GW is the EA of miniature and tabletop wargaming.
Yet if you go to the average FLGS and try to get tabletop wargamers interested in better games (and I mean pretty much any war game out there has better rules than 40k)- they look at you like you're insane.
"No man I'mma just play 40k"
And they'll just bend over and take it. The average 40k player is a literal catamite, that will take it up the fart pipe and thank GW for it.
Mockery should be used at every possible opportunity.
And I say this as someone whose favorite game is Necromunda.

Given how GW are starting to produce the old WFB kits again for The Old World, I can see them clamping down hard on anything that can impact potential future profits.
@@Gorbz They would have to demonstrate in court that they had imminent plans to restart production of the figures in question, not vagueries about potential ideas for the series they might do in the future.
@@KdogPrime I'm sure they could pull up a plan, but if they didn't have one then they can easily cliam infringement on AoS, as that used the WFB minis at the start. Sure they are not used now, but the argument could be made by them that the sales of AoS is impacted. And it sucks balls.

@@nicwelch You could sit here all day but just off the top of my head aspects of the tyranids design are stolen from Aliens/H.R Giger. The Alien Queens head crest has also been ripped off directly on one of the tyranid designs. The Necrons are a rip of Terminator. The bikes the space marines ride are lifted directly from Judge Dredds Lawmaster bike. Any number of Star Wars references. Mech Warrior. Tolkiens Orcs or the concept of Orcs... As I say you could sit here all day.

Yep. A ton of modern sci-fi just copies and modified aspects of older sci-fi. Unlike fantasy where everyone just blatantly rips off Tolkien (which GW managed to do as well) sci-fi rips off a variety of sources and only a small fraction of Warhammer stuff is actually original. Lots of concepts from Dune, Starship Troopers (besides aliens I'm relatively certain that's the concept origin for Tyranides), and various other IPs. And then they get pissy when anyone takes their stuff and does something cool with it, as if that's not the foundation for the entirety of their IP. Even when said people aren't making money off it. It's gross.
So litigiously protective of their IP yet they seem to give it away to any third-rate videogame dev to make endless crappy games with their name on it....
Games Workshop are scum and I don't give them money.
GW sell their IP to almost anyone, and they don't care because they have been paid. Same reason they have been lax on scalpers, they already have been paid.

Yep, GW has as much money as they want compared to him and they can draw this out for as long as they want with extensions and such until the other party runs out of money is completely bankrupt, and is forced to settle on the corporation's terms.

Probably the case. My understanding he ripped models from the Total War games, touched them up to make them printable (not a small amount of work) and was giving them away for free, so GW probably have a stronger legal claim than your average 3D modeller who is just making something that kind of looks like a GW model with a funny name.

They were probably expecting him to put up some resistance which they could use as justification, but are still so petty as to go through with it anyways when that didn't work.

I think previously GW have come down harder on people selling STLs rather than offering them free. But it maybe seems they're trying to do the Napster thing of claiming some insane damages as if everyone who downloaded his files would have bought some other GW product.
Unfortunately, I can't boycott GW any harder than I already am.

What actually are scarce resources that are owned are the minds and skills and physical capital resources utilized to produce things that make use of an idea. The enforcement of IP laws are negative restraints upon the actual physical wares that other people own, from a party that claims to have first claim of use over a non-scarce concept or idea. It’s a racket set up by government court and bureaucracy to practice tyrannical rule in the imposition of spurious fines and fees. While there’s a theoretical argument for why IP law exists to protect creators and innovators, the reality has shown that all of the time the effects of IP law has done the opposite. legal claims of misusing ideas result in causing real financial damages to innocent parties, through a guilty until proven innocent process. It has been an inhibitor and a restraint upon skilled and knowledgeable people from making more creations or innovative improvements to ideas. At worst this should be a civil dispute and not a criminal dispute.

Even if he wanted to he cant/would be thrown out, his logo was just the arrow compass rose (a symbol he cant even trademark as directional compass symbols are not subject to IP protection, only taglines and florishes on them are).
It took up to the D&D art (iirc made by TSR artists no longer even alive) to add the circle and damage to it that GW tilted for the chaos factions and Moorcocks publishers ruined that cooperation despite him at the time sniffing his own farts far less and giving full rights to use the EC collection thus far written.

I also blame the people that still spend thousands of dollars on their plastic. They are getting scammed with prices that were unacceptable 10 years ago and they still purchase.

@@EmanGameplay Pretty much how mobile games work. Too bad the practices they used for whaling also spread to other games/platforms. Its mainly the reason why Mxt's/lootboxes etc, have been tied with gameplay in so many games these days.

