In most cases, asylees may apply for naturalization aka citizenship 5 years after the date of their admission to lawful permanent residence status aka green card holder. In some cases, asylees can apply for citizenship after 1 year of military service and must be a green card holder at the time of the citizenship interview. There used to be a program called MANVI that allowed asylees who were in the military to apply directly for citizenship without becoming a green card holder, but that program is no longer available. Hi Rahul. Thanks for your question. Generally, to hire an H-1B worker who is subject to the cap, the sponsoring employer must submit an "electronic registration" between March 1st - March 18th. Each submission is given a random number and after the registration period closes, then USCIS conducts a random lottery and selects employers to move forward with filing an H-1B Petition. The petition must be submitted no earlier than April 1st and no later than 90 days thereafter. If the H-1B Petition is approved, the worker would begin employment on October 1st. However, if the prospective employee is not subject to the cap because s/he already has or had H-1B status under certain conditions, then the employer can submit an H-1B Transfer Petition and the employee may begin working once the H-1B Petition is received by USCIS, which is usually a few days after filing. Generally, not if you do that one-time, if you have a valid business purpose to return for another 5 months. For example, negotiating a commercial contract or need to observe business operations, attend a conference, etc.. If you try to do it more than once though, then you will likely run into an issue with CBP because they will likely interpret that your intent is not merely to be a visitor, but a permanent resident, which requires a green card. As a foreign national, you can own a US LLC. However, you cannot work for your US LLC from within the USA, unless you have "work authorization." A B1/B2 visa does not permit working in the USA. If you conducted "product promotion or marketing activities" or any other work/job for the US LLC or Indian company, then you would be in violation of your B1 or B2 status depending on how you entered. I would like to open a business in NC (a cafe/shop/yoga salon…multiple facets) with my wife, but have a us national manage it. I understand that this would not allow me or my wife to have a visa to live/work in the US, however i would like to know if it would be possible to apply at a later date (change the visa status) so we could eventually live/work and manage (oversee) the business as the owners? Generally, your South African company would be the parent company and the U.S. LLC would be a subsidiary. An "affiliate" for immigration purposes is (1) one of two subsidiaries that are both owned and controlled by the same parent or individual; or (2) one of two legal business entities that are owned and controlled by the same group of individuals where each own and control nearly the same percentage of each entity. Hi Rahul. Thanks for your question. Generally, to hire an H-1B worker who is subject to the cap, the sponsoring employer must submit an "electronic registration" between March 1st - March 18th. Each submission is given a random number and after the registration period closes, then USCIS conducts a random lottery and selects employers to move forward with filing an H-1B Petition. The petition must be submitted no earlier than April 1st and no later than 90 days thereafter. If the H-1B Petition is approved, the worker would begin employment on October 1st. However, if the prospective employee is not subject to the cap because s/he already has or had H-1B status under certain conditions, then the employer can submit an H-1B Transfer Petition and the employee may begin working once the H-1B Petition is received by USCIS, which is usually a few days after filing. Question - On B1 visa once, what if I visit the USA for 5 months go back to home country for a month and come back and stay 5 months, will there be any issue with that?
Generally, not if you do that one-time, if you have a valid business purpose to return for another 5 months. For example, negotiating a commercial contract or need to observe business operations, attend a conference, etc.. If you try to do it more than once though, then you will likely run into an issue with CBP because they will likely interpret that your intent is not merely to be a visitor, but a permanent resident, which requires a green card. For an O-1 visa, it depends on numerous factors. There are no set number of publications under the law, but it's rather how much weight and credibility does the publication carry. As a foreign national, you can own a US LLC. However, you cannot work for your US LLC from within the USA, unless you have "work authorization." A B1/B2 visa does not permit working in the USA. If you conducted "product promotion or marketing activities" or any other work/job for the US LLC or Indian company, then you would be in violation of your B1 or B2 status depending on how you entered.
