    As a lawyer myself, I do t think you need to get to the standard of care - the lack of informed consent should be a winner. There are no experts in this field - the doctors who do this are political activists for trans care.

      That's exactly the point of standing up to this delusional gender ideaology. Young people don't have a clue about what they're getting into (sterilization, genital mutilation, & chemical castration). A part of the total number of parents that support their children in following this path usually are homophobic & they would prefer a transitioned straight child over a gay or lesbian child. Only a very very small percentage of people are actual Transexuals who are people who suffer from gender dysphoria. Patients need time to psychologically process transitioning. It used to be at least two years of intense psychological counseling where transitioning was discussed in minute detail. After & during that process the patient must live their day to day life as the opposite sex (clothing & physical appearance) the point being that authentic Transexuals want to melt into society as full members of it as the opposite sex. They do not want added attention to themselves or want to argue over delusional & misused pronouns, while capturing their bullying of society on video. These trans-activists are not Transexuals & they have inserted themselves into the LGB&T Communities by making threats, labeling people as transphobic, & getting people fired from their careers for simply not agreeing with them on the gender ideaology that they insist upon shoving down society's throat. The entire non-binary gender queer trans-activists are making a mockery of all the gains Gay Liberation Movement made since Stonewall. We of the Gay & Lesbian Community were seeking equal rights & the ability to keep our homes & jobs, which we could lose for simply being gay & lesbian & currently in 2024 LGB&T folks can still lose their jobs & homes in 26 States for being gay & lesbian. This trans-activist movement is a cancer on the LGB&T Community & society as a whole.

      There has been a huge movement to silence these people and convince them they are alone and noone will listen to them. They were already vulnerable which is why they ended up in this situation so without the support they needed they were never going to achieve this on their own. Sadly there is a long road ahead before this is fully recognised and apologised for. I don't see an apology coming for at least a generation. Think about the symphysiotomy scandal or the labotomy scandal. Those people didn't get an apology for a generation

      I find it disturbing how so many different authorities and gate keepers blindly followed this new 'Trans Ideology'.
      Professional sports organizations not willing to admit to physical advantages for males. Doctors and Phycologists forced to follow WPATH.
      Politicians in Women's Ministries not able to identify what a woman is. Educators pushing this on children.
      I don't think I can trust 'Authorities' again.

    The work that these women are doing is so important. This does not fall into the category of “frivolous” as someone in chat suggested. This is the opposite of frivolous, and the only way to make real change in North America.

    Been saying for a few years now that the number of our youth who have been [misinformed] on all this will result in a multitude of societal issues of which we must address at some point. Tide is turning, but due to the state of things being what they are, it is gonna be a VERY long road.

      It is going to be a difficult road given how much the systems that should allow redress have been infiltrated and undermined. And given the sophisticated tactics already by those with an interest in sterilization of children ( including actual lawfare tactics ).
      On a side note , could it is so frustrating/ infuriating when people misuse the term "lawfare " to signify legitimate attempts to seek legal redress , thus depriving us of a distinctive term for the illegitimate weaponization of legal processes and costs.

      @@gisellemagraibhaigh8342 The only fibs I had to tell was to the psychologist and doctor and I just stretched the truth a bit saying that I wanted to be trans-feminine. If you look at Richie Heron, Eli Erlick, Rinoa Leonhardt, or Alexander L, they don't really look like women when they cut their hair short. Those are good examples because they like most went through some male development and now don't take or can't take testosterone. They all look about half their age. Even Scott Newgent says that most transgender people look like they are mid-teen boys well into their 40's.
      What did you think I lied about? I engage with similar males who use gender medicine but don't present as female but it helps us keep our look through the decades. One can no longer make sperm but that doesn't mean you can't have an adequate life complete with sexual relations. I did it because I didn't want to become a man and I don't like masculinized, Tannerized men. One can act as feminine or as masculine as they want but I want a softness that gets lost in the physical masculinization process. A gay who acts feminine is just a masculinized fruitcake.

    I sued for negligence (not related to GAC) when I was a teenager. The law suit took 7 years and was harder on me than the actual negligence. I hope these detransitioners get what they’re owed.

    When you're victimized by a doctor and need to file a malpractice lawsuit, it should not require paying tens of thousands of dollars. A person with $0 should be able to file a lawsuit if need be. How is that legal in itself??