All the courts need is one judge to establish precident and then other judges to agree with said precident.

So the litigation process is just the equivalent of pinkertons. You can try and fight them off but it'll definitely cost you.

I decided to start working on my own IP for this very reason. Something completely under my control that I am deeply passionate about.

Figure I could offer maybe a little more context since EmanG either can’t or won’t on his behalf without potential repercussions.
The files he offered where indeed modified (in some cases heavily modified to fit the correct loadout for table top) total war Warhammer models which indeed where free to download. However a pre-supported version of these was added in as part of his patreon (the files instead of needing to have supports added in the 3d printing software to print properly by the users would come with supports pre created) this SEEMS to be what GW had an issue with which is more then justified. However one of their initial arguments was that he was being deceptive in offering them for free as the files are useless without the supports. This is at best a lie on GW’s behalf as adding supports is rudimentary although copyright infringement claims are more than valid in this regard.
Although GW definitely has a case on the copyright being violated their other arguments are significantly more flawed. The designs are in several cases a one for one from the video game. but look nothing like the official GW sculpts as those go for a more cartoonish design philosophy to the point the two designs look wildly different, have a completely different scale, and most don’t even fit on the proper base they are required to in order to be usable for a game. This then combines with the sculpts he made available had been for the most part for units that either haven’t for a long time or never had rules or an official model available although some most certainly did cover units that do have current support and could in theory deny GW a sale.
Effectively long story short GW did have a legal right to demand these be taken down, but then tacted on several bad faith arguments and behaviors to its demands that go beyond the realm of justification at least in my eyes. GW won a minor legal victory and in turn looked like a jackass in the process.
While some of the models (dispensers, steve irwins mortal enemy of a changing NERD bird, etc) were 100% rips just by unmodified verts, for most there is still the need to prove that they were, in which case GW still has no right to sue as Total War games are made and all work for hire done by artists goes to CA.
As CA in game designs are not 1:1s of the GW models and art, along with copyright requiring exact execution, the case is entirely bad faith and malicious thus should have been thrown out in prep for discovery.
He wont tell because to do so would prove his absolute guilt. And so by being vague. He gets all these people on his side because he's obfuscating the truth period.
GW deserve to lose all of their IPs to a superior organization...which seems to be most of them.
Never forget that GW also killed all the fan animations during an upswing of public sentiment no less, for Warhammer+

This is not something unique to games workshop as much as they like to make out that this is such an evil company. Most companies take steps to protect their IP and will sue over stuff like this. He ripped assets from one of their games and was profiting off it. He has my sympathy but honestly he made his bed and now he has to lie in it.

we need to reform copyright law in general. It only gets used as a cudgel. It doesn't actually help artists or support them in any way. I had my own original songs copyright stricken by a person who hated me. There was no recourse.

GW is at it again. Really, it never ended.
GW have damaged themselves. Their endless litigation (Spots the Space Marine anyone?) to protect IP, itself a Frankenstein monster of many others, to claim "Intellectual Piracy" is pretty laughable and it's inherently a dystopian idea, at least to me. The reason people like EmanG are designing minis is because of GW's greed. Any successful company has to deal with imitators, 3rd party copies/parts etc. Countless imitations are made of movies, games, songs, auto parts, fashion brands etc. In GW's case their greed has more or less 'forced' players to go to numerous recasters and now 3D printing is making proxies go insane, set up by the failed Chapter House lawsuit.
GW have created the perfect conditions for "intellectual piracy" to exist. If more and more people love Warhammer but hate GW it will only continue to drive sales away from the company. The reason it's so profitable is because they've overcharged for years and peoples passion for the hobby/setting meant they would still pay. Time will tell if that changes. I certainly think it has now become unaffordable for many, especially as older hobbyists have families and newer players are more likely to look at the cost of entry and either leave then and there or seek cheaper alternatives.
This said I know EmanG's designs and he flew far too close to the sun, a slight change of style was needed across the board, not just a different name for stuff. I wish him well but I don't think he has a legal leg to stand on.
That GW employ soneone to constantly seek out recasters and 3d designs and groups online shows the scale of the problem they in no small part created. If they weren't such corporatist dicks, I'd feel sorry for them.
It's such a shame that they no longer foster creativity within the hobby (unless its kitbashing their product) and have taken an elitist view of their product. They could easily release a budget range, encourage people to make their own terrain or provide free pdf paper templates, start putting older designs remastered as stl files online and sell them, make coloring books, have their own official wiki, sell sanctioned cosplay designs, sell high quality scans of former paper products etc. For a company that values its IP so highly, they've done precious little with it to capitalise on its popularity which is why others have run off with it - it's a simple case of demand and supply and GW have failed at the supply, quite literally, for a long time now. It's so frustrating and I feel totally unnecessary. I equate them to Smaug, sitting on their golden IP doing nothing but when someone takes a coin they go a bit scorched earth. They must have lost so much custom with this bs attitude they have. It's such a shame when I think how great they could have been. But no, I think the spirit of GW died when Rick left and the corporatists took full control.

