As a soldier he knew not to point a weapon at anyone, not to have the safety off, not to have his finger on the trigger / inside the trigger box and not to pull the trigger. He had to do FOUR wrong things to kill his wife. This was not an accident. This was murder.

Correct. He would have been doing SPORTS in his sleep. To those in the know it's the drill for that weapon they teach in the US military.
Exactly. My grandpa taught me all of that when I was a kid and he showed me how to fire a shotgun. It’s common sense, but someone who is military trained would never do any of those things. Especially not in his house, sitting right behind his wife who he seemed to be perfectly aligned with to be able to have that bullet travel that path.

A female relative of mine was killed by her husband who was “cleaning his gun.” He claimed it was accidental and never faced any consequences. Her story only lives on through the few ppl who still remember her, it is very sad.

And not to remove the selector off "safe" until ready to fire.
And not to place his finger inside the trigger guard until the target is acquired and a shot is justified.
@@skyhawk_4526 M16/AR-15 and it's many variants you cannot apply the safety catch until the weapon is cocked. The selector switch is set to 'Fire' in its default position. If the selector is set to Safety, then the weapon is loaded and been cocked. So not the correct position. Unchambered the selector is set to Fire and won't move to either Safety or Auto.

Yeah, as an American white male in my 30's - I have to agree with your guys' point. I've never been charged with any type of killing, but I can see how "showing remorse" combined with a good attorney and my white privilege would give me a significant leg up on others of a more... pigmented nature who may find themselves in a similar situation.

The difference between American and British jury's is that American Jury's are given too much power, they can let their emotions and intuition influence their decision. British Jury's must leave their emotions locked out and can only judge on evidence presented in court, banned from reading about the case on social media or posting anything, if they do they go to jail for perjury.
If someone is found Not Guilty in a British court it's because the prosecution failed to present a water tight case, or they are actually innocent. In an American court it comes down to if the Jury likes the defendant.

There were people who knew of domestic incidents and had seen her with bruises. Some of his army buddies supposedly told him to stop. I don’t know that police were ever called.

My ex husband had no rap shit because his mom, sisters and then me would protect him from facing legal consequences for his violence. When I finally called the cops on him, it was hard to prove that he was the instigator and the offender and not me.

So apparently the rifle did it? The most horrifying part of this case is that someone trained by the the U.S military thought “ the gun just went off” was a believable excuse. Thank you for covering this Dr. Grande.
I believe many people get away with murder under the guise of an accidental shooting. If nothing else, many of the shooters should face charges under "idiot with a gun" laws.
It’s called “accidental homicide” and is prosecutable.
All it would take to turn it around (especially in this case where it involves a trained soldier) is the prosecutors putting a good firearms expert on the stand to explain to the jury how implausible the "accident" defense is.

(In this case, that's what he was convicted of, even though it should have been a murder conviction since this "accident" clearly required numerous deliberate steps and an intentional and deliberate disregard for basic safety practices (that would be totally engrained in any trained soldier like him) in order for his wife to have been killed the way that she was.)

Good day Dr Grande😊thank you for reviewing this heartbreaking case. I had family members in the military, they were never careless with weapons. I don’t understand why he wasn’t convicted.
I’m guessing Danielle wanted to make sure she would have the alcohol when Skylar came home. Danielle probably lied to Skylar about how she got the alcohol to avoid a fight. Skylar caught her in the lie and assumed this meant she was cheating. He killed her while angry and intoxicated. Once the reality of the situation became clear he tried to cover up the crime.
Sounds like Romeo and Juliette: "the reality of the situation."
She was constantly trying to please him. She got the alcohol to please him and it wasn’t enough. It’s never enough for abusers.
Good analysis. Also, am I the only one that found his attempt at grieving on the scene was just sooo lame. Like, normally I really hate it when people say “his behavior was suspicious or not believable”, but this dude took it to a whole new level with his fake-ass grief that would have been laughable if it weren’t for the tragedy in which it was performed.

