This is clearly unconstitutional, and a direct violation of the 4th Amendment which guarantees that everyone "be secure in their _persons,_ papers, houses, and effects." A fetus before 18 weeks (when it is developed enough to feel pain) has no legitimate moral claim to be considered as an entity in its own right worthy of legal protection. The rights guaranteed to all Americans of "life, liberty, and the pursuit of happiness" simply do not apply to it _at least_ in the first 17 weeks of gestation. The autonomical interests of a fully-grown adult woman who IS capable of experiencing pain and suffering and seeing herself as entity existing over time (the notion of "personhood") supersedes the non-existent desires of a first-trimester fetus to stay alive or to not suffer. It couldn't be more obvious what the correct moral stance is here, unless your faculties of judgement are blinded by the shackles of Iron Age superstition. Put two-and-two together, folks. I believe that you aimed for it to be concise, however that is simply not the case. Your stance has lost momentum before the validity of it could have been considered.

In addition to life and liberty; and happiness, this is only applicable as long as you don’t do anything illegal or violate the rights of others. If you used this argument you are violating the right of a child to the right to have a “life”.
The amendments and the DOI do not address abortion, in the slightest, so to manipulate the true meaning of that statement is wrong.

But, this is far from the truth.
#1) The forth amendment doesn't even talk about, mention or allude to abortion being a constitutional right. The Constitution, through the Fourth Amendment, protects people from unreasonable searches and seizures by the government. This has nothing to do with abortion. I don't even know what your trying to say here.
The constitution doesn’t even mention abortion being a “right” anywhere. People who use this argument will often point to the 9th amendment and the 10th. The 9th amendment (the Right to Privacy, written by James Madison in support of federalism) states, “The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people”. This means that the government can’t take away other rights of people that are not listed in the rights in the Constitution. The 10th amendment (written by James Madison) states, “The powers not delegated to the United States by the Constitution, not prohibited by it to the States, are reserved to the States respectively, or to the people”.
Abortionists will say that the 9th amendment guarantees a right to privacy, therefore the 10th amendment doesn’t apply in the circumstance of abortion and abortion access must be allowed at the federal level. This is supported by the fact that in January 1973, the Supreme Court issued a 7-2 decision ruling that the Due Process Clause of the Fourteenth Amendment provides a "right to privacy" that allows the pregnant woman to decide to have an abortion or not.
But, I disagree. Abortion doesn’t seem to be a private matter. In order to consider it as a “private matter” you, not only have to ignore that nature of the procedure, but also the outside interests that are affected by the abortion. The definition of private is, “belonging to or for the use of one particular person or group of people only”. So it would go, as it follows that in this circumstance, a private matter is defined as an individual interest in which government and uninvolved third parties can claim no valid or permissible interest. Before the abortion decision is characterized as a private matter or not between the mother and her physician, the non maternal interests involved in this decision, has to be identified and weighed to confirm that they have no valid or permissible interest. The primary non maternal interest would be defined as the baby in the womb. Because the unborn aren’t able to serve or protect their own interests, those interests must be protected and asserted by the government or by concerned third parties (the pro-life movement). If we approach this problem from a pro-life perspective as the murder of a baby, the rejection of the privacy argument follows logically from the commonly held belief that the taking of a human life is a proper matter of societal concern. Given the interests being asserted by the opponents of legal abortion (the right of the unborn child to life), making a pro-abortion argument that’s based upon the right to privacy would be incorrect and is not an argument, (It’s a conclusion based upon a decision that maternal interests take precedence over the lives of the unborn). And most abortions aren’t about the mother’s heath or a forced pregnancy (a lot of them are about lifestyle conveniences). And the legal precedent that established the “right to privacy” was within the context of former president James Madison's ideas that people should have a right to privacy in their bedrooms whether or not to take birth control. Therefore, it would be wrong to twist the 9th amendment to fit with the idea that abortion is a “constitutional right”.
#2) Person hood and the ability to feel pain does not define whether a person is a living. People with congenital analgesia (a rare condition in which a person cannot feel, and has never felt, physical pain) would disagree with you. You also described "person hood" as experience by saying, "The autonomical interests of a fully-grown adult woman who IS capable of experiencing pain and suffering and seeing herself as entity existing over time (the notion of "personhood)". But, being logically consistent, a 2 month old baby would have little to no person hood. Person hood does not define life, life defines person hood.
This is also biologically incorrect, life begins at conception (Also known as fertilization).
But even ignoring that life begins at conception, this argument is against the theory of bio genesis. This theory states that life arises from pre-existing life, not from nonliving material. Therefore, it would be unlikely that the baby could originally be inanimate and later become animate when it’s in the womb for a period of time. And there is very clear observable evidence that fetuses are living human beings.
Now, back to life beginning at conception. Fertilization (conception) is the amalgamation of male and female gametes to form a zygote to give rise to a new individual organism and initiate his/hers development.
After this occurs, during the first trimester, the baby starts to grow rapidly. This process is called “Implantation”. Implantation is a process in which a developing embryo, moving as a blastocyst (or a structure formed in early development) through the uterus, makes contact with the uterine wall and remains attached to it until birth. The lining of the uterus or the “endometrium” prepares for the developing blastocyst to attach to it.
Then, the baby’s heart begins to beat in the 3rd-6th week of pregnancy. Trans-vaginal ultrasound technology can detect the baby’s heartbeat as early as 3 to 4 weeks after conception, or 5 to 6 weeks after the first day of the last menstrual period. Later, the baby’s lungs and digestive system also start to form. At 8 weeks, the baby’s brain activity can be recorded using a device called a “prenatal EEG”. At 12 weeks, the baby can swallow, scrunch it’s hands into fists, and touch their face and head. At 13 weeks, the baby’s fingers and toes are also complete and nails are fully grown and fingerprints start to develop by week 14. At 18 weeks, the baby’s ears can hear music, outside sounds, and the mother’s voice. Between 18 and 30 weeks, doctors can treat pre-born babies while they’re still inside the womb by repairing significant defects or diseases. For example, doctors in San Francisco (2015) do surgeries on fetuses in utero. They repair herniated diaphragms by removing the fetus from the womb temporarily. After partially removing them from the mother’s womb, they put the fetus back in where the fetus is born normally 12 weeks later.
The only way to figure out if something is living is by comparing it to other living things and contrasting it with non living things.
We can compare fetuses to full grown adults to show that they’re living beings. In comparison to adults, fetuses can smile, feel pain, cough, yawn, hiccup, respond to sound, respond to light, and even sleep. Adults do the same thing. Adults can grow, move, breath, and need nutrients from foods and water. The same thing is true for fetuses.
We can contrast fetuses to inanimate objects or non-living material to show that fetuses are not non-living material. Non living things can’t move without an external force, they can’t grow, they don’t need food or water to continually exist, they can’t breath, they don’t have consciousness, they don’t have working lungs, working ears, developed fingers, or a beating heart. All of these things are what fetuses have at 18 weeks in the womb.

