Question regarding you statement starting at 2:15:
You mentioned cops may be able to conduct a protective sweet during a domestic if certain criteria are met when the victim comes to the door & the suspect is still inside. My understanding for protective sweeps based on Maryland v Buie, SCOTUS 1990 is the sweep must be used incident to arrest to an in home arrest. Since the suspect has yet to be arrested, how can we utilize this as justification for a sweep?
Unless this term is being used in replacement of an emergency aid/exigency type search of the home, I’m confused as to how we are meeting the criteria of Maryland v Buie in your DV example.
