International Court of Justice: Arguments heard over Russia’s genocide claims

  • Judges at the International Court of Justice are hearing arguments from Russia and Ukraine about Moscow's claims that it launched its invasion to prevent genocide.
    Ukraine brought the case to the United Nations' highest court, days after Russia invaded last year.
    Kyiv accuses Moscow of abusing international law by falsely alleging genocide in eastern Ukraine.
    Russia wants the case to be thrown out, and objects to the court's jurisdiction.
    Geoffrey Nice joins us from Canterbury in the United Kingdom.
    He is Emiritus Gresham Professor of Law and the Former Lead Prosecutor of Slobodan Milosevic for the United Nations at the International Criminal Tribunal for Yugoslavia.

      Genocide : crime pour motif d'ethnicité, religion, langue,...le nombre ne fait pas la qualification du crime, mais la motivation. Or l'Etat Ukrainien les avait permis, ensuite amnistié et engagé les organisations génocidaires , maintenant leurs structures, au sein des troupes du ministère de l'intérieur. Même le chef du service des renseignement militaire , le Général Budanov, a, en matière, un passé pas très recommendable...     At this point unconditional surrender is the only practical solution for Ukraine. Hitler's Germany also refused to admit defeat until Hitler killed himself, then Keitel signed unconditional surrender. The war is already lost by Ukraine. Zelenskyy offensive is going nowhere . Meanwhile new Ukrainian defense minister Rustem Umierov wants to officially enlist 16-year-olds, obviously Zelenskyy offensive was so successful that even official forced conscription of disabled and people with AIDS and hepatitis wasn't enough. WaPo is reporting that yet another Zelenskyy debacle caused bitter recriminations on Capitol Hill: "The bleak outlook, briefed to some Republicans and Democrats on Capitol Hill, has already prompted a blame game inside closed-door meetings" (WaPo article "U.S. intelligence says Ukraine will fail to meet offensive’s key goal"). Ukrainian army in its current dismal state proved to be completely impotent. It's the result of a successful implementation of an attrition strategy.

      NATO expansion is a voluntary choice by countries who wish to join. Russia can't dictate how much NATO is allowed to expand. And if Russia really wants countries to stop joining NATO, then it should be friendlier towards its neighbors and not make meaningless threats.

But the consensus is that the average within the low hundreds of thousands over a period of 9 years.       There was legal justification to invade Afghanistan to overthrow the Taliban. Although Iraq was more legally dubious, nobody is really upset that Saddam Hussein was overthrown. And neither were directed towards petty, ancient grievances, territorial expansion or genocide, unlike what happened in Bosnia, Kosovo, Rwanda and now Ukraine.

    Crimes of genocide have been comitted, and have been excused. Crimes of genocide have followed again.
    Contest this is stupid and injustice.
    But the number of victims is low, less than terrorism of Organisation Armée Secrète , Al Qaeda, more than Rote Armée Fraktion. It can't be compared with what happened during the Holocaust, the three mass-genocides of Burundi, the Halloween massacre in Luanda, the massacre, partially genocidary , by the Interahamwe in Ruanda ( 1 in 4 victims was not Tutsi, but Hutu opposed to tribal violence , or just refusing that quaification based on supposed ancestry ).
    So, yes , there IS genocide in Ukraina, by neonazi milicians protected and powered by Nato ( maybe more than by Zelenski ), BUT the number of victims can hardly justify the intervention.
    Anyhow, not all citizans of Russia are ethnical Russians, not all ethnical Russians are citizans of Russia. There is no reason to go to war for that sake. A yakouti is citizan of Russia, but as there aren't Yakuti-victims, he should not be concerned? Why, if so, that mant Tchetchens, Bouriati,...?
    So, yes, there was /is genocide, the legal governement didn't even trie to protect the victims, but encouraged those who committed those crimes for reasons of ethnic, linguistic, religious, ...belonging ( so, crimes of genocide).
    But the character wasn't massif enough to justifie the war.
    If UN would pretend there wasn't genocide, murdering for those motives isn't genocide ? Than from how many victims begins genocide?
    The refusal to grant protection justifies the right to decide themselves concerning their sovereign belonging as region and as population. Self-determination is justified.

But schools, hospitals, market places, or even opera houses are not "strategic" targets, but it doesn't stop Russia from launching missiles and killing civilians. Second is a bridge used for transport of military good, so no "terrorist attack" occurred, and the incident in Poland would not have happened had Ukrainian air defense not been trying to shoot down a russian rocket, as there would have been no rocket for the anti-air missiles to miss.

And you spent 20 years in Germany, 10 without a German passport and what did you do? Instead of going online and talking rubbish about "democracy" and "human rights," how about go seek legal advice about immigration, residency stay or nationality in Germany?