As a parent of a young woman I would have been disappointed if my daughter was pregnant before marriage, but if she aborted her baby I would be disappointed and crushed. Not just for me, but for her. I am against abortion because today, more than any other time in history, we have ways to prevent pregnancy. Why doesn't the Government pay 100% for pregnancy prevention (from the pill to sterilization, if a man never wants to father children, or a woman never sees herself as being a mom) instead of creating laws that only worsen the situation? And, the mantra, my body, my choice, is not valid. It is something you tell yourself when you want to get past something that has put a wrench in your life. Once you get pregnant there is another body that does not have a say in what you are about to do.

Unfortunately it's not that simple. I honestly wish every child born has a good family by birth or adoption, but that is simply not the case. On top of that, simply being pregnant affects both the mind and body. Off the top of my mind are post natal depression and gastro diabetes. Forgive me I belive I butchered the words. I doubt anyone who consider or go through with abortion does so lightly. Or at least that is my hope. They may grieves the child the never had or will never raise. I don't think I would have the mental fortitude or mental health to carry a baby to term ,get attached, only to give them up because I couldn't afford them. In the end, weather it's adoption or abortion I would loose the possibility of rasing my child, my kid. Both would be mentally taxing. One will physically and financially harm me alot more than the other. Giving birth is unreasonably costly. One would add another child to the system that is full of children needing homes and family with no guarantee that the child will live safly and happily. Both will probably hit me in the gut and heart. I use to think exactly what you think. Now, I see a rock and a hard place. A no win situation. I still want a choice on what option to choose.

When I held my newborn grandson in my arms, it was just the most beautiful feeling, he was so tiny and helpless - to think some women don't think twice about doing this is so heart wrenching.
