what to do when current president is not allowing us to register a association post resignation of Treasurer and Secreatary and take hand over. We are living in a gated community.
majority of members can vote to remove the president and appoint new so that proper management can be done
Let us know whether non registered rwa ( applied for ) can issues the receipts against monthly maintenance charges or is it illegal .

Thanks for such an informative video. I would like to know, we have a 360 flats apartment and the builder has taken maintenance money for three years. Not all flats are occupied, about 25 flats are unsold and about 75 flats are yet to get registered. About 230 flats are occupied. In such a case, can we form the association? If so, do we need to take elections before heading for the official formalities? How will new owners (for unsold or non registered flats) join?
Can we form an association first and then take the election?

Ours is a new gated community.Assn Red under Societies Reg Act without submitting by-laws. Some members objected to this and as a group demanding reg under Mutually aided co-operative Societies Act.
But there is also AP Apartments (Promotion of construction & ownership)Act &Rules,1987 and after division of AP State ,The Telagana State govt adopted this Act vide GO MS No 45 dated 1-6-2016 an gazette notification made.
Now the question is whether our registration is legally valid or not.

As per my opinion yours is a valid and legal association however you need to submit your bye laws and get it updated as per the existing law of the state in order to avoid any further dispute or objections.

To verify whether a Resident Welfare Association Ask the RWA for its registration certificate and Visit the local Registrar of Societies or check their online portal and Look for the RWA in public records or official databases.
If the RWA is found to be fake, Report to the local police station, Notify the Registrar of Societies about the fraudulent RWA, Consider legal action through a lawyer for misrepresentation or fraud