      Filing the lawsuit is cheap. It's hiring the lawyers, experts, getting evidence etc that is expensive and rightfully so. Lawyers and experts aren't cheap for a reason. It requires a lot of work to write briefs, do the legal research on something this complicated especially a medical and mental health issue.

      No. They were following the law. The school and teachers aren't really at fault. They were being sued by parents and trans activists organizations to adhere to this ideology. You need to realize this battle has been going on for over a decade. Teachers and school administrators who refused to follow this ideology were fired early on and so other schools went silent out of fear.
      You have to go after the medical and big pharma. But good luck. They will argue that they were following the standards of care that trans and lgb activists forced on everyone and demanded be written into the law. Remember a lot of trans people, trans kids and trans activists were bullying everyone in society to get this treatment, for pronoun recognition and all other aspects of this ideology to be pushed on the public.
      This is why a patient should not demand their own treatment or participate in some activist organization to get that treatment written into law.

    Thank you ladies for doing what you do. I am one of many cases unable to sue because of the statute of repose. Even though it’s a helpless situation for me, it warms my heart seeing so many people fight on my behalf.

    And the 'care' they drafted was abysmally bad. This should definitely put WPATH into the 'strict liability' camp. They created a 'product' that was inherently harmful.

      Not only that, but because there was no science behind it, it was experimental. But they had no experiment design write up, no authorization from governing bodies for an experiment, no ethical body to review the methodology and design, and no consent from those being experimented on! Everyone was told it was settled science.
      That puts it into Dr. Mengele level experimentation!

    It's about time. I've been wondering how long this would take. The fact any doctor can look a parent in the eyes and tell them that hormones or blockers are reversible is absolutely disgusting. They need to be held accountable. I have no objections to any adult doing this but a child needs to be protected.

    This is why I'm against the statute of limitations. There are plenty of countries that have the opinion that if you van prove a crime happened 20 years later then so be it. Many crimes become more difficult to prove for each year that passes, but if you can prove then why not?

      I think it's the "more difficult to prove" problem exactly. Even DNA evidence decays or gets contaminated. The longer ago a crime is committed, the more faulty people's memories will be, the more all kinds of evidence come into question of whether they can be verifiable and accurate.
      Albeit, some of our statutes could probably be updated as forensic science advances.

But if evidence, records, documentation, or recordings exist, even when accounting for the fallibility of human memory, or the fact that over time a criminal is better able to get their story straight with made-up alibis, if you can reasonably prove your case... why not?

      ​@@analogbunnyyeah I agree. My friend lives in a property where historic sexual abuse crimes against children took place. The crimes were over 35 years ago but the case is being investigated. One of the victims who says they were abused as a child in the property described the property in detail, floorplan, down to particular wallpaper. They (the police,) came and stripped the walls in patches and found under layers of paint the wallpaper described. Also evidence of a fireplace that was described by a victim that was blocked off and bricked up after the fact. They really do take care to ensure that memories are reliable and can be credibly relied upon and verified. Of course not all cases have enough evidence to go forward with but if they do then the perpetrators should not escape justice.

      I think, by suing these doctors, it can be a punitive measure to signal to other doctor to actually use their knowledge and not just go along to get along. The doctors, with all their elite knowledge, should have seen the health issues to arise in the future. They were transing people simply to earn money. They weren't self-decived. They were willfully ignorant.

    I think that these lawyers should really research the recent Kowolski case from Fl. A lot of the aspects surrounding consent, somatic illness (physical manifestation and treatment involving psychological disorders) and standards of care.

    I'd be very surprised if there aren't lawyers somewhere in the USA who have been tracking this issue and potentially seeking to follow up those who have been through the gender affirmation production line.
    The whole situation seems so open to the possibility of ugly, heavily contested litigation, and potentially very lucrative for a lawyer.

    I was researching vaginal atrophy to find out more about it (my wife suffers from it) and according to the Cleveland Clinic she suffers from it because she identifies as a female.

    It'll be hard in some ways for a patient to win a lawsuit as the doctors will argue that they were following the standards for gender affirming guidance provided by Wpath, the WHO and the trans activists organizations. Also some doctors and psychologists will say they were bullied by patients, parents and trans activists organizations to provide gender affirming care. This also the gender affirming guidance that trans persons and activists demanded and argued that doctors, psychologists, therapists, school administrators follow.
    So now this is coming to bite Wpath, the who and trans persons and activists back in the butt. Not sure how this will play out in the courts. But this is why you as the patient should never decide your own treatment or demand a treatment from a doctor using activists organizations or demanding it in the law. You might have a hard time seeking relief should that treatment go bad.

