    The only time you are responsible to fix appliances is if you put it in paper that you are renting them the appliances. But if you provide them and it’s not in writing that you are renting them then it is not your obligation to replace them if they break

    If it’s something you broke you gotta pay for repairs if it’s something that you didn’t do landlord has to fix it or get people in too fix it. Example when I rented I noticed the hardwood floor starting to buckle in the summer heat small section in the back room. The room that sees morning sun all the time. I took pictures and showed how it got worse each day about a week after I noticed it kinda stoped spreading but the floor was no all bumpy and those planks needed to be replaced it’s their floor and I didn’t do this. I showed my property manager that lives in the building with me he came in my unit took I look I showed him the damage and since I have a good relationship with everyone in the building he took my word that I didn’t do anything. He contacted the landlord she came out I showed her in my unit what was happening she said yep this isn’t something you could have done. She called in some contractors to take a look so they could match the flooring and couple days later they came back pulled out the bad peace’s cut new ones and reinstalled. I had to clear some furniture and stuff out of the way so they could do the work but I remember the contractor saying since you are on the ground floor the the hardwood probably absorbed to much moister and they put extra foam down underneath so it wouldn’t happen again. But I didn’t have to pay for anything and my rent did not increase and it shouldn’t it’s the landlords floor that failed.

      Hello..sure could use ur opinion on my issue with my landlord. I feel like I'm getting bamboozled for the cost to replace my disposal. Had an issue with it the 1st time and a plumber came out to clean the filter and it was all good. Now it has to be replaced. Am I liable for the plumbers fee and a new disposal? Isn't that wear and tear? Im in Utah. Thank u for a response..

    Stress rambling. If you have a landlord like mine you know...
    I've lived in apartments since I was born. I'm 30 years old now. My parents just liked moving every 1-3 years. My point is I have enough experience with what it's like living in apartments/townhouses that I know what to expect from management/landlords & I swear the place I am living now, have been living for 7 years( VERY unfortunately) is a goddamn nightmare. And it's 75% the landlord. They refuse to fix anything. They do an inspection every 2-3 months & harass us & it always turns into a thing. They don't do this to anyone else that I'm aware of. Tell me if this is acceptable:
    ★We have 2 bathrooms. The downstairs toilet knob was so old it busted off & something else was going on inside the lid that needed replacement. I informed them in person. They inspected our unit a total of 6 more × in 2 years before finally fixing it.
    ★Our dining room light & fan don't turn on because of an issue I'll get to next. I informed them in early 2020. Still not fixed.
    ★Our backyard fence (cheapest wood I've ever seen used for a fence) has been falling apart since 2018. It's now basically got 3 partial sections left. And w/o it were exposed to the street in our yard & someone can walk right up to our back sliding door.
    ★They notified us they were going to be changing the knobs in the bathtub & sinks from 8am-4pm. However NEVER mentioned they'd be sawing into the walls for hours. My cat was so terrified. They finally leave & I notice there's 5 12×12 inch HOLES in our walls. Bathrooms, kitchen, & storage closet. Took them 15 days to return to fix it. During those 15 days we had TWO MICE come out of the goddamn holes. I know that's where they came from because my cat saw a 3rd inside the hole & I caught her by the behind just before she got fully inside. Yeah they left em open. No cover, nothing.
    ★Most impressive. When we moved in there was a tiny water spot about 4 inches that they pointed out that they were aware so we didn't worry & they promised it would be fixed within the following weeks....By the following year the spot was a large circle puddle impression. By year 3 we had black forming around it. Year 5 we had it split open. Year 6 black mold was forming along the walls, carpet below the hole, & 1/2 the ceiling. Keep in mind they do inspections 3-6× yearly, depending on the year. They decide randomly after I'd given up, to 'fix it'. I think ok where are we going to stay I mean that's no easy task. They come in, take plaster, slap it over the hole, paint over the walls & done. No removal of the mold.
    Ever since they slapped some paint over the mold they have been extra awful & have started sending us THROUGH THE MAIL notices of NON COMPLIANCE for 'unit needs to be cleaned '. Problem is unit is not only cleaned, Its cleaner than it's been since the 1st year we moved in. So I don't understand what the hell is going on. They send a damn list every time & I'm mentally checking off every one done done done. They are flat out trying to evict us. They also sent an extra notice this time around saying our cat was never authorized. NO. Bullshit. When I moved in for the first 4 years we had a manager living on property. Year 2 I was going through hell so my mom got me a kitten to help cheer me up. She's 5 now & I love her more than anyone or anything on earth. She follows me like a dog all around the apartment, to the trash, mailbox, car. I spoke with & signed stuff for the cat, paid a fee. But she's (manager) now gone & I don't remember if I received anything from her in return. It was 5 years ago. It's absurd they just now say something when they have inspected with her in front of them every time. They are obviously smart & know I won't get rid of my cat (she saved my life). I also don't get wht they are allowed to send urgent time restrictive notifications through the mail so by the time I get it it's usually about 12 hours-24hours before. They say I have until tomorrow to remove my cat or be evicted & then get rejected from every residence in Oregon.
    Prior to this my experience with management was lovely. I met them when I moved in & usually don't see em again until I move out. Some did 1 inspection a year maybe & never notified me of a violation. I seriously don't know what to do. And I'm losing it from the stress of being evicted when I don't have cash saved for a new place & I will have an eviction so nobody would accept me anyways. This place is ghetto enough. I will not live somewhere worse. I've already witnessed enough traumatic shit in this complex between a man attacking his wife in the parking lot & hearing 4 gun shots in my neighbors apartment. Yet the landlord is wasting his time on me. WTF.
    Oh I also read up on black mold & it sounds exactly like everything that has been not right with me health wise for a few YEARS. Like very specific symptoms.