There's no such thing as a gun going off accidentally by itself. It takes applied pressure on the trigger to shoot a gun
Maybe it had one of those "magical going off on its own" Alec Baldwin specials.
That's not 100% true, but it's generally true. It's just best not to talk in absolute terms. The AR design is susceptible to an accidental discharge when chambering a round that's been chambered multiple times due to the free-floating firing pin lightly impacting the primer of the round each time it chambers it, gradually weakening the primer and causing an unintended discharge without any manipulation of the trigger. I'm not saying that's what happened here (I am quite certain it was not since this scenario is extremely rare and required numerous re-chambering of the same round), but to say an AR-15 cannot possibly go off accidentally is frankly inaccurate.
@@skyhawk_4526 I realize the following theory may be relatively unlikely, and obviously is impossible to assert without a confession. But I think it could have been used as a strategy to press for manslaughter:
While Danielle was looking at the computer, drunk and angry Skyler pointed the gun at the back of her head with the intention of mimicking the act of executing her, with no intention to carry out the act in reality. With is inhibitions lowered and motor skills decreased, he underestimated the sensitivity of the trigger, and accidentally fired it.
I have no compassion for Skyler and am in no way trying to defend his actions....just floating this idea out of interest from the legal perspective.
I remember when this happened. I live like 15 minutes away. He deserves at least 20 years

I was married to a narcissist in the Marine Corp for years. We were hs sweethearts and in love but after he left to join, he changed dramatically. He was so insecure, he always thought I was cheating and made me cry so much on the phone. When we finally moved in together, we were strangers and he would get fits of rage in a split second. He'd drink and try to get me to slip on something I'd told him before and if I did get caught in a white lie, he's flip out and become violent. I couldn't have male friends at all.
Hearing this story of Danielle, I can feel it, I know what she was going thru and how hard she was trying. I also feel his rage and see it for what it was. He was guilty of murder either way but 2nd degree is what should've been. How very sad for her family.
*Dr Grande perhaps that's a good video idea for you to do on how young men change when they go into military service and the effects it has on family/spouses once they return.
I've been shooting 48 years and worked as a range safety officer, never seen the shake-fire AR before, must be like a bump-stock. Oh wait, no that can't be it he said she shot herself in the back of the head while cleaning the rifle. Guess I'll have to be more careful in the future when I'm practicing my contortion routine while cleaning my AR-15 behind my head. I might get lead poisoning and break my computer.
Oddly enough him destroying the evidence of the alcohol hurt him more than he realized; both the act of covering it up hurts his credibility, but had he kept it all there than the fact that they were both intoxicated gives more credibility to his accidental shooting story.

I've read about this case and watched footage of the court trial, but I didn't know he initially claimed Danielle shot herself and then later changed his story to shooting her square in the back of the head by mistake.
If for some reason I accidentally shot my spouse while fiddling with a rifle pointed directly at their head, and they were clearly well and truly dead, I would still try to hold them in my arms before the warmth drained from their body... can't imagine I would suddenly be overcome by an urge to tidy up the liquor cabinet and double check the toilet flush is working properly .
You didn't mention that he later appealed the manslaughter conviction, arguing that "deadly weapon sentence enhancements should not be applied to an unintentional crime such as first degree manslaughter". He was then granted credit towards his original sentence for time spent on electric home monitoring prior to the trial.
Those jurors should have been assessed for gullibility prior to being selected. Poor Danielle. RIP.

Usually they teach soldiers weapon safety, so his claim is a little hard to believe.
It's not just taught, but drilled into you.
I spent a few years in the Army. Trust me, many young soldiers are often not very safe with firearms handling. Guys, I knew post-basic training purchased weapons and often brought them out to show off when they were drinking in the barracks. I'm very thankful no one was shot and killed.
Danielle actually went back and finished high school. Hood for her. 👍🏽😊
It seems like Danielle wanted to create a loving, stable relationship. She probably thought she could make herself love anyone she was involved with. Sometimes, the relationship is a way out...as it was for me. I got married 2 weeks after graduation, to escape an abusive childhood. Danielle had the quality of being much more attractive than what her husband deserved, and he knew it. Jealousy was likely why her killed her.

