as someone whose brother is unfortunately a cop, they wouldn’t be able to arrest or handle a family member’s case in any way. they would have to call for backup and have someone else deal with the arrest, to prevent any bias and special treatment.
I think depends on the state. I know at least in Florida, your keys have to be in the ignition, but if it's in the backseat, they can't charge you. Other than possible public intoxication, though that depends on police discretion.
