      Sai spoke as a legal expert with proper proof from constitution for citizen act with all clarity with details. You dont seem to follow him because you are not able to understand.
      Let us agree that Sai is biased and speaking for the current central government
      You tell us given a chance to implement CAA and NRC, how will you go ahead and implement?
      Just saying that , we already have many crores of illegals are already spread and feeding the elections votes of the congress and communist governments. Mind you al these CAB and NRC are mandated by Supreme court and also note that these are pending to be implemented since 1955.
      You better listen to all Sais videos in you tube. You will be highly enlightened on these immigration, citizen act and the blunders of the previous central and state governments to not to implement them inspite of supreme court orders

      Yes. He is biased towards truth and does not mince his words unlike pseudo pretending nationalists like us who want to politically correct. The days of being polite and politically correct are over in India as of now and also world over. As we speak here, the world over is slowly away to Islamists, especially in Western Europe, Canada due to the political correctness of leftist politics and liberal society. Unless indian state takes a solid internal security measures like Israil and US, the days of one or more Indian partions are not too far away. May be in another 10 to 15 years.
      So, let us keep debating about who is left or right or center and thereby giving way for one more partition.

      Why it is against article 14....
      Firstly the the classification should be intelligible... This classification is not intelligible
      1) why only from 3 countries... There is no intelligible reasoning
      2) why only MUSLIMS are excluded.... Because sufferings of MUSLIM immigrants is not lesser than that of HINDU immigrants here...
      3)WHY only religious persecution? Is religious persecution any different from other persecution?
      4) why Rohingyas from BURMA, or UYIGHUR from CHINA are not included....
      There is no way to say one persecution is lesser from the other...
      NOW DON'T get PRE INDEPENDENCE ,Pak and ban are from INDIA...
      Presently, post INDEPENDENCE post Cutof dates of first CITIZENSHIP bill,
      These countries are no different from other countries for us
      Secondly AHMEDIS and SHIAS get persecuted, why they are not included, their sufferings won't be different from others
      Even though PAK and Ban is no different from other countries, and still you cannot justify the inclusion of AFG...
      So this BILL highly unintelligibly classified which goes against the article 14
      Now coming to the OBJECT of the classification should have rational relationship with the classification...
      Now what is the object of act, certain people will get citizenship,...BUT what about MUSLIMS who dont get citizenship, if they could deport and CITIZENSHIP in any other countries, object would have been rational ... But that's not the case
      One particular community will suffer in detention centre and others will get citizenship....
      So object of act doesn't have rational relationship with the classification.....

      In pak 1947 - more than 20% , now about 1%
      In bang 1971 - about 20% , now 9 %
      3) He stated we are not a federation in true sense . This is true as well , not an opinion. ( B.R. Ambedkar in constitution assembly stated - We are not a federation in a sense as States of India have not entered an agreement to form a federation. They have been created for administration effectiveness. India is largely Unitary)
      All above points mentioned are FACTS not opinion ...
      Get a book and study instead of giving advices to others !

    Sai Deepak is asking why this much of pbm while including (CAA)which is not there while excluding (NRC). 1-NRC conducted in one state and CAA will be for every state.
    2- Why gov conducted NRC and after several pbm in that it's coming with CAA. If you plan
    Correct you could have come up with CAA directly.
    3) The biggest pbm with this govt is not
    Consulting with all stakeholders before legislation and after that it will blink without knowing what to do for implementation.
    This is happening from demonetisation to CAA. With your knowledge you can defend easily today but need a responsible answer from you as we are following you. 🙏

      There are two things you got to understand - 1. NRC is being done on the order of SC. There is this confusion everywhere. This process started in 2013.
      2. First we identify the problem then remedy. SC directed to prepare NRC for Assam. As far as problems are concerned wrt to NRC, it is only because of the fact that we are liberal civilization. Had this been the case in China, they would have thrown everyone out of the country in one go. We are giving every chance to prove citizenship hence the delay and problems.

    Sai Deepak sir legal views are always clear as water, but in this episode he lack the practical aspect of the matter. "He even said why should somebody has a problem for inclusion of other beneficiaries on the ground that some section has been excluded?" Well, that's because it is "DISCRIMINATION", the type of discrimination that is not allowed under the Constitution of India, at least in this case. Nowhere in the Constitution does it mentioned that citizenship can be granted based on religion (Art 5 -11).
    Also, the panelist had not considered the concerned of the NE states, especially Assam and Tripura. Their problem is not because of the exclusion of certain section, instead they just don't want any immigrants, irrespective of religion, in their already crowded and resource scares land where there are only limited opportunities available. The indigenous population and their identity are also being threatened in the process. Take the case of Tripura, the indigenous people there is already a minority in their own land. Fact: most immigrants that will be covered under this law will be from Bangladesh, therefore the fear that the NE people have are legitimate.
    If we really do have sympathy and concerned for people facing religious prosecution from our neighboring countries, why only these three countries? What about Rohingyas from Myanmar? Are they not our neighbor? Are they not facing the worse religious prosecution!!
    While it is not a bad law per se, the intention and motives, the political angle, the discrimination and lack of consultation and consensus is the problem.
    Our Federalism may be unitary based, but don't forget the spirit of "co-operative federalism".

