Builder stands by decision to cancel home contracts

  • Central Texas homebuyers are warning others after their dream home contracts were abruptly canceled. KXAN investigated and found home builders can have a termination clause in their contracts that allows them to cancel for any reason. Still, the home buyers have filed a formal complaint with the Texas Attorney General's office.

    If they cancel the contract because you want an inspection, that tells you how shady the company is. They are only going to screw over the next buyer. You dodged a bullet

    I wouldn't buy a new home. These cookie cutter houses are put together so quickly and are not of the highest quality. Good luck.

    They don't care these are fly by companies looking for a profit. They close up shop and open up again later under a different name. You can tell if is a scummy company by the business registration papers with the states. Look at the dates that should clue you in.

    It's crazy how frequent this is happening around the country with builders canceling contracts. The reason varies slightly but the outcome is always the same.
    Also that one lady is crazy to go back to another builder. I would've just bought some land and higher my own contractor and architect if that's the case.

    This is disgusting all around. The Texas administration for homes and companies building should also do their jobs as to helping the buyer. It looks as although all persons who can make money will send you the buyer in circles. 😢😢

    I've been a builder since 1988...I'm retired now because of the direction home building has taken...No tradesmen, scumbag banks, overbearing townships, self important clients, litigious POS lawyers, etc etc etc....If you're buying a newly built house or contracting to do so; you're being willfully ignorant...Find a nice home that's been built for a while in an established area; preferably on the east coast.

My son attended Cal and Bill Reipken's Basball Camp in Aberdeen, MD starting in 2007 and that year we happened to fly into Philly as it was much cheaper than BWI. OF COURSE I wanted to try the cheese steaks I had seen all over Food Network and Travel Channel (episode of Pat's vs. Geno's). Neither place disappointed as the "experience" was awesome. We live in Austin TX so just the neighborhood around there was very foreign to us...older big city with narrow streets and 3 story "houses?" My son asked if this was the "ghetto" and I said...I'll bet NO. He was 7 and had his nose stck to the window where dude was chooping the meat and of course he flipped a pile of meat up against the window and my son jumped back. LOL. and then at Geno's Mr. Geno himself gave him a "Geno's" pen that he kept for years. I liked Pat's better because more meat "copped" as opposed to just slices but found out there were better places in town...And the next place we tried was the Jim's downtown and I thought it was the best of all. What are your favorites?

    It’s the contracts, read them carefully and negotiate the terms so that both parties agree . Customers do not read and understand the clauses, they are one sided towards the contractor. They make very good project profit.

      @@wanaraz contracts should be fair to both parties, so that terminating a contract should be based on legitimate issues, not easily canceling for profit. Why should you need lawyers if contracts are fair and ethically business related.

      Oh one other point FAIR and Ethically is subjective. I don't think the real estate contract was wrong at all. I would not have signed it but it was out in the open.

      @@wanaraz you do not need a lawyer every time you have a contract to sign, in the US probably yes definitely because contracts here are minefields for the average person, in many countries where I have lived (construction industry) the use of lawyers is minimal and normally for clause advice, in the US you need a lawyer for the most trivial of issues, it’s the claim conscious society that drives this, for example, ask your average medical practitioner, extra over add ons to there costs to protect themselves against possible litigation. In conclusion a contract whereby a contractor can just terminate and walk away from it then sell the house for extra profit and leave the other party high and dry is not a fair contract.

    These new homes are built quickly and with substandard materials. Those homes are money pits and have structural/foundational issues. It’s a blessing in disguise because those homes will sliding and sinking soon. The builder is speaking with a forked tongue. Always have an attorney read the contract before signing.

      I owned a KB home from 1996 to 2020. It was a great home. The original roof with no leaks. No electrical problems and insulation was great. With stood a good earthquake and it was the original electric garage door. Not sure what you are complaining about because the new owner loves it!!!

      You can't build a home in the United States ANYWHERE, LEGALLY, with substandard materials...A home requires stamped plans from a licensed architect. Sub assemblies ( wall elevations and structural assemblies detailed showing materials, etc.) So, You're speaking from feelings and not from knowledge...Home builder and Remodeler in the fifth largest U.S market - East coast... Now, substandard labor and finish work, and bare minimum price points for fixtures etc...That, I'll stipulate.

    What people fail to see is that the company takes the money from the first buyer and pays for the home to be built. Getting paid to build a home and reselling it before close of contract. The first buyers should profit from the difference, not the company. However, when people sign such contracts, then that is what it is. Don't sign such a bad contract.

