    Since 1962, the laws have been ‘adjusted’ to keep one group of people in power.
    How should one overcome it?

    GK Sir, your breakdown of numbers and how 'legalised' manipulation of the EQ is an absolute eye opener to the 'democracy' we have had. To the Courts.. Yes and the two options?.. Hmmm.     Fantastic report.. to change to one person one vote.. never today can happen to reverse back to a real fair election.. Why? Many will perceive this as taking away benefit for some part of population... 🤦🤦🤦

    Thank you Mr GK for this very interesting & informative article. No offense to anyone. May I ask why after the extensive research, no one especially the learned & legal eagles took affirmative action to right the wrong. So what was the purpose of the research.

      Why has it not been done before? Not sure. Perhaps no one thought to look at source of the error. Or even if they did, they may not have had a strategy to overcome it.

      Ethnic based malapportionment (subtly implied) has been there since 1954 delineation. Only in 1960, when strict rules of Merdeka Constitution was used for redelineation, this was reversed. 1962 amendments annulled the 1960 fair redelineation. Since then ethnic based malapportionment and gerrymandering allowed the incumbent to stay in power until 2018

    In MA 63 :
    Chapter 3-Parliament, Legislative Assemblies and State Constitutions
    8. In Article 45 of the Constitution, in paragraph (b) of Clause (1) (which provides for sixteen members of the Senate to be appointed by the Yang di-Pertuan Agong), for the word " sixteen " there shall be substituted the words " twenty-two ".
    9. (i) The House of Representatives shall consist of one hundred and fifty-nineelectedmembers.
    (2) There shall be-
    (a) one hundred and four member from the States of Malaya ; (b) sixteen members from Sabah ;
    (c) twenty-four members from Sarawak ;
    (d) fifteen members from Singapore.
    With the exit of Singapore from Malaysia, this gave Sabah and Sarawak 28% of the seats in parliament. Is this guaranteed in the Constitution? How does the EQ relate to this aspect of the MA63?
    Recently it has been said that the 15 seats for Singapore should have been redistributed to Sabah and Sarawak to ensure that a 2/3 majority is not held by Malaya. This would increase East Malaysia’s representation in parliament to 35%.

    On behalf of Tindak Malaysia, I would like to thank you for citing our past research. We must understand the deviation limits of +/-15% of EQ in our original Merdeka Constitution was clearly worded and specifically refers Electoral Quota for the state. EC up to 1973 had the power to add or delete seats throughout Malaya through the provisions of Merdeka Constitution and 1962 (bad time) amendments. Some individuals interpreted the loose terms of 1962 amendments as +/-33% of Electoral Quota. Tindak Malaysia's recent study debunked such myths of +/-33%. It is important we should aim to reinstate clear, non vaguely worded terms of the Merdeka Constitution. Not using 1962 amendments as some sort of reference for wide limits

    If the one person one vote is implemented the Bornea region will have no safe guard against Malaya changing the Constitution unitarily.

      No, that fear has no basis. There are sufficient safeguards in the Constitution to safeguard East Malaysia

      IIRC, to change the constitution a 2/3 majority in Parliament is required.
      At present, Borneo (S&S) has less than 1/3 of the parliamentary seats (about 25%, 56 seats out of 222).
      That is well below the 33.333333333% needed to block any unfavourable amendments to the constitution.
      By your logic, one person, one vote will make it even worse, with only about 18% of parliamentary seats allocated to Borneo.
      And do remember the PDA 74, where Sarawak lost its offshore O&G resources to a federal govt entity, with the revenues sent to develop Malaya, instead of benefiting Sarawak.
      And the Territorial Sea Act, 2012, reduced to 3 n miles (from 12 n miles).
      Pray tell me why the states with the most resources should be the least developed?
      Furthermore, please remember that MA64 is signed between Malaya, Sarawak and Sabah (and obviously Singapore).
      Of course the people in Borneo are very fearful of the shenanigans in Malaya.

    There're alot of unconstitutional amendment made over the 60 years period that shifting the goal post. Whoever wins the next GE will not touch it (with ten foot pole) as the damages has been done (I hope not) and beyond repair rather keeping the status quo. Sandakan has less than 12K voters.
