I’ve been illegally arrested four times in Monterey California in the last 2 years .The female malicious prosecutor Bordeaux told me I cannot go 100 yards within the Monterey police station ,she also said I was allowed to film law-enforcement in Monterey County, but I could not filmThe Monterey police department , I was in shackles at the time. Each time I’ve gone to jail has been 3 days 14 days and 30 days . each time I was on unsupervised probation I got out of jail and started filming them they arrest me .they’re playing games with me and violating my rights. I don’t use drugs and don’t have a drug record. They tried to put me on pretrial probation and the probation kicked me out because I didn’t qualify .they put me on a year unsupervised probation. It is clear they do not want us recording police holding them accountable but they can’t stop that. Anybody that can help Chris with the lawyer please do retaliation is real.

This is true. I went after a judge and exposed him. He retired within my case. No ego, just truth.
This is basically same thing that is happening to me in York, Pennsylvania.
I asked my public defender to file a motion to dismiss, he refused and then I filed a judicial complaint against the public defender and the Judge, Musti Cooke.
Same things happened to me.
My case has even other twists. It started out as an illegal traffic stop where I swerved to avoid being in an accident. Then when I videoed the state trooper who was in an unmarked car, who didn’t activate his lights on our first encounter, but the second, he took my phone and put me in handcuffs.
When I filed court paperwork the clerk of courts did not put it in the docket for the trial, but entered it in the docket after the trial but used the same date as the trial date.
It is unbelievable the corruption here.
I had court workers rip paperwork away from me when I signed "unduress" never to be seen again

Magistrates are like the short-bus of Judges. In some states ANYONE can be a Magistrate. It's elected and you don't even need any knowledge of law at all. It's crazy what people in those positions can do and get away with.

It seems that AZ has judges that don’t follow our constitutional rights and seems to be judging on public servants feelings about doing their job.
I found out the hard way to not use public defenders, it’s like you said they are deal makers. He didn’t want to help me . I dropped him and tried to represent myself but judge denied me that . I ended up hiring a real attorney who got it dropped. It was apparent the judge favored the PD and the cop. They see each other often at work & build relationships

Other lawyers should speak up on the public defender's unwillingness to file a motion to dismiss. They know it's the right thing to do and displays her intent not to properly represent Chris.
I like your use of 'chilling effect' in the second-to-last paragraph in your Kane complaint. I may have misunderstood, but if a motion to dismiss submittal is a required hoop to jump through in order for a future appeal to have merit, how can she ethically deny to do it? What is the big deal? It's just some paperwork. No comprende.

The court system has been broken for decades. Defendants get crappy lawyers who go to lunch with court officers. The state can spend tens of thousands of dollars against you, while you can't afford to do the same. I'd like to see the Supreme Court take that subject up.

Number one most lawyers do not file motions to dismiss. It’s actually rather rare, especially court appointed attorneys.
And of course, as soon as you threaten bar compliance, they’re going to withdraw because it’s a conflict of interest now their financial livelihood in their career is more important than their representation of you. No attorney should continue representing someone after they threaten bar complaint
Lastly, a judge can only appoint you in new attorney. If the one you have doesn’t want to be your lawyer the judge is dead wrong on that.
DD nailed it about the public defender. Never forget that the police chief, the DA, municipal judges and yes the Public Defenders all work for their local municipalities/corporations. They are all friends, belong to the same clubs, go out to lunch together and BBQ at each others homes. Their true goal/alliance is not to justice or the people they serve but rather to enrich the coffers of the local government/corporation that employ them.
Justice is rarely achieved at the municipal level but rather after appeal to a higher court that has no real connection to that local/municipal - corporation.
Next step is to appeal the Bar's decision, whilst also sending all the information (judge's ruling et al and bar complaint/response) to the next level in the Bar chain, the ACLU, the state and federal AG's and the media. Shining light on cock roaches is always a good thing.
Motion to dismiss is really standard. That seems like a lazy lawyer that no one is going to tell her what to do.

Being a public defender is the lowest form of being an attorney that you can get short of being an ambulance chaser. Ms. Herd, from what I can tell, just didn't want to put in the work. Needless to say, she didn't appear to want to buck the system but just get Mr. Ruff to roll over and take a plea deal.
"Motion to Dismiss" based of LACK OF HABEAS CORPUS! (Body of the CRIME) Three elements ofr a "crime" to have been committed: 1. Intent. 2. Property loss of damage. 3 Bodily injury or death. If two of the three do not pertain - there is no CRIME!

I've been behind courtroom doors. Public defenders work hand in hand with their counterpart. NEVER pick a public defender to represent you in something like this. I've seen the public defenders treat their clientele like baseball cards. Trust me they weren't at all meaningful to them either.

I've went through similar "justice" in federal court system against an appointed lawyer. In my case the judge threaten me if I say anything he would give me one year in jail for contempt of court. Eventually I was given a 5yr prison term on an "expired federal sentence" on a 5yr probation term 3yrs after an expired sentence. What an American justice system?

I’m dealing with the same issue in Virginia Beach Va. I filmed them when my friend was pulled over. They arrested me and with no record I had a $2500 bond. A week later I’m in VB and they hit me with a warrant for what idk but another city came to arrest me. That again was a $2500 bond. When I get to the jail they said I assaulted and battered a woman which I have never done in my whole life. I got a mouth and I’ll yell and cuss all day long but I never touched her. Never use threatening words to her, but she was going 20 and 40 and kept on me and then I hit her but thank God I have a dash camera and she won’t give me a license. She wouldn’t give me her insurance. She sat in her car all this crazy stuff. Finally I got her license, and she went and talk to me and I found out that the Virginia Beach police filed an assault and battery charge against me not her so now I’m dealing with the same crap as you not as intense, but I know what you’re going through there after me because I’ve been filming them for the last six months and they don’t like it!

The house always wins. They make the rules as they go, good luck. Our rights are just to make us think we have them, they can violate them at any time without recourse.
This is another practice that we have allowed to go on for too long. There are far too many people who do not understand the judicial process and who cannot afford an attorney. Instead of appointing a competent attorney for the best chance of a fair trial, the court appoints just any attorney.
Additionally, these appointed attorneys really have no skin in the game. They are not being paid by the defendant. So they have no incentive to actually create a good defense. They would rather sit on their ass and accept whatever plea deal is offered. How is this fair to the defendant? If the defendant wants to go to trial then the attorney should do his absolute best.
The sad truth is that unless you can afford to pay a minimum of $600 per hour for a trail attorney you are at the complete mercy of the crooked justice system.
