I really appreciate that when Judge Judy learned she had misunderstood the situation, she made a point of retracting her earlier comment. She could have just ruled accordingly without specifically mentioning that, but she went out of her way to make that right. If Judge Judy can eat her words when she gets new information, we should all be able to.
Well she did say unless you have a contract right after making her comment so she didn't really need to say anything else but it was nice of her
She did the right thing here despite initially trying to shut the lady down. Sometimes she is too impatient to listen and is plain rude and gets things wrong. Her age has caught up with her but nevertheless in this case she got it right.

She only did what she did because her granddaughter, who is a new attorney, is sitting beside her.

Judge Judy attempted to solve the case without understanding it. She was talking about a bunch of irrelevant stuff at first.
Why did this man and his wife waste the courts time? They agreed to the terms and then stiffed that poor lady. I’m glad judge Judy did the right thing.
It's kind of a mystery, isn't it? They don't look like deadbeats either.
They decided to see if she would actually sue.
I actually think that they didn't realize that those text messages (if one knows business law) constitute a binding contract. Everybody should take Business Law in HS if they can, or in college if they can't. It was one of my most useful classes that I every took dealing with lifelong experiences.
When they edit these down for youtube they seem to cut out some of the original program. I am not saying they had a reason, or a good reason or even a bad reason but perhaps in some of the parts that didn't make it to the final here they may go into some detail about what case they may have thought they had.

Technically JJ didn't have to retract her statement, because while she did say, "You're not getting any money," she eventually went on to say, "unless you have a contract," which the plaintiff did, so JJ didn't make a false statement. However, I love that she made it a point to clarify anyway. It's a rare display of humility from her, which is nice to see.

It's not humility. She doesn't rule out of ego anyway. It's her indomitable sense of justice. That's why she's one of a kind, and no other judge matches her, except perhaps judge Caprio (being on the lenient side).

It’s a VERY rare occasion when Judge Judy openly admits that she’s wrong - and provides a form of apology. Well done to the plaintiff for providing clear evidence of her position.
All three of them should know exactly WHO wrote up the contracts and the name of the Company. They make it sound as if the paperwork just magically appeared and no one knows where it came from. Good thing the Plaintiff had those emails.

In actuality all Judge Judy had to do was read the contracts first. When it came down to it the questions she was asking were irrelevant.
This one should be played for all the haters who claim Judge Judy comes in with her mind made up already.
Historically yes. Now she has her granddaughter sitting there beside her so she has to make an effort to be a fair judge.

Well if she gave them a chance to speak sometimes instead of saying just a second all the time a lot of cases she does it wouldn't take so long for them to tell her what she's asking them...its frustrating to listen to when she does that

I did a little research and the house went on sale in 2023. The lions are still there and they are magnificent. It appears there may be a new Mrs.

A good takeaway from many a Judge Judy episode I've gotten is *never rely on a verbal contract.*
Thankfully, intelligent people already know that.
Verbal contracts involving real property aren’t enforceable
In the UK we fill out a form stating what is staying or not, or for sale at an additional cost. This includes things like curtains, blinds, kitchen items (washer, fridge etc.) and also asks about garden items such as plants, garden furniture etc. It's a very good idea, and there is also a space in each section to mention any extras, such as Lions 😃
In 2021 we sold our house in Scotland. Any piece of furniture that we could not bring with us to Portugal was given to friends and the new owners, which the latter happily accepted.
We bought a house many years ago which was supposed to include the garden shed. The seller claimed it wasn't included but would sell it to us for £500! It was an old shed, so we declined and told them they could come and collect it, knowing full well they'd has to dismantle it and would need a large van to take it away. We kept the shed for free 😅
The same is true here in the United States. I'm about to take the real estate license exam and am horrified they didn't hire a real estate attorney to handle their closing. Most people do.
@@scribe712 Well, I was horrified to hear that the 'closing' fees were around $12,000 ‼️ Fees in the UK are usually percentage based, and range from about 2% up to about 5% - so the higher the value property the more fees you pay. Some agents charge a flat fee, and where I live, in the north of England, we have a row of about 5 Agents all competing for your house, so fees go from £899 (inclusive of vat) up to around £1,500 + vat.(value added tax). Only big houses would incur fees like £12,000 🥺🥺 but then all houses in the States are 'big' 😃
The defendants wanted to play dumb about everything because they knew they were wrong. They still didn’t have to pay for the lions because the show actually pays the amount awarded.

Unfortunately, the damage was done and long lasting. She has people thinking the defendants and plaintiff did something stupid with the sale of the house when in fact it's the opposite, they save money on lawyers. And this all while the entire case is really about the sell of the lions.