I'd say yes- it's awful to suffer a childhood marred by painful loss & instability, lacking self esteem, experiencing constant doubt, uncertainty & upheaval, all results of an anxious attachment style, due to loss of one's mother @ 2 y.o., to then both convince oneself & allow yr romantic partner to convince you you're finally safe & loved, only to- a few short yrs later- be killed by someone you love & trust & devote your life to (however rashly, & immaturely, never seeing one's partner for who they really are)...also it depends if she was conscious at all, felt pain, knew she was dying, however briefly (the phrasing Dr Grande uses abt Skylar not "comforting her" makes me think she did Not, despite such horrific fatal injuries, die right away 😣)...
She likely didnt know what happened but the presence of her loved one would have been comforting I'd think while the absence of his presence, being completely alone- no doubt her life's biggest fear- was probably an additional awful feeling she felt if she was conscious at all after being shot, b4 she died.
As someone who lives with chronic pain tho, who watched my 2 most beloved family members die of cancer, I definitely what you're saying... & agree to an extent. So otoh Id say no, not exactly a "sad" way to die compared to many... I'd say it was a tragic way to go, however. And if I'm misunderstanding the implication of Grande's statement (I know I could further research the case to find out, but I don't want to know more, I hate true crime) & she did Not have any seconds or moments of consciousness and/or pain after the bullet went thru her head, then I'd say it was an easier end than most of us will get, however tragic her life and the circumstances of her death.

In a country where guns are freely available and where the majority of citizens know about guns and gun safety it is inconceivable that a jury could get a decision involving the discharge of a weapon so badly wrong.
American juries are very often badly terribly stupidly wrong.
here's how to clear an AR.hold it normally. point it down and away from you by opening your arm as you grip it.
flick the safety, push the mag release with your off hand and rock the mag out.
look cool as you drop it.
Reach the the off hand to the bolt handle and pull it back.
Observe the round pop out.
No shoulders. No thighs, no finger on the trigger.
How did the jury not see through this act? It magically disengaged the safety and pulled the trigger by itself and just HAPPENED to fire into her head? Get real.

I highly doubt there was anyone on the jury that was familiar with firearms, and firearm safety. Jury got it wrong, for sure.

EXACTLY! The very first thing you learn with gun safety is to NEVER point the gun at anything or anyone you don’t intend to shoot! You ALWAYS point you’re gun in a downward position or away from any person or dwelling, and you ALWAYS check the safety button, and NEVER put you’re finger on the trigger unless you’re ready to pull it. That is gun safety basics that even my 14 year old son understands, and I understood by age 10! No person on that Jury who is remotely used to guns would believe this garbage story! Bottom line. This is awful..
This case has always broken my heart. Danielle was so young and extremely vulnerable to an abusive relationship because of her upbringing. Then she was trapped with this horrible man and was trying so hard to please him but of course there is no pleasing an abuser. He will abuse more women when he is released.

I rented a room in a house from a man that come to find out, was home from work with an injury long term. That’s not what it said online. Anyway I was very nervous day 1 and on especially when he started threatening me with eviction and cleaning his guns. He also made the TV make loud shot gun sounds.

Hello Dr. Grande, another great video. I do agree with you that he was guilty of second-degree murder. There are too many reasons that make him look guilty as you mentioned of them, including not calling 911, destruction of evidence and not remembering the event, and deception behavior. I strongly agree with you that he was trying to make fabricate a believable story of what happened, just strange what jealousy can bring someone to commit a violent act against someone close to them. And after police/ "law enforcement", the U.S military has one of the most toxic environments in this regard, effectively a breeding ground for growing the number of the radicalized young men for a cause that- in reality- truly benefits only a small fraction of extremely wealthy White conservative men in power... but many insecure young men, the ones that lack a secure sense of identity & their values, remain vulnerable to it.

I agree with Dr. Grande completely. I was USAF Security Forces, and an AR-15 is essentially identical in operation to an M16/M4. Any soldier in the US Army would be intimately familiar with the clearing procedures for an AR-15 style rifle and the safety measures (like pointing the muzzle in a safe direction, making sure it's on "safe" and keeping your finger outside the trigger guard) would be automatic and drilled into him.
Also, an M16/AR-15 type rifle would not be stored or routinely carried by any sound minded soldier with a round in the chamber outside of its needing to be chambered for the immediate use against a threat that presents itself.
The idea that "shaking" the rifle caused it to discharge a round (even if one was already chambered and it was on "fire" - both of which make no sense in this scenario unless you intend to fire it - makes no sense at all and is absurd - based on his obviously extensive and ingrained training by the Army with such a platform.
It seems to me that the prosecution did a very poor job outlining these facts. And none of what I already mentioned touches on the fact that the rifle was obviously pointed at the back of her head when it was fired - which is also inexplicable (unless you're planning to kill her) for a trained soldier (even if he was drunk at the time). The prosecution should have had a competent firearms expert with military training and experience testify to the jury about all of this.
No way this was an "accident." The only way this happened was for the defendant to point a loaded and chambered AR-15, with its selector lever placed on "fire," at the back of his wife's head, and then pull the trigger.
For him to not be convicted of at least 2nd degree murder means that either the jury was incompetent, or the prosecution was. And once you factor in the destruction of evidence, failure to render aid and failure to call 911, on top of the alleged "mishandling" of the rifle (by a trained soldier), and this should be a slam dunk murder conviction.
I really don't get it.