      No, the buyers did not pay anything but a deposit, which is a small fraction of the total cost of the home. The builder assumes the vast majority of the risk until the closing is done. Even after that, the builder usually has to maintain a warranty on the major components of the house for up to 10 years. Again, assuming most of the risk

      Your statement is BS because ZERO buyers put up 100% of the sale price to get the builder to start the project. Typically its closer to 5% and the mortgage company underwrites and funds construction costs along the way. So the house is in essence being funded up front by the mortgage company against the contractor's line of credit. Buyer doesn't pay another dime until closing unless they make changes along the way that cost over and above agreed to sale price.

    The bs about breaking the contract and reason "...NOT being for more profit..." God, that is the most irritating thing they can respond with. Like a second smack on the face of the consumer/home buyer. There should be a law out there, if a builder cancel the contract, they should be held to original pricing for the next buyer. But they always sell for almost double...if not double the price. That right there shows it is for more profit. And for a question in the case of one of them after not passing an inspection. Consumers should have a law to protect them, that construction should cease until issues that are not passed by inspection get fixed, and that would make a contract fix to NOT be canceled under those nor any circumstances. Good to know about this builder. For sure I will NEVER buy a home from this builder, and I will share the story everywhere I can, it will go to hundreds of people. I love CZcams in cases like this... communicate the laws that are out there to protect the rich.

    I worked in an unrelated industry (collision repair) but I dealt with several people in my years in the industry that I would have liked to have terminated my agreement with them. I found out too late that I could have. Some people just cannot EVER be satisfied.

    They realize they could get more for the property so they said sayonara . These type of contracts shouldn't even be allowed in America. Who has the advantage criminal builder or home owners who lack the experience to deal with these criminals that prey on the vulnerable. Both can terminate the contract but so far 100% of all termination waws done but the builder and zero by the clients. Don't accept contracts where the builder can cancel for any reason. That is crazy contract. Go over the contract with a fine tooth comb or pay a lawyer if you have to. It will be well worth the headaches later on. Always deal with a realtor not by yourself with these clowns. Better to just buy a home already built so no contracts at all. Also read the reviews of the companies you plan on deal with it. If you see them doing shady things like this in the past to others what makes you think you suffer the same fate? Run from companies that have problems in the past. Sometimes they change their names and have little to no reviews. I would avoid those companies as this is most likely your biggest investment in your life. They are using the money from clients as cash flow so they can pay their employees and once sold the property they take the profits. So in essence they are using these clients aka "suckers" as a free no interest loan.

    Very common the last few years.
    Builder uses potential buyers money to build the home then backs out for any reason. Re sell home for hundreds more. Og buyer gets most of the money back

    Home building is a business and if the business can increase their profits greatly because the market calls for it, why wouldn't you back out of the contract and sell it for more? The contract also allows the customer to back out if they find something better or cheaper. These customers only have earnest money at stake . If the builder cancels the contract, buyer gets the earnest money back. If the buyer cancels the contract, builder keeps the earnest money.
    If you are buying a house from a builder, you would be well advised to hire a real estate attorney and have them go over the contract with you.

    So the company sets a price to build a house for say $200,000 and then gets rid of the first buyer of the home once built. Then turns around and sells the home for almost $500,000. If that is not canceling a contract for nothing more than greed, I have a bridge in Brooklyn I can sell you.
    Greed is the only thing these companies understand. make billions on canceled contracts on the backs of the first home buyers.
    helpfull hint to anyone either buying a home or even building one. Read the ENTIRE contract. Front, back, forwards backwards, and upside down. Because if you sign it without reading it, you are stuck with the contract the companies love you to get. You get the shaft and they get more money on your dream home you will never be able to live in it.

    "We don't terminate contracts for financial gain".... hahahaha... everyone applaud ... punch line has been delivered. Ya we are a company trying to make a profit for ourselves and any investors... but we aren't looking for an easy way to increase that profit like canceling a contract on a home we started building that was worth this much when we started and had a buyer (security), but will be worth more by the time we finish building it... besides we aren't in it for a profit, its about building homes for people, right? .... Well there ya go folks, I mean, why would it be for an increase in profit if they said it wasn't?..... The whole country is going to drown in greed if the government does not step in and regulate the housing market to some extent.

    I'm a builder. There are some horrible people that we have built for. There are 2 sides to every story. Some people deserve to have their contracts cancelled. There are a few I can think of that gave signs and I should have cancelled before we even started.