    Lets see what CAA says:
    "Provided that any person belonging to Hindu, Sikh, Buddhist, Jain, Parsi or
    Christian community from Afghanistan, Bangladesh or Pakistan, who entered into
    India on or before the 31st day of December, 2014 ...... shall not be treated as
    illegal migrant for the purposes of this Act (Citizenship Act 1955)"
    By Implication communities other than above 6, that is, Muslims, Jews etc (who entered into India on or before the 31st day of December, 2014) will become Illegal Migrant
    Now, to be a citizen of India by Registration or Naturalisation (according to Citizenship Act 1955) one has to be a Legal Migrant
    Therefore, Muslims, Jews etc will not be eligible for Indian citizenship & will become liable to the proceedings of Illegal Migrants
    Now, if NRC comes in future, communities other than above 6, that is, Muslims, Jews etc (who entered into India on or before the 31st day of December, 2014) will be excluded from NRC because they now become Illegal Migrants by the virtue of CAA 2019
    Lets see what Article 14 says:
    "The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India"
    Now, because Article 14 talks about ANY PERSON (not only citizens), it becomes patently clear that the Indian State is blatantly discriminating against communities other than above 6, that is, Muslims, Jews etc (who entered into India on or before the 31st day of December, 2014)
    It is right that CAA is not for existing citizens of India but there are many who will not be able to prove their citizenship (though the are living in India from decades) as we can see from the Assam experience, in which 19 lakhs out of 3.29 crore were excluded from NRC.
    The main point here is that, it is not about giving citizenship (which is indeed a sovereign right of a nation) to those who deserves, it is about the process through which it's being done. Citizenship to deserving can be granted through other means, it doesn't necessarily requires to violate the BASIC STRUCTURE of the CONSTITUTION
    And what we are going to get from all this, if at all it will implemented?
    Large number of excluded population, who ultimately going to live in detention centres leaving their home in which the are living since decades. Which in turn, could lead to a more divided India, which could lead to more instability in the country
    Huge burden on the countries exchequer is another elephant in the room, given the precarious economic situation of the country
    Stability is the sine qua none for a country to become "World Leader". As India is aspiring to become one, it must avoid all things that will leads to instability in the country
    Instead of waisting its time & resources on things which could be done in a different way, India must focus more on ways to utilise its demographic dividend if it wants to prosper & to reach $5 trillion economy by 2024-25.
    PS: One must refrain oneself from hero worship & question everything

      First , the inclusion of the above mentioned 6 communities are a continuation of 1950 Nehru- Liaquat Pact .
      Second , though Article 14 has just two lines in it's defination , it has many different applicable meanings like reservation for depressed classes is not violation of Article 14.
      Third , I AGREE THAT although
      NRC or CAA may be good or bad , The point is We Don't Need Them . We are at a stage of development where we should be focused on development alone .

      Two Points
      1. The NRC in Assam was faulty and most of the ministers have said that there would be more checks and balances and more documents considerations in the NRC that would be done now unlike Assam which was done under SC guidance and was delayed many times.
      2. Illegal migrants should be weeded away because they are taking away the jobs of especially the labour class (many of them are harming job prospects of poor Indian Muslims) and are a security threat as well. Illegal migrants for eg took away many labour class jobs in states like Gujarat by offering to work at a lower wage and I have seen that and verified it myself a long time back. Plus vulnerable Muslim migrants like Rohingyas have been recruited in terrorist sleeper cells according to various NIA reports.
      So NRC and CAA are must needed.
      What can be done here ? If we say everyone who entered India has to be sent back then :
      Data shows in Bangladesh and Pak Non- Muslims are converted, killed or tortured. Just see the dwindling percentages of non Muslims in both of these countries. Afghanistan is under Taliban.
      So we cant send them to die in these countries.
      Where as Muslims who are illegal migrants can be sent back and being Islamic nations they wont be persecuted there.
      So I think Both CAA and NRC are apt for handling the issue. But having said that NRC should be fool proof and no Indian Muslim should suffer because of it.

    Good debate.
    Some points to be mentioned-
    Though parliament is sovereign in making laws on centers subject, Majority in the parliament doesnt mean 'Majoritarian Polity'.Govt is elected by mere 25-30 crores of indians,not by 130 crores of indians.Its moral responsibilty of the govt to take everyone in confidence.
    Shaheed Bhagat singh has said that the sanctity of the law can be maintained only if it the popular will of the people.

    All I understand is, CAA and NRIC are like giving solution first and then creating a problem. Why create fear, panic in the country. As if everything else is fine, these were the only last issue needed. We were better before all these started.

      Long story short, this is ONE OF THE FIRST relaxations offered in Citizenship. Hence citizenship AMENDMENT act.
      As for the reasons of only these three countries, roughly speaking, India can claim responsibility for Pak and Ban because of Nehru Liyaqat Pact. As for Afg, the term 'transmigration' is used which refers to migration of population between Col. India and NWFP.

      Even small errors in documents can declare stateless.

    the bill was passed via constitutional means.
    I agree the LOk Sabha had majority and it was smooth sailed , BUT in Rajya Sabha( House of elders) there wasnt any majority. The MP had the right when the bill was tabled to counter the arguement and to overturn the Lok Sabha verdict.
    instead some chose to walkout and some flipped over.
    The opposition is in shambles.
    People have problem, there is a process, file the damn PIL in SC.
    And wait for the verdict, no satisfied, file review plea ask for a bigger bench.
    Destruction of public property isnt a way forward,
    The exclusion is based on the recommendation by IB,NIA,
    A country has a right to protect its stratgic interest.
    It can't be run on emotional rhetoric and human rights hullabaloo.😒

    These advocates are very cunning people. Let sai deepak sit opposite to a lawyer or an advocate. It is unfair to bring advocate and a normal politician. Let sai deepak sit opposite to a huge stature lawyer then we will come to know is his "actual" level.
