. Much respect for the judge in this case. I couldn't have listened to watch he had to endure. He handled this case well. Much respect for you,Sir.

      @@scottlaux6934 You are probably right, and that is so unfortunate. It's really heartbreaking for the victims family to be informed that someone this cruel gets to live. Also heartbreaking for the offenders family, it isn't their fault. I just believe that everything humanly possible should be done without offering a plea deal for this crime. JMO.

      there should be but then the whole court system would come to a stand still most cases are closed by the defendant taking a plea deal, following the advise of their lawyers. I'm not sure of the stats anymore but I read about it recently, most people take a plea in trade of a lower sentence. EDIT: even though they obviously do not deserve any deal and should get the maximum sentence.

They’re lazy and don’t wanna do the actual police work, so they act like they have something and get people to tell on themselves. This is sad and just disgusting.     We really NEED to whip this society into shape. I don't think we should tolerate ANY form of abuse, torture, molestation, neglect, etc. And certainly not murder. We need stiffer penalties and laws for ALL, regardless of race, gender, income, social rank, status, etc.

      Kim:The was not the actual defendant. That was a member of the court reading the previous testimony. You missed a lot.

    46:52 just like in school when teacher steps out of the classroom, takes less than 10 seconds for the kids to start cutting up and laughing. It's a courtroom people and a death penalty hearing because 2 people died! It's not a playground or meet and greet luncheon. Have some respect for the courtroom and the reason everyone is there.

    The worst part of giving any of these people a retrial is that they have had years now to build new relationships, years to plead their innocence or to shove blame onto the others, years to "get their story straight". Something they have not afforded to the two elderly people who could very well be alive today had they not (reminder) been buried alive by these scumbags.

      Because we’re a decent society and want to do everything we can to make sure we’re punishing the guilty. We’re not animals like the perpetrators of this crime. We have these laws to prevent innocent people from the death penalty, we give every possible opportunity to show why they shouldn’t be put to death. However, it’s too bad we can’t make exceptions for certain crimes and criminals. Obviously these people were irredeemable.

Three of those states, Pennsylvania, California, and Oregon, have a "moratorium" on executions. "Moratorium": a temporary prohibition of an activity. Can you guess which states, (politically speaking) give criminals more rights and the freedom to walk free?? I 100% agree that this guy deserves "No Mercy"....

    I think this man is Judge Michael Weatherby. I’ve seen him in other trials. He’s an amazing Judge & an all around wonderful human. I read that he retired, unfortunately. He’s irreplaceable, exactly the kind of man that every county needs as their Judge.

    I had fell asleep and woke up listening to some of this testimony then read the comments. I can't listen to the rest of this after reading what happened to this couple. This is really tragic. I never could have imagined this evil. I hope I don't have nightmares about this. This couple was so vulnerable. I pray that nothing like this ever happens again. I wish I could undo this. I mourn with the victims family. The people who knew and loved this couple probably think about this everyday. I'm praying that God gives you all strength to deal with the trauma.

    This guy, two other guys and a girl kidnapped and murdered an old couple for their money and were caught through using the dead couples credit card at a hotel. This guy turned on the other 3 and told the cops everything, that’s why he didn’t get the death penalty like the others. Apparently the old couple broke free of the ropes and instead of fighting they hugged each other before being buried, so damn sad

    I knew the first cousin of the murder victims.....this family was heart broken to lose this couple from their family......the first cousin was a missionary to Honduras and she was "on scene" whenever searches were made into various areas of woods in the North Jacksonville/south Georgia

    I was looking through this trial again this morning. Reggie’s sister read a wonderful and powerful message to the court about her brother and wife. I can’t imagine the pain she was feeling.
    The murderers should have pics in their cells to have to look at the victims all the time, or would it even bother them. God bless the Sumner families and everyone who suffered

    The guy on the stand reading testimony is not the actual guy. It's usually an associate attorney reading testimony from another trial or a deposition. No other reason for that guy to be reading testimony. Also, he said he's 20 years old and the man on the stand is much older than 20.

      It's not because of their worthy hood it's to protect you and any other innocent person who is facing charges wrongfully. As all these rules are not to protect a guilty person but to ensure a innocent one does not get wrongfully convictived. Public opinion or personal feelings for the defendant don't matter on what steps are taken to ensure the right person is convictived and to what extent. It might be frustrating but a guilty person having a way to appel or get around the law should be handled now not later.

    I strongly believe that anyone who murders should die the exact same way that they killed someone. If the victims were more than one then the murderer should be executed in the same manner as each of the victims were dealt with. In other words, (for example, if three people were killed, one by beheading, another by being shot, and the last by being beat to death. Then the convicted perpetrator must be beaten to death, then shot, then beheaded. In that order.

    You know what makes me shake my head is Alan Wade has gone on and gotten married while on death row. Has gone on and had a baby with his wife. Who knows how, but they have. Alan has gone on with his life behind bars. His wife has videos on CZcams. She wants him off death row, so they no longer have to visit behind glass. They belong where they have been all of these years, and bringing this back up is more salt in the wound for the victim's loved ones.

      Florida has the most media friendly court system in the country that why almost every live trial is from Florida. It's the only state that can ban cameras in court rooms.

    Our legal system is so complicated I feel like alot of evidence gets dismissed based on how it comes into the court that is legitimate in itself along with how a skilled lawyer can legally get a guilty person off the hook. However as terrible as that is nothing is worse then punishing a innocent person and that means some of the guilty will get away with their crimes in order to ensure the likely hood of the next case that is against a innocent person gets it right.

      Yes, as my dad used to say, 'you get as much justice as you can afford' with the legal system. It is a big club and not a Just and fair system. I beleive the outcome is often 'arranged' by the lawyers, barristers and judges beforehand. That is why we need trial by jury.

    I was raised in Huntsville Tx. Biggest part of my life I lived across the street from the prison. At 12 midnight is when they would execute prisoners. At that time they used the electric chair. You knew when it was midnight because the lights at the prison would dim 3 times. Now they use lethal injection much to easy in my opinion.

      No I don't feel "unsafe" watching this In fact it makes me feel very safe knowing that the judicial system is for ALL people I think its a good reflection of our system/society that even the most despicable people who are clearly guilty of the most heinous crimes have a fundamental right to a trial.       No. Just one with a sense of professionalism. If you were a lawyer, it would be YOUR fault when murderers get mistrials and innocent men get jailed because of tampered storylines and a tainted public opinion. That's why everyone deserves a fair trial. If the system isn't fair to everyone, it is not a fair system, and if you contribute to that, you are a source of corruption in the system. Simple. Reality can be harsh. Some victims don't have enough evidence. Its the 100 guilty men vs 1 innocent prisoner concept.
