  • The plaintiff gave the defendant a security deposit on an apartment he was renting. Before moving, the plaintiff learned the place broke multiple code violations, so the plaintiff is suing for his deposit back. The defendant argues she's been renting out the apartment since the 1980s and hasn't had any issues with previous tenants.

    Here’s a young man who is respectful to Judge MM & never cuts off the shady defendant. He doesn’t act hard, entitled and as if he knows everything. He’s listening and learning.
    He brings his mom and represents himself well. He obviously trust & respects her to give him guidance and THAT’s the kind of relationship you want with your parent(s). Not the kind where you represent yourself & your family in a bad light.
    We’ve seen time and time again where the “man” shows up (with parents) and obviously show no accountability or respect for the law and the parents make excuses for the kids behavior as if it’s ok….
    We should give him the credit he deserves. He proved his facts and is trying to do right and not getting taken advantage of. His mom was making sure he was protected because of her life experience and she lead by example making sure the shady defendant took care of the violations. Most 20 something year olds aren’t going to microcheck these things. They’re so excited about getting their own place, the overlook these details. Thank god for his mom to call the city because had he moved in and then try to hold this woman responsible, Judge MM would have done the “why didn’t you check the apartment thoroughly BEFORE you moved in, etc…” and this would have been like the many other cases we’ve all seen on People’s Court.

      Let's take it one step further.The defendant KNEW that she did not have the Necessary Certificate of Occupancy, to rent, which therefore without it She could not rent. she also knew that if SHE went up they would more than likely be demanding their money back.

    If i could I'd love to live with my parents even if i was older than 26 yrs old . My mother died when i was 11 and i haven't lived at home since i was 14 . He's blessed he has a momma like that.

    The plaintiff is lucky the tenancy didn't work out - if the downstairs neighbours are so nosy they have to immediately tell the landlord he had visitors (including the baby), it would have been an absolute nightmare to endure for the term of the lease. Total busybodies.

    I was 29 when I got my first apartment in NYC and I took my parents to each viewing and my dad to the lease signing. They’ve been there done that, I haven’t. I will seek my parents advice in most major life decisions that I make. Whoever sees an issue with that probably doesn’t have a good relationship with their parents so they can’t comprehend 🤷🏽‍♀️.

    If the plaintiff is telling the truth the defendant breached the contract. He said she told him that it wasn’t a good fit for him. So, even if she didn’t have a CO he should have gotten his deposit back.

    I really don't understand the Judge's logic here. He absolutely should have been paid in FULL for the paint job. The fact that there was never an agreement for him to get paid for the work he did is completely irrelevant under these circumstances. He wasn't hired as a worker and he most definitely wasn't doing it just as a favor for that lady. He painted the apartment because he planned on living there a while and he never got the benefit of the work he did. And she certainly shouldn't get the benefit of a free paint job, especially when she legally couldn't even rent out the apartment in the first place. Besides, $200 to paint an apartment is a bargain. So she still would have made out in the deal by paying him because from the sounds of it, she needed to get the place repainted anyways. It seems like Judge Milian was trying to punish him by making him eat half of the cost just because she didn't like the way he went about getting the apartment before trying to negotiate the on damages.
    I'm sorry but she shouldn't be letting her personal feelings about something affect how she rules on a case and especially not to use it as an excuse to punish someone financially. That's just wrong. It's legally unethical and literally goes against her judicial duty.

    I don’t like how the judge is acting towards the plaintiff as if because he’s 26 and this is his first apartment,it’s a problem or giving the vibe of he should’ve been out the house..NO,your kids should be allowed to stay home until they’re completely self sufficient so they won’t have to come back (unless they need to),be able to take care of themselves properly and won’t have to struggle..A lot of cultures do this some even keep their kids home until they’re married (in their 40z or 50z) so why is it frowned upon by her that we also do this,in the black community as well🙄

    People in their early 20's are just starting to figure out how to "adult," and how things work, and how to protect themselves. For that young adult's age and experience, I don't see anything wrong with him having his mother help him. She was also a witness to a lot of things that happened. We should all be so lucky to have a parent help us while we are figuring out how the world works, and how to "adult" successfully.

    I agree with him when he said when a landlord doesn’t look at the place with you, that’s a red flag. The landlord in my new place didn’t come inside the apt I just put a deposit down on. Turns out, the apt wasn’t cleaned, painted and it needed a new dishwasher, oven and fridge 🙃