    If the standards of care are arbitrated by people who make the standards fit their practice ... rather than the practice fit their standards then unfortunately the only pathwau forwards MAY be under a lack of information (about negative effects and prevalence) within the informed consent process.     10000 children , mostly girls are on cross sex and puberty blockers in New zealand and our ministry of health has tasked Patha to examine this . Patha denounced the CASS report.!
    The state TV broadcasters immediately side with the trans advocacy surgeon , a transgender who requested more funds and faster access to surgery
    And cited no regret ever experienced by trans , only Joy.

    When a set of beliefs become fundamental to a person's sense of self, NO amount of letters, evidence, reasoning etc is going to sway them.
    Those beliefs become indistinguishable from other more commonly encountered doctrines of faith, namely religions. Similarly, they'll have texts they consider 'holy' and various dogma etc that CANNOT be questioned.
    It requires a person to have sufficient self-awareness and courage, or suffered something traumatic relevant to those beliefs, potentially to come to question them.
    There are ugly, cult-like traits to some elements of gender/trans ideology; particularly in activists, which is hardly surprising given one might expect them to be the most 'committed' to their beliefs.

    (2) Wondering if people who get refused trans health care also have the ability to sue
    (3) Potentially due to emotional bias of their doctor.
    (4) Especially if it morphs their body pass a passing state
    (5) Giving them physical characteristics of the genetic gender they did not want to be.
    (6) Costing them thousands of dollars to fix

      How would you expect them to pay their bills? Did you hear how much effort each case will take? These are small law firms who couldn’t possibly feed their family without funding. We don't live in a fantasy world where people can dedicate full-time efforts without some remuneration.

    The doctor is between two fires: if you don't 'treat' the trans, the trans will sue you, and if you do, they will sue you for care.

      Its pressure from the activists that these doctors fear the most. That's because they have never been confronted with fighting their own medical lawsuits from their own hip pockets. Once that hits the scene, they will finally begin to fear the appropriate thing.

      Exactly. The patients were bullying and threatening medical professionals as well. I know some psychologists who will no longer work with children because of this and it is too much of a liability to their profession and license.

    Sounds like Themis is doing interesting and needed work. In anticipation of criticisms by trans activists and allies, that Themis is probably just an opportunistic front group with $$$ from far Right, Christian nationalist Tr**pist billionaires, I did a cursory search regarding their funding. Well, knock me down with a goose feather. It's all center-left NGOs and funders. I keep trying to tell people that there is nothing inherently "Left" about "trans rights"., etc. In fact, quite the opposite (see Susan Neiman et al). The trans phenomenon, I believe, does not fit the longstanding (in this case loosely construed) "Left" liberation narrative. Nor does it have anything to do with the Left's roots in labor. Trans grows out of completely unrelated origins and particulars. Sounds like some funders agree or are coming around to it. My current station in life precludes all but moral support. But if I ever hit the Lotto...

      I am taking what were called "notes" when I was in school.
      Basically, I have a pen and a paper, and I write down thoughts and details that will help me formulate appropriate questions later in the interview.

      That would double to triple the turn-around for these interviews. Perhaps listening to the podcast would help. This interview in particular was about a complex topic, not so much a personal biography, requiring me to keep many additional details in mind when guiding the discussion.

      Lawyers still have to pay staff, expert witnesses need to travel, court fees, even if everyone is working for as cheaply as possible, it adds up. Remember these cases may drag on for years.

    It'll be hard in some ways for a patient to win a lawsuit as the doctors will argue that they were following the standards for gender affirming guidance provided by Wpath, the WHO and the trans activists organizations. Also some doctors and psychologists will say they were bullied by patients, parents and trans activists organizations to provide gender affirming care. This also the gender affirming guidance that trans persons and activists demanded and argued that doctors, psychologists, therapists, school administrators follow.
    So now this is coming to bite Wpath, the who and trans persons and activists back in the butt. Not sure how this will play out in the courts. But this is why you as the patient should never decide your own treatment or demand a treatment from a doctor using activists organizations or demanding it in the law. You might have a hard time seeking relief should that treatment go bad.
