    How to persuade a judge
    In her long career judge would have heard and seen hundreds of lawyers. How can you be different from every other lawyer?
    Is there a technique which is more likely to persuade a judge? I think so. I do not guarantee that this will work all the time, in all courts, and in all circumstances, or with all judges. But it has worked for me most of the time.
    The technique consists of remembering 4 points/:
    (1). Convenience: make it easy for the judge. Help him or her.
    (2). Optics: maintain a courteous but dignified appearance. Do not simper. Do not be over officious. Do not fawn. Judges do not like it.
    (3). Audio: Speaker with a deeper voice; and speak slowly. Pronounce the different parts of a word fully. Do not put on a Western accent. Speak naturally and slowly. Watch your cadence and tone.
    (4). Content: There is no substitute for the five main factors: Integrity, Courtesy, Brevity, and Clarity . Be painfully honest. If you do not know something, say so. It is not a mark of ignorance: it is a badge of integrity. Do not guess. Take the shortest possible time to tell the judge the main points. Do not relate the case to the judge as if you are expatiating on the Mahabharatha. Do not maintain a school masterly attitude. Do not think the judge is stupid. He has had better lawyers than you appear from him for ages and ages.
    When you get to the Content, ensure you ‘do’ The Three Tells: Tell her what you care going to say, then tell her; and then Tell her what you have told her. Take a short time. Do not show that you are afflicted with the ‘One more point’ syndrome. Do not go on and on, interminably. It irritates the judges no end. Be short, sharp and concise.
    Best of luck

    We are lucky we have a world class lawyer like G K Ganesan prepared to share his knowledge and talent with us. I am a litigant in person without a legal background involved in a case to recover trust properties. With what I learned from G K Ganesan I am able to hold my ground arguing against 2 lawyers representing the Defendant. I appreciate the opportunity to learn from G K Ganesan.

    I really appreciate that this video showed up in perfect time as I'm researching on how to persuade a judge for my Mooting class. This video helped me to build confidence and prepare my arguments in a great way. Thank you so much for creating an amazing content. Looking forward to more videos like this. Perhaps more of Court's Ethics videos? That will be really great.

    Are the Malaysian courts crowded with people? Do the judges have time to listen to their lawyers?

      @GKganesan  Před rokem

      Not as much as Indian courts, which are as I note, very busy. Everyone will have time to argue: first by written arguments and second, by oral arguments.

    How can a person in legal practise get to be appointed as queen counsel? What are the steps taken to be appointed as one?

    • @GKganesan
      @GKganesan  Před 3 lety

      To become a Queen's Counsel, one has to practice in the U.K. Cannot do that elsewhere in the commonwealth, unless there are special exceptions like, e.g. other commonwealth nations like Australia, Canada, British Columbia, etc.
