  • Deferred adjudication is a type of probation that helps you keep your record clear if you finish your supervision period successfully. But if you violate, you can go to jail for a much longer than you would with regular probation.

      I think you mean Motion to adjudicate if I'm not mistaken. When you first get deferred adjudication type probation it simply means the judge has postponed a finding of guilt. So if you finish the period of supervision successfully, you will not have a conviction on your record. Hence "deferred adjudication." Motion to adjudicate is when you have violated some condition of your supervision and the court is now going to move forward and make a finding guilt. It is similar to a motion to revoke probation. When you are on deferred probation you don't have a conviction yet. When you are on regular probation you do have a conviction. I Hope helps.

    Can a small traffic infraction violate deferred adjudicated probation can IV sensor the Lacs on any traffic violation like a tail light going out while I'm driving

      It you be very unlikely that a traffic violation, (especially a non moving violation like a tail light going out) would cause you any problems with your deferred adjudication. The only time it would is if your deferred prohibits you from driving in the first place. Good Luck.

    What happens if they never told you about the the sentencing stipulations ?

      Are you referring to the admonishments the court should give you if you violate? If your attorney or the court does not properly warn you of the consequences of violating your probation, you may have a claim of ineffective assistance of counsel against your lawyer or an involuntary plea. The court should always warn you of the what will happen if you violate your probation.

      @THEFEDORALAWYER Right. Never explained about the possibility of serving the maximum sentence allowed by law. Can they stipulate no early termination on felony deferred adjudication?

      @@calliemerritt3004 I have never heard of them stipulating to no early termination. In most states, only sex offenses have no early termination. Otherwise, I don't know why the court or the prosecutor would make that stipulation. It benefits no one to do that.

      The judge have you plea guilty before he/she give you a deferred probation.

      @@eddieb608 Yes you plead guilty first. But you work out the agreement with the prosecutor to get deferred ahead of time so you know that you will get deferred. The Judge cannot surprise you and not give you deferred once you and the prosecutor have agreed to it.
