    This speech needs to be segmented and explained in simple terms to school and college students to build a dynamic and robust democracy for the future.

    Nowadays we see such speeches only outside courts and that too from "Retired"

    • @raajathalapathy8461
      @raajathalapathy8461 Před 6 měsíci +3

      You need to understand the importance of it.
      It is not that they cannot do it while they’re inside the court or before their retirement
      But, it is the due respect given to the institution of Supreme Court.
      It’s a balancing act between giving respect to the institution & critiquing its flaws.
      If the people who are inside critique while they are sitting over there, think about the public perception of SC?
      But on the other hand, if the Justices who have been there & seen it all don’t point out the mistakes committed who else will?
      So it’s a rather balancing act than a conscious decision to go against the very Institution they belong to.

    True sir, not sure where is this Nation heading to ? Lack of wisdom, spinelessness, no determination in upholding constitution, the character of judiciary is worrisome. I wish entire judiciary of India watches this and have some sense of justice delivery system and constitution of India.

    TN Seshan is remembered for electoral reforms. He was appointed CEC by minority Govt backed by Congress. MS Gill is remembered for introducing EVMs. He was appointed by minority UF Govt backed by Congress. Gill went on to become Congress MP and Minister. So shall we cancel Seshan’s reforms and banish EVMs?
    Opposition was not consulted earlier while selecting ECs. Now as per the new law brought by Modi Govt, Opposition will be consulted.
    It is not expected of a retired Supreme Court judge to indulge in sweeping and shallow political statements lacking in both reason and logic, apart from being devoid of facts and reality.

    I have seen judges giving lectures in seminars but doing nothing to safeguard therights of people to live with dignity when in power. I have filed cases in Allahabad High Court for exclusion of cerebral palsy candidates from teaching opportunities in higher education. On one hand Central Government allows people with cerebral palsy for assistant professorship but on the other hand State Government of Uttar Pradesh is not abiding to it, it is close to 2 years now and the case is moving very slowly

    Inshort Solutions are with Forums and Tribunals lead by independent minds well Justice advocated for Retired Judges by Bar but must also include other fields relating to justice i.e. legal researchers and advocates.❤ Lectures and Speeches aren't enough therefore these "lecture" speeches outside the bar and bench be specific and bidirectional dedicated sessions including with civic forums , symposium, talks, workshop but be specific as with lecture which lacks and doesn't become behavioural and participatory but the same authority seeking(though they are against authoritarian regime and little anti establishment of religion and politics) nature which we try to avoid and just agreeing or disagreement on the propositional nature of contemporary cases which isn't enough and not looking at the larger larger picture i.e.beyond criticism and educated solutions and towards the nature of cultivation of institutional nature of thoughts towards Constitutionalism, as law making isn't a just solution and neglecting emotional structures, the socio-economic nature of laws and including the social morality in the debate which isn't considered in writing judgement as aren't legal but important in life and concepts of justices.

    Instead of going by majority why can’t President asks for one representative each rather than go by majority and hear them out in a debate . And then come to conclusion ?
    In any case do we really need governors ? Other than mischief making what else are their work these days .

    these honorable judges are always refering to foreigners' works mostly the whites. But most brilliant era and literature that is native to Bharat none of them read . Immense knowledge is there in Indian lumiraies of past. Most of this is in Sanskrit and most of it is burnt down by Muslims who did it to every country they invaded. But still some literature and some luminaries of India's knowledge is still available. But the Congress government hid it. Hope In future our native cul true and jurisprudence will come to our people.