    My landlords refuse to do repairs on my rental like regular maintenance sealing window , repairing the holes in walls inside and outside, leaky pipes checking that insulation is against floor the list goes on and on. So this year in February my electric bill was 92 % higher than last year so I got a google nest thermostat and it whet to below normal after that but then a super old mini transformer for the furnace blew out the new thermostat was blamed but I think it blew out before because something caused that electric increase. So not only are they going to put back the old one and for my electric to be increased once again they are also stating their taxes are skyrocketing and they will be raising the rent. Please help. I’m not the only one that this behaviour is affecting. Every time I ask them to fix something they either say it’s inspection time or I get a retaliatory letter on my door.

    One question, I'm a landlord in Ontario and my tenant has moved in for a month, he clogged a toilet and a sink, I have spent money for a plumber to unclog them but the toilet cannot be unclogged because some hard substance was inside the toilet, I replaced the toilet with a new one. That was 2 weeks ago and total was about 700. Today he clogged the new toilet that cannot be plunged again, and for some reason the washer has been clogged, accumulating water and eventually spilling it all out, leaking downstairs to another unit. Now I'm charged with leakages.. I'm still waiting for the quote of the repair from the condo. What should i do? Thank you

      Good question and we're sorry to hear you're having these difficulties. Water can be especially tricky, and it sounds like you're trying to determine who is responsible for these ongoing issues. Here are a few general pointers:
      (1) Under Ontario's Residential Tenancies Act, landlords are responsible for providing essential services like water and sewer service and keeping related devices (like the toilet and washer) in good repair. However, there are limits to this responsibility.
      (2) The Act also states that tenants "are responsible for the repair of undue damage to the residential unit or residential complex caused by the wilful or negligent conduct of the tenant." If your tenant is causing these issues by willfully putting inappropriate things into the toilet or washer, then any resulting damage may indeed be his responsibility under the law.
      (3) In some cases, it can be tricky for landlords and tenants to negotiate this kind of damage between themselves. Make sure you have thorough documentation of each incident, including a report from a professional plumber or repair technician that identifies the cause of the problems.
      (4) You should also consider contacting your landlord insurance provider to open a claim. In fact, it is a requirement of landlord insurance policies that you promptly report it to them so that they have an opportunity to investigate. Your insurance provider will be able to give you specific advice in your unique situation; and, your policy may include coverage that will help you with damage that is assessed against your unit.
      If all else fails, you can also apply to the Ontario Landlord and Tenant Board for a review of the problems, and help in conclusively determining who is responsible for the damage.

    I would like to know for a commercial landlord that if the bottom of the toilet with a stainless steel 16 gauge flex pipe plastic cap broke overnight and leaking water flood the front office inside. Who should pay for the repair and damaged for the flooding carpets on the front office floors.

The answer would depend on the exact situation and the jurisdiction in which this happened, but typically the owner of the building (the landlord) is responsible for the upkeep of plumbing, and also would pay for any damage that arises from faulty plumbing.     what if a hurricane totals a vehicle outside of the apartment in parking lot? Who pays for this?

      Weather-related damage to a vehicle would always fall under the auto insurance policy covering that vehicle, assuming that the policy includes coverage for wind, water, or whatever type of damage the hurricane causes.

      Hi, Josee. The rules regarding this are different depending on where you live, but generally speaking, in Canada the landlord is responsible for repairing appliances if those appliances are included in the rent. So, if the oven belongs to your landlord and was there when you moved into the suite, your landlord should be responsible for the repairs.

    We are tenants next to a baseball field in california. A person hit a ball into our backyard and it hit the sliding window and broke it. The landlord is saying we are responsible for the cost of the repair. This doesnt seem right. Who is responsible for this cost?

Most leases in California state that tenants are only responsible for repairs resulting from the tenant's misuse or negligence.       @@kj8016 No, the landlord is responsible for repairing the damage. It's likely that new glass can be installed rather than replacing the entire window. This will greatly reduce the cost. Hope that helps.

      When I rented um the landlords kids well young adults clear the driveway parking stalls and sidewalks but lots of the tenets I lived with were nice and took turns shovelling. They also cut the grass

      @@frijolechingon5713 that's funny because I've been in my apartment since 2018 and I have kids so yes the carpet was dirty. I tried to get the carpet cleaned And when the carpet cleaning company came out they said they can't clean the carpet because they're device detects water damage underneath the carpet and carpet padding in all bedroom so he said that means it has to be a leaking pipe .. he also mentioned it's the landlord's responsibility to pull carpet up in each bedroom, fix the leak and then place new carpet and padding. This was in January when I reported this .. nothing was ever done then in May now my whole units was flooded water coming out on the base boards on the walls!
