    The judiciary is the problem we are having in this country, the way they made 25% of the Abuja made a mockery of the Judiciary.
    Under Thiefnubu the democracy has been truncated and turned to dictatorship. Wike is doing the same thing Thiefnubu is doing to Nigeria in Rivers State. We will one day wake up to hear the Supreme Court saying the defected law makers still remain in PDP.

    Section 109 (1) (G) of the 1999 Constitution of the Federal Republic of Nigeria states:
    "A member of the House of Assembly shall vacate his seat in the House if... (G) he becomes a member of a political party other than the one on whose platform he was elected."
    In essence, this section mandates that a member of the House of Assembly must relinquish their seat if they switch political parties unless they were originally elected as an independent candidate.
    According to Section 109 (1) (G) of the 1999 Constitution, the 25 pro-Wike members who resigned from the Rivers State House of Assembly have indeed lost their seats by operation of law.
    The Appeal Court's judgment has contradicted this constitutional provision just like the Supreme Court's kangaroo 🦘 judgement in the 2023 Presidential Election.
    However, the Constitution is clear on this matter, and the Appeal Court's judgment deviated from the constitutional requirement.
    One may allege that the Nigerian Judiciary is an agent of the Caliphate Government of Nigeria under the illegitimately imposed 1999 Constitution.

      @ninasvoice Let us not get the judgment of the Appeal Court wrong. The court only stated that the State High Court does not have the jurisdiction to handle the case. Therefore, it nullified the ruling of the court.
      While this is an interesting twist, which, in my opinion, is an infusion of human technicality in legal matters, the supreme court will rule on the jurisdictions of state high courts on handling domestic affairs.
      Meanwhile, there is no contestation over the loss of seats by the 27 lawmakers who defected. They are gone, and nothing can reverse it.

Kudos to political science students, our judges has made us to respect your faculty more than faculty of law. Once again kudos to our medical practioners no open wayo in your work

    How can one leave a political party without formally resigned from the party .
    There should be formal communication in writing to the ward executive of the person who intends to resign . In this case , it was done and court should be allowed to decide on this matter.

      Make no mistake. The Judgement of the Appeal Court is only saying that State High Courts do not have the power to make pronouncements on vacancies, and this means ALL the States High Courts in Nigeria. The Appeal Court did not, and at no time, say that the former rivers state legislators seats are not vacant, per the constitution. This constitutional infraction cannot be remedied or cured. Please, I challenge anyone to show me in the Appeal Court judgement where it says the former rivers state legislators seats are not vacant, per the constitution.
