    Lake Jackson deserves NO commendation. They created yet another gypsy cop and taught another cop that nothing all that bad happens if you stand by and do nothing while your partner flagrantly violates the law.

    "as of this morning, BEFORE CONCLUSION OF THE INVESTIGATION, we accepted the resignation" and "We are also in consultation with the DA for confirmation on whether the actions of the officers rise to the level of criminal responsibility"
    That means he gets a general discharge, but had they concluded the investigation and fired him, or had to charge him, then he'd be looking at a dishonorable discharge... They knew the outcome of the investigation and let him resign, file the paperwork, then they complete the investigation that proves wrongdoing, then file the charges, and none of that goes on his record which allows him to get employed elsewhere and maintain pension and benefits already gained.
    Why not just arrest him, charge him, and then let him "deal with it in court" like they do when people don't even commit crimes? They're not as commendable as you'd like them to be, but it's better than a total cover-up and excuses with union backing.

      May I highly commend you on your well-worded response. You reflect my feelings 100-percent. I will again say that this activity is the reason policing in America should be completely dismantled brick by brick, redesigned and rebuilt.

      Exactly, think about it a police officer simply have to know certain staues or call his supervisor to clarify. Police officers get Qualified Immunity for not knowing anything. Yet citizens are required to know all laws or random statues and ignorance of the law is no excuse, even if the statues and laws are not published. All recourse for citizens are extremely costly.

      That's what most bad cops say when they commit a false arrest, "You can deal with it in court". I agree, cops should get the same treatment and be told the same thing, but we know they look out for the bad cops and do them favors.

    They always say, "Don't talk to the police" because anything you say can be used against you. Here, the cops do a lot of the talking and THEY incriminate themselves - they say they don't want him on the "accident scene" yet one of the cops, when told to go back to the accident scene, says "It's over!" So therefore the was no accident scene, so no reason for to leave the "accident scene" that no longer exists! And as usual, the cops take their dear sweet time "investigating" yet they take no time in arresting a citizen.

      "appropriate action" is not letting one resign and giving the other a vacation. "appropriate action" would be enforcing USC 18:241 and 2.

      Correction...Turner v. Driver didn't have an impact nationwide unfortunately. It only covers states found in the 5th district I believe. Since Texas is in that district it covers a lot of people but still only a fraction of the US population.

    Thank you, Phillip, for providing a very professional update on this incident. While it is somewhat encouraging to see PROMPT actions by the department’s IA, I couldn’t help but notice the press release did not mention what the specific criminal charges are that they referred. Was it false arrest, assault, kidnapping, excessive use of force? Had a citizen been arrested and charges referred for such offenses, press releases typically include those details. The public has a right to know. Perhaps your excellent research capabilities can find out. Well done, Sir! 👍👍👍

    It’s good to see that this department didn’t just say the officers were following procedure and did nothing wrong. The department took immediate action, but this could have been avoided had these tyrants followed the law and not let their egos overcome their duties as LEOs.

    I spoke to them a few days ago. The officer I spoke to was very cordial and responsive. I spoke to them about the importance of being aware of law as law enforcement. It's important to have an understanding that policing is public safety, not the generation of revenue for the state.

    A public apology by the officer on camera to the victim should be a part of any resolution. If they can’t do that, they lose their man card until they do. I can’t respect people who do not live by the code of “owning your errors and attempting to make amends.” They aren’t even human in my book and deserve no acknowledgement.

      @@mehameha4453 Getting an apology that is genuine would be better than forcing an apology that has no meaning. Kind of like an abuser who apologizes after abusing their victim to save their back side then do it again later. In this case you aren't getting an apology because they truly feel they have done something wrong but rather because they were caught and called out on it.

      @@cajunrandy2143 the city does apologize “for” the officer almost 100% of the time. Like having your parent apologize for you. When you are an adult, whether you mean it or not, you should be forced to apologize in person on camera while looking at them. It may not mean anything but it is at least more than what they do now. They should be given a choice. 1. A public apology or 2. Sign a statement saying they refuse to apologize and agree to pay damages to the victim or the victim’s family as well as giving up their right to ever be a Law enforcement officer or a private security officer in the USA. Nor ever hold public office.

    Now for all of the BLUE LINE supporters out there. This is why the Auditing community do what they do and why I and others support their efforts. I am sure I can speak for the masses of the Audit supporters and the like that we DO NOT HATE POLICE. We HATE tryannical, ignorant, egotistical police. If you cared enough to educate yourself, look in a Black's Law dictionary and you will not find that word. However, you will find sovereign, n. 1. A person, body, or state vested with independent and supreme authority. Let this video be a testiment to those Police officers and supporters of the Thin Blue Line that we Americans support the Bill of Rights and will defend and expose the corruptions that continue to errode our liberty. The more and more we expose corruption, it becomes more and more obvious that policing in American takes on a gang like persona.     Mr Turner, I truly believe the cases you present, especially Trurner v Driver, should be condensed in a classroom text book to be a required course at the police academys and as a law school course. The way he recited your case with respect, could help change the landscape. Here's another idea. Put together a package for sale with the best cameras and editing software to bring amateurs in play. The cell phone is ok but with your experience you can offer the best equipment available.