so he will get out at about the age of 34...he will kill another woman, either wife or a girlfriend or both...there is no way a man in the armed services could make such a mistake...even in the extremely unlikely case that it was an accident...he should have gotten life with no parole, he is not safe around innocent people.

It’s not true for all folks who got married at a young age that the relationship will always or most certainly end up in disaster. My husband and I married young and we’re still married over 35 years.

I'm a gun owner and I truly cannot comprehend how some people do not KNOW that their firearm is unloaded. You have to KNOW this. I keep an empty chamber flag in all of my rifles for that very purpose. This was no accident.

Thanks a lot, Dr. Grande! What a sad and tragic case. A beautiful young woman killed in what really seems to be not a manslaughter, but rather a second degree murder. I'm sorry, I seem to have missed the name of the state in which this tragedy happened. Probably, Skylar Nemetz could even face the capital punishment for the assassination of his wife? Thus, he really seems to be ''lucky'' for receiving only an imprisonment instead of the possible death penalty he deserved.

Just googled it and found out that capital punishment in the Washington state had been officially abolished in 2018 and the last person had been executed there in 2010. But at the moment this tragedy took place, death penalty still was at least officially in use in the Washington state. Though, as the sources relate, due to the fact that second-degree murder is considered a lesser crime than the first-degree one, it's not typically subject to the capital punishmnet. Thus, even if Skylar had been found guilty of a second-degree murder, he wouldn't have been probably punished with death sentence. Maybe, he'd have got a longer imprisonment, up till spending the rest of his life in jail. Unfortunately, neither of the punishments can ever bring the beautiful Danielle back to life, but, of course, I think, considering the facts that it was obviously a murder, and not a manslaughter, that man should have got even a harsher punishment than thirteen years in jail.

The shaking fire feature on the rifle is so if there's so many enemy's that your shaking in your boots it takes them out for you.
The scariest thing to me is that in controlling and abusive relationships, people will honestly believe that there is no way that their partner would actually kill them. Unfortunately, the signs leading up to murder could be so subtle...until it becomes a tragedy.

Good morning, Dr. Grande! Since he disengaged the safety on the weapon and then pointed his gun at Danielle's head and pulled the trigger. If he was angry about her "playing around" with that friend of hers, I'd agree with second degree murder as the verdict.
I'd say that they were too young and too emotional to have gotten together in the first place and would have ended up like so many other kids who married in haste had Skylar not ended it before they got any older.
On the other hand, he'll only be thirty-four if he serves the max in the slammer.
And there will be a lot of women waiting for a man like him when he gets out because he'll be single. Never mind the fact that he killed his wife to get that way.

I realize the following theory may be relatively unlikely, and obviously is impossible to assert without a confession. But I think it could have been used as a strategy to press for manslaughter:
While Danielle was looking at the computer, drunk and angry Skyler pointed the gun at the back of her head with the intention of mimicking the act of executing her, with no intention to carry out the act in reality. With is inhibitions lowered and motor skills decreased, he underestimated the sensitivity of the trigger, and accidentally fired it.
I have no compassion for Skyler and am in no way trying to defend his actions....just floating this idea out of interest from the legal perspective.

No relation to any of this but a handful of years ago in a store I overheard a young woman excitedly detailing all the steps of her husband's military career, like every place where he would be stationed until his retirement and all the things they would do together. And she was really selling it and I figured he must be an enlistment or two into his career. And then, whoa, I heard her say he was still in basic training. She was really getting ahead of herself, like serious fantasyland.