Just the fact that creatives have to engage in 3d modelling/sculpting IP violations instead of being able to sell their own IP, is you people's fault.

For those of you who aren't fully aware.... he was reselling copyrighted assets from a video game. No one else who has genuinely made their own models has ever been deep in trouble like this.
This is what people don't realize. It sucks for the person that he gets sued but if you stole copyrighted assets for resale from any company they will sue you. There are always two sides of the story.
Warhammer The Old World released in January of this year, it uses (massively marked up) resin models identical to the original plastic and metal miniatures from upto 40 years ago.
Law suits like this are extremely terrible for those caught up in it, but absolutely something GW does every chance they get, and it's not like GW aren't famous for doing this kind of thing.
EmanG should have shuttered shop as soon as the announcement for Warhammer The Old World being slated for release was made public.

Stalling legal proceedings so that the defendant will lose even more money should result in throwing the case out automatically.
If you don't protect IP you can lose it. Including clear derivatives. It's sad as a fan, but this is what happens when our cultural touchstones are actually corporate products.

Not a bunch I'd hire.
About 10 years or so ago, a german group was planning to make a fan movie, non profit and all. GW initially gave them permission.
A while later, it was all done and cut, GW noticed that german laws did not permit a creator to write away their whole rights, even to non profit stuff. Basically, while the setting was GWs, the creators could not hand their actual scripting and writing of the fan movie to GW. Those rights would be retained forever.
GW threatened to sue. Movie was 'leaked' onto torrents.
RIP DAMNATUS.
People really need to just move on from GW. There are companies out there that make much better games, sell miniatures at a faction of the GW price, and don't hate their customers. They're so much more deserving of your time, money and fandom.

To shed some light, it sounds like the lawsuit is primarily seeking to enjoin (legally force) Eman to cease his activities. I doubt they are saying the damages are truly "priceless", but more likely that they are unquantifiable, especially if Games Workshop was no longer profiting directly from the products in question. This is likely to open the door for non-economic damages for reputational harm, which is tenuous but is likely meant to give them a stronger bargaining position and threaten Eman into settling and ceasing all activity.
That is why I am always critical with GW.
Stop giving Games Workshop money. They don't care about you. They hate you. They have for a long time. It's why I stopped buying their products during Warhammer Fantasy 7th edition.
40k 12 years ago was definitely less "balanced" then it is today, but you know what it had in spades new 40k seemingly hates? Customization. Practically every codex had some way of altering the rules of your army to let it play how you wanted it to play...and it wasn't hidden behind dumb as crap stratagems. You're armies special rules were active at all times, not situationally.

GW doesn't give a F about a singular creator. They don't care about him. This is a war against the 3D printing. They want to scare anyone thinking of doing 3D printing. Why do u think they are boosting the prices? In 5 years from now 3D printers will be in every school. They will be so cheap.

I just started WARHAMMER 40k model painting, and this is exactly why I dont get my models directly from GW.
I get mine through 3rd partys that probably give some form of royalties or something to GW sure, but as long as a decent amount of my money doesn't go to them, im happy with that. In the future, I'd like to cut GW out of the equation entirely, but like i said, I JUST started, and im not sure yet how I'd go about doing that exactly yet.

GW has ALWAYS been extremely litigious, and they at least used to love having them sealed after they finished. If you want to really dig into it, look at the boardgame "Princess Ryan's Star Marines", and what it was originally named.

Fun fact, none of these would be tournament legal at any GW tournament. So, not only were the pieces he made STL files for made predominantly for a defunct game, they could never be used in a corporate sponsored function.

In my opinion this is more of a moral question than a legal question. Morally games workshop should not be doing this. But legally they can.

Given that GW is currently repackaging and selling WFB products as Old World kits, I'd imagine that releasing free STL files of those same kits would derail the Old World release somewhat. Is this a defence of GW's policy? Not exactly, but it is a feasible explanation as to why they're acting in this way rather than simply sending C&Ds.