    This is great news and I salute this police department for taking the proper actions.
    I still have concerns about cops investigating cops. However this was definitely a step in the right direction.

    Note, it took less than 5 days to implement and investigate and come to a decision in an internal affairs investigation. Fantasitic effort by the police force. But it begs the question why does it take others months to do the same?

    Police were originally installed to keep order in society. Over time they were also incorporated into a "social contract" which effectively gave them an additional level of respect (a.k.a. power) in the community. That level-up created a situation that allowed effective policing of the community with fewer numbers of officers. However, over the following period of time, the "social contract" has been subverted into a fascistic hierarchy that allows ego over policing which then gives us these infamous scenarios referenced in the video.
    All of the actions of 1A auditors are intended to "rewrite" or even rescind that "social contract". As power is once given, it so shall be revoked!

    Thank you so much for this update…..and your follow thru is spectacular.
    This city and Its police department should be a shining example to all others as to how to quickly handle a misconduct by its officers.
    When they provide justice and fairness to the public , the public in turn will be supportive of them. This is all that the public is asking for by way of the auditors. Just think , the quickest way to make auditors obsolete is to behave justly with the public, then their would be no need for auditing. But as we know……that would never happen voluntarily.

    All it takes is one District Attorney and anyone can be above the Law by his discretion. They get to decide whether or not to prosecute. Imagine if the DA was automatically charged with whatever crime he refused to prosecute. That would end a lot of corruption.

    Well done auditor! Thank you for your commitment to make a positive change even when it is not easy and obstacles work against you. This event is a good example of how auditors and citizens can work with law enforcement to achieve a positive outcome.
    To the IA and officers of Port Jackson, Texas police department thank you for taking swift action to address this situation. Clearly you have a significant workload. However this situation was made a high priority and timely action was taken. And in the process respect for the public was demonstrated as well.
    This is an excellent example of how to handle such a situation. In fact the manner in which this was handled is the best I can recall seeing over the last ~18 months, though others in this forum may disagree.

    Great update. Your work behind the scenes is fantastic. The letter showed a decent outcome - as you said, police investigating police is always tricky. We have had that happen where I live - oh boy!

    I have serious respect and gratitude for law enforcement. I've had my ass saved by cops before. But nothing boils my blood more than someone using their power as a cop to violate someone else's rights. There is just something infuriating seeing these clowns seem so sure of their incorrect understanding of the law with the benefit of hindsight, knowing that what they are doing is sealing their fate and will ultimately result in the end of their careers as a cop. There's also something seriously satisfying about seeing a bully with a badge dig his own grave.

    The real issue is that the cop that resigned will just go to a department down the road and pickup right where he left off. The press release failed to say that the cop was going to surrender his license which means he can be rehired by any other law enforcement agency. He keeps his pension he has built up so other than taking a few weeks off he really lost nothing. What a load of BS.

    We have to continue to document and film all public employees for transparency. This actually needs to be brought to the legislature for more transparency within our government and a reasonable fee structure for FOIA. I hear some crazy stories about rates and fees to discourage our rights.

    This is great news!!!!!!!!! This PD was actually quick to admit that the officers were at fault, which is better than a lot of them that ignore the problem or try to cover it up.
    I hope the FOIA request gets the body cam footage before it gets “lost”.

    I hope the dude sues and use that press statement as an admission of wrong doing. Those cops were acting like thugs. And this is a unicorn where cops investigate themselves and find wrongdoing.

    It's imperative that you follow up on this. The agency allowed the officer to resign instead of firing him! Pressure the DA to file criminal charges! Also the fact that they had one ambulance and gave it to the criminal cop for an injured hand from attacking the citizen. The victim had to ride to the hospital in the back of a squad car.

    The investigation started before the cop was allowed to resign so he should still be held accountable for his violent attack on an innocent member of the public !!! The report should go on his file and be stated when and if he seeks employment in another law enforcement agency !!! This cop should be prosecuted and sued for the violent attack !!! After all ignorance of the law is no excuse !!!

    I want to commend Lake Jackson Police department for moving so quickly to discipline The officers involved. Too many police departments are throwing it on the back burner. Hoping the public will forget about it

    Statute,Code,or Policy is Moot....any conversion of said policy to a crime and applying it to a Man or woman is unlawful and clearly acting under the Color of Law if no harm(a crime) to a person or property exists.

    The problem with the system is officers are given the choice to resign to get out of the situation they put themselves in.
    Like it’s a requirement to spend time at the G** range it should be a requirement to spend time in the Law Library learning the law.

    Why is it when cops are ignorant of the law, they get to use it as an excuse. If I am ignorant of the law, why don't I get to use that as an excuse. Tax code is HUGE but if you are ignorant of it and make a mistake, does the IRS just let you go with a strongly worded reprimand??