      It's not like their will be a couple of alterations, they will be never-ending on an hourly or daily basis. Which is NOT a problem. The problem comes when you have to charge these harpees for overruns. Then your reputation and professional credibility is at stake.
      No service should take a loss because the customer couldn't make up her mind.
      It's just the sign of the times right now.

      This is also about how I feel. I've worked in this industry and when Karen's get shut down it's never their fault and they always say they were being fair and reasonable and downplay their part. I hope these women didn't experience something bad with Brohn, but I also strongly support business owners right to close a contract with a micro managing client. If they can then turn it around into a better deal for another family, nothing wrong there.
      Hopefully the AG investigation will sort it out.

    To address the comment section about the seller canceling the contract simply to take advantage of an escalating real estate market. Apparently, according to this news story, either side has the right to end the contract. Which means the buyer has the right to terminate if the market was in decline.

      The market is irrelevant when paying to build a home. Cost of material and labor vary but it's always less then retail value.

      Very few available. Most builders in subdivisions have a very limited supply of spec homes. They do just enough to keep their crews busy. And those sell quickly.

    It’s why y’all need to use a realtor, read thru the contract, understand it, and don’t try to cut corners buying direct from a builder. You signed the contract so deal with it.

      @@jaysantos536 however a realtor will point out where the risks are and the client can chose to negotiate or walk at that point. My point is that people cut corners then cry when they get screwed. Anyone that unknowingly signs a builders contract is just asking to get screwed. The people in this video acted like victims and surprised which tells me no one advised them on the contract.

      @@eaglethree1 I would be willing to wager that VERY FEW Realtors go through any of the "builder cancellation" provisions and/or warn their clients about them BECAUSE said Realtor doesnt get paid a dime until the deal closes. I know of at least a few Realtors that SPECIFICALLY do not include "builder contract" discussion in their "services" and refer the client to an attorney if "they care about the contract". Realtors typically only advise the clients on whether to pay for "lot premiums" and design center upgrades from what Ive seen.

      @@jaysantos536 I won’t argue that, but a good realtor will and should and the ones I deal with do. That’s part of the problem. Too easy to become a realtor and people hire their cousins friends brother instead of researching and finding a quality pro.

      @@eaglethree1 I agree and have always had somewhat of a "bias" against a lot of them because I was a Senior Appraiser at Bank of America in Fort Worth and Austin for 25 years and appraised about 10,000 houses during that time. I always despised the Realtors that would "demand" to be at a listing of theirs under contract during the inspection for the appraisal so they could provide me with "The best comps." How shocking that their "best comps" ALWAYS were the highest priced 5 or 6 sales in the neighborhood that were similar at all to the subject property.

    Cost are going up monthly. There is a reason why these builders are canceling. They can not lose money on these builds. The buyer does have the right to buy at the new price.

      You buy at a fair price the building materials should already be bought for the listed home. And they are making money!! Even at the old price or some builders would not still be listing new homes the same price now!

    I’m a dentist. I work with patients everyday. Most are great and compliant. Many are not-they’re hard to please, nit picky, and are rude. As a result, I dismiss these patients and ask they find care elsewhere. I understand this from the business side of things and feel that each of these women have given clear reasons to have their contracts cancelled.

      If you listen to the report everyone of them, except one, had only one request. One lady had 2 inspection requests, the rest had one and one was the toilet area was to small.

    There’s no way the builder would simply say “we don’t want to work with you” in their communication. They gave them a specific reason and These buyers clearly aren’t telling the truth and it’s very obvious by the way they answered that question. The number one reason for cancelling a contract was failure to secure financing, the rest are related to disruption of construction. These buyers obviously because high-risk, difficult clients.

      Not at all. This is happening more regularly due to greed more than anything. This is like the 5th recent story I've heard of such. Since the pandemic hit, more builders have been able to back out of the contract with little or no real reason other than they realize upon completion (or near completion) that they can get a LOT more for the home than the 1st buyers bargained for.

      Yeah right, and while these people were waiting for their promised homes to be built, other homes both new and resale doubled in price. Now these people and others like them have to start their lives over. Leaving the areas they lived and worked in to find both new housing (likely a rental) and a new job since their current jobs can’t buy a car payment in certain instances.

      With the poor craftsmanship on these homes I hope they are certainly bringing it to the construction managers attention. We recently bought a new build. I have to say the builder did listen and try and fix the problems we had but I never expected to see some of the poor quality of work that we had. Homes are expensive. Also some of the ways they cut corners to save money is ridicules. Times are going to change. Some of theses builders are going to regret the way they treated people