Anything that can be removed is a FIXTURE and is NOT included with the sale of a property. That's how it works. You would have to write it in otherwise.
You are using the wrong word: A "fixture" is something that is affixed to an item.
A real estate fixture is any object permanently attached to a property by way of bolts, screws, nails, glue, cement or other means. Items like chandeliers, ceiling fans and window treatments are generally seen as fixtures and will stay with the house in a real estate transaction.

Wow, Judy made a mistake and owned up to it.
I know somebody who bought a house and the seller listed fixtures (like chandeliers) with price tags. The agents had to tell him they are considered part of the house. Anyway, when they closed, he had removed them.
I know the buyer's didn't pursue it, but I also found out why years later. They got the house for less than half the asking price. The couple who owned it were divorcing, and the house had dragged the case out for a LONG time, to the point where the judge was sick of them. The buyer and their agent presented a non-contingency all cash offer. The judge took a look, said "sold", and banged his gavel.
The couple got an expensive lesson in why you don't piss off the judge.

Sean and Shalla Melton took the woman's lions, and then didn't pay for them!! I'm so happy this old woman sued them, and got justice.

I bought my house right before covid. First time. We didn't have a lawyer either. Never knew it was a thing. Will have one for the next house cause oh man. We had 5 gas leaks and a broken water heater that "passed" inspection. It was a nightmare as there was also an issue with rocket mortgage dropping the ball for a month! Though we did agree to 169k and because of all the issues we got it for 134k.

I hate to hear that you had so many problems with a first-time home ownership. That had to have really soured your opinion on home purchasing. Just remember this - it’s a building, it’s made of concrete, wood and glass, its purpose is to keep a roof over your family’s head. All that being said, what makes a house special is the faith, family, love and joy that comes from the hearts of the inhabitants!
@@Kaloufie Studied real estate in the 90s and again, a few years ago. I assumed everyone used an attorney to handle the closing when purchasing real estate. To me, it's common sense. But I guess if everyone had common sense, people like JJ wouldn't have a job. LOL

It's not common for JJ to admit she made a mistake. This plaintiff may not have been astute to write a formal contract for the sale of the home but that email saved her case. Those defendants are scammers, they wanted something that they didn't have the money to buy and they hoped she would just throw her hands up and go away.
In the end the contract for the sale of the house was satisfactory once Judge Judy finally took out the time to look at it and let go of her preconceived understanding of real-estate sales.
Obviously the defendants are okay with being the type of people to go back on their word, that’s embarrassing to have all over the internet and on television.

JJ must have dealt with 100s of cases where the plaintiff only wanted money but in this occassion, its the 1 case where its a genuine contract so I can see why JJ was initially assuming it was the usual and its good to know when she realises she made a mistake, retracts the statement .

When we bought a house there was a beautiful statue in the garden but when we went to move in it was gone. The owners told a friend they could take it but they should have taken it before the house was up for sale because I was disappointed to not see it there.

I practice law in New Hampshire, and the way that real estate agents handle transactions in that state is disastrous, they make every effort whatsoever to keep attorneys out of the process, and they all engage in the unauthorized practice of law by drafting and advising on contracts.
Pretty good gig for the shady defendants. They get to keep the two lions and the JJ program pays the plaintiff the five grand.

When I bought the house that I live in now there were a few things in the garden that the pervious owners said ''didn't come with the house'' and ''I would have to pay for them if I wanted them'' (the garden furniture, the garden shed, the barbecue) so I said that I didn't want them .. and when I moved in they were still there, so I got them for nothing anyway.

A somewhat tedious sort of case, but always welcome a break from dodgy tenants and bad break ups and people getting into car accidents with no insurance 😅
It is more than likely that the Lions came with the property. If the Gentleman had not written to the seller, he would have got them anyway. I am kind of sympathetic with the buyer and I think the plaintiff saw an opportunity to make extra cash. Sometimes inaction is the best action. The judge had to go with the Law. So verdict for the plaintiff.
Clearly the defendants tried to take advantage of the plaintiff. Not cool!

I laugh at people doing their own home sale, having problems and complaining about it all.
In reality there wasn't a problem with the sell of the home. Judge Judy's initial questioning made it appear that way, but all she had to do was read the contracts. They were ironclad!
So they should have paid 40 to 50k to avoid a dispute over 5k lions? Maybe not.

As a former realtor, never deal with a FSBO, for sale by owner. There's too many headaches on both sides of the aisle l. People always believe their property is worth more than it truly is, walk away.

This could have been avoided if both parties had representation.
It wasn't really that deep. The defendants just didn't want to pay for the lions as agreed. Judge Judy made it seem more complicated than it really was.
